They never called me and told me where the vehicle was and my possessions were never returned to me.

I did not get a response. Addressed to XXXX XXXX. The dates are as noted, XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX. I have not received an update on my previous request to reduce the payoff amount and interest rate, due to overpayment. I am forced to be under a new payment plan. I have kept up with my payment agreements, and I would like to ask that you reduce the vehicle 's payoff due to the vehicle 's worth being around {$1500.00} and the high interest rate is at 23.02 %. I suggest that the vehicle 's resale value is less than the payoff of {$8700.00}. It should be reduced, along with my interest rate, monthly payment, and payoff value. I am looking forward to your immediate positive response to my concerns regarding my overpayment several times. I have provided you all with ample proof of the overpay. I have mentioned overpayment, and it was ignored in XXXX, several letters were sent out and no one would address it ( XXXX XXXX of XXXX ). Consumer Complaint: I am writing this complaint because Credit Acceptance is taking advantage of my rights. They keep calling and harassing me and placing my car into repossession. I am facing hardship right now and advised the company of my situation and they still placed my car under repossession. I also looked on my credit report recently and noticed that they are illegally reporting information on my credit report, and it need to be removed immediately. Under 15 USC 1681e ( b ) it states this ( b ) accuracy of report whenever a consumer reporting agency prepares a consumer report it shall follow reasonable procedures to assure maximum possible accuracy of the information concerning the individual about whom the report relates. According to 15 USC 1681i ( 5 ) treatment of inaccurate or unverifiable information. This information needs to be deleted from my credit report.

Consumer Complaint: After being fraudulently entered into this car loan which I informed credit acceptance of, Credit acceptance continued to proceed with the loan and its terms. Persuant to 15 USC 1635 your company have violated multiple laws required by your company such as, Disclosure of the consumers right to rescind a contract in which a security interest is or will be retained. Providing Rescission forms for the consumer to successfully rescind a contract if he/she so desires. Many more finance requirements that were not explained or disclosed that will be added to my civil suit. Persuant to this section of the law you are required to rescind this fraudulent contract and refund all moneys paid out including, but not limited too any down payments made. The law also states in section ( g ) of 15 USC 1635 : ( g ) Additional relief In any action in which it is determined that a creditor has violated this section, in addition to rescission the court may award relief under section 1640 of this title for violations of this subchapter not relating to the right to rescind. 1640. Civil liability ( a ) Individual or class action for damages ; amount of award ; factors determining amount of award Except as otherwise provided in this section, any creditor who fails to comply with any requirement imposed under this part, including any requirement under section 1635 of this title, subsection ( f ) or ( g ) of section 1641 of this title, or part D or E of this subchapter with respect to any person is liable to such person in an amount equal to the sum of- ( 1 ) any actual damage sustained by such person as a result of the failure ; ( 2 ) ( A ) ( i ) in the case of an individual action twice the amount of any finance charge in connection with the transaction, ( ii ) in the case of an individual action relating to a consumer lease under part E of this subchapter, 25 per centum of the total amount of monthly payments under the lease, except that the liability under this subparagraph shall not be less than {$200.00} nor greater than {$2000.00}, ( iii ) in the case of an individual action relating to an open end consumer credit plan that is not secured by real property or a dwelling, twice the amount of any finance charge in connection with the transaction, with a minimum of {$500.00} and a maximum of {$5000.00}, or such higher amount as may be appropriate in the case of an established pattern or practice of such failures ; As a second time Credit acceptance customer Im 1000 % positive that I can prove a pattern of violations on credit acceptance behalf, as you guys even repoed my last car after it was paid off according to the law, that classifies as theft, being that our whole contract was fraud. With pain and suffering from this vehicle almost killing me and my children, because of it being an unroadworthy vehicle. Breaking down twice since taking it off the lot, the first time being the same night of purchase and never working pass 15days. Having to lose my job due to not having a vehicle and using all of my savings to take my children back and forth to school in XXXX and on the City bus, Im sure a jury would be very generous in there verdict. I have sent this letter to XXXX XXXX as I am suing them also for violations, fraud, deception, breach of contract, etc, Just As I am filing civil charges against your company. '' XXXX, XXXX and XXXX are consumer reporting agencies and I am the Consumer. I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states " It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' XXXX XXXX, XXXX, CREDIT ACCEPTANCE, XXXX XXXX are financial institutions by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' XXXX XXXX, XXXX, CREDIT ACCEPTANCE, XXXX XXXX, any financial institution and the Consumer reporting agencies XXXX, XXXX and XXXX DO NOT have my consent to furnish this information and they surely DO NOT have my written consent. Any and all consent to XXXX, XXXX, XXXX, XXXX XXXX, XXXX, CREDIT ACCEPTANCE, XXXX XXXX, whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' XXXX XXXX, XXXX, CREDIT ACCEPTANCE, XXXX XXXX Never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information : Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' These accounts are adverse items they are reporting without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. XXXX, XXXX and XXXX are not maintaining reasonable procedures. Also 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. '' I am opting out of your reporting services.
