Issue: Attempts to collect debt not owed
Subissue: Debt was result of identity theft
Consumer Complaint: I purchased a car XX/XX/XXXX and noticed my signature has been forged and identity theft was committed said date the contract was established with XXXX XXXX the initial contract has been assigned to a 3rd party dealer without my consent or knowledge meaning the initial retail installment contract I signed with my true signature and the contract that has my forged signature is not the same nor did i willfully give any consent for anyone to sign said contract on my behalf i was tricked forced and coerced into this contract with Credit Acceptance for {$41000.00}. XXXX XXXX withheld pertinent information from me for example my right to rescind, falsely stating optional features are required. I've sent 3 letters to credit acceptance on XX/XX/XXXX XX/XX/XXXX XX/XX/XXXX all via certified mail to exercise my right to rescission and taking steps of filing for identity theft XXXX and called their corporation on this day XX/XX/XXXX to let them know of this fraudulent account and awaiting a response. This has caused me tremendous XXXX XXXX discomfort and damage..

Issue: Managing the loan or lease
Subissue: Problem with fees charged
Consumer Complaint: Someone working within Credit Acceptance Auto, illegally charged and stole money off 11 months of the entire car loan with them, ruining my credit, as well reporting false information as well. I went to an accountant and they came up with {$1000.00} in stolen money they charged if excess fees. They only charge {$5.00} a month in late fees, which is stated on the contract I have from them... They also did not honor covid assistance, reported late payments when they said they would not during covid, they also reported several times 30 days past due when I was only a few days past due. They also reported a past due amount of {$300.00} in XX/XX/2021, when in fact I was not!!! Balances should never go up but as one can see with the image I attached, it happened, their cap for a monthly late fee is {$5.00}, not {$10.00}, nor {$100.00} etc, I attached the proof of the illegal fees ranging from {$40.00} to {$100.00}, as well as the reported {$300.00} past due, in which one can clearly see, I was paid for XXXX and XX/XX/2021!!! Then they tried to cover it up by clearing what they reported in the XXXX report! That is attached as well ... Also the interest was already accumulated in the total loan, from the beginning of the loan, not monthly excessive fees because I was late or even on time from the 4rth month it the loan. None of this was in the contract, which is attached as well. This from what I read has been a common practice with this company over the years from lawsuits to complaints of the same nature! I also had to hire a Credit Firm to help with this as well as spend money for the accountant for this illegal nonsense! Also have many many recorded phones calls of lying straight to me, as well as a response from an Attorney they used, lying regarding this situation as well.

Consumer Complaint: I sent out certified copy of my complaint to resend the contract to the CEO of the lending company on XX/XX/2022. I declared there was a problem, with the contract that was given to me the car lot that was associated with the loan that was given to me has officially closed down. There was a lot of fraudulent acts within that contract, and I reset out certified copies of a complaint again on Thursday XX/XX/2022 to the CFO and see COO of the loan company. I am expecting some type of mediation and the return of all the money that I had put into the loan return to me.

Consumer Complaint: Made ridiculously high payments on time they made a payment plan for late fees that I did not even owe and I do not know how to fix this because when I do get in contact with someone they're trying to make a new payment plan for things I don't understand you're telling me I was late for my first car payment after I paid my first car payment right after it said it was late already so it's always been late since I began to pay for the car which is very awkward
