Consumer Complaint: I'm XXXX XXXX, and I need your help in contacting this company. I made an attempt to get in touch with them to ask why someone had registered an account in my name. I regret that this extremely significant issue is now harming my credit profile. Since it also violates data privacy, I do not let anybody to use my name, date of birth, or any other information. They must identify who started the account in my name and just provide that individual my information. Kindly help me in solving this.

Consumer Complaint: Dear Sir or XXXX : I am writing this complaint to you today regarding the practices of this company, and the response I received from this collections company, concerning an alleged debt. I sent a validation request to Convergent Outsourcing XXXX IncXXXX dated XXXX XXXX, 2022, in response to a negative entry on my credit reports listed by this collection company. The alleged amount owed stated was {$1300.00}, and the alleged creditor listed was XXXX. I sent this debt validation request certified electronic return receipt signature required via usps on XXXX XXXX, 2022. Records show the collection company received the validation request XXXX XXXX, 2022. The company responded in a timley manner as per the Fair Debt Collection Practices Act. I recieved a response dated XXXX XXXX, 2022. The issue and basis on this complaint is that the response was not appropriate, nor did it meet the requirements of the Fair Debt Collection Practices Act standards for verification or debt validation. The reponse to my request included a XXXX XXXX to be completed by the original creditor, or completed on the original creditor 's behalf, and returned to me as requested. My dispute and validation request for verification also contained a Request for Production of Documents pursuant to the full records of the account from both the collection company and the original creditor. All requests for information including the Verification or Debt Validation Request, Creditor Declaration, and the Request for Production of Documents were ignored and disregarded. The response I received from Convergent Oursourcing , IncXXXX was a fraud packet they erroneously stated I requested. This is a direct violation of the Fair Debt Collection Practices Act. The company continues reporting the entry without verifying or validating the information. As you are well aware, it is the collection company 's responsibility to provide the information to the alleged consumer upon request for validation or verification. I have disputed the entry with XXXX and XXXX, to which they have failed to respond or remove the unverified entry as well. XXXX and XXXX have failed to properly investigate upon dispute, failed to repond to the request for verification, and failed to remove inaccurate information upon notice of such status. I am writing seperate complaints for these credit bureaus, as they are complicit in this not being investigated, verified, or removed. I am requesting either an appropriate response to my Validation Request, Creditor Declaration, and Request for Production of Documents containing the information requested in these documents to meet the standard of debt validation, or that the company remove the negative entry from all credit bureaus in which it is being reported to. I have attached records of the original letter of dispute and request for validation, signature proof of reciept, creditor declaration, and request for production of documents, and the response I received to support this complaint.

Consumer Complaint: I received notification on XX/XX/2022 from XXXX and XXXX on my credit reports that a new collection was added. The collection agency Convergent Outsourcing NEVER sent me ANY letter informing me that they had my account from XXXX or any letter for that matter that they had my account in collections since XX/XX/2022 according to what's being reported in my credit reports. 4 months later it gets reported to my credit reports. Why was I not notified that my account was sold???!!! I would've been able to pay the account off prior to it being reported to my credit reports. I was unaware that my account had even been sent to collections because I was making regular payments to XXXX to pay the account down and they also never sent me a letter stating my account had been sold. XXXX kept accepting my payments leading me to believe they still owned my account and the whole time they sold my account to Convergent Outsourcing without my knowledge! So the original creditor XXXX never sent me any letter nor did Convergent Outsourcing. I do not owe Convergent Outsourcing any money. I have already paid XXXX the remaining balance of {$150.00} on XX/XX/2022 that was owed to them. I do not owe the collection agency because I was not even aware they owned my account until it was placed on my credit reports and I want this collection deleted from every credit reporting agency that Convergent Outsourcing has placed it on due to them not letting me know my account had been sold to them.

Under the Fair Debt collection Practices Act ( FDCPA ), I have the right to request validation of the debt you say I owe you. I am requesting proof that I am indeed the party you are asking to pay this debt, and there is some contractual obligation that is binding on me to pay this debt. Consumer Complaint: I recently received a copy of my credit report. The state of Texas statute of limitations is only 4 years from the date of the last payment. This alleged debt continues to appear on my credit report as a violation of the statute of limitations. I request validation of this debt per Texas Finance Code Section 392.202 which requires a debt collection agency or credit bureau to provide the alleged debtor with specific information concerning their debt including but not limited to ; For the purpose of validation provides me with : The name and address of the original creditor. The original date of default or non-payment of the debt with the original creditor. The date the debt was transferred from the original creditor to the third party debt collector. The original balance. The current balance. Any fees added by your agency. Sec. 392.303 ( a ) ( 2 ). I did not sign any agreement and/or contract with this company regarding any allege debt. And this company should provide a valid recorded copy of an assignment of transfer to be able to attempt to collect on noncollectable debt after the statute of Limitations. Texas Surety bond information as required by Sec. 392.101 - my original signature on the application from the creditor - my original signature on an application with your office consenting to any service Please note XXXX, XXXX, and XXXX are bonded in the state of Texas and are required to comply with Texas Finance Code. If a debt collector has failed to respond to your debt validation request, then they have essentially admitted, per Texas Finance Code 392.202 ( b ) ( 2 ), that the debt in question is inaccurate. Per this requirement you must delete this tradeline if you do not have sufficient time to complete an investigation to validate this debt in 30 days according to Sec. 392.202 ( d ) ( 1 ) Also per Texas Finance Code 392.202 Correction of third -party debt collectors or credit bureaus files. I request immediate notification by mail if this alleged debt is sold or transferred per Sec. 392.301 ( a ) ( 4 ). This company is also attempting to collect on alleged debt that has exceeded the statute of limitations in the state of Texas. Under the Fair Credit Reporting Act, 15 U.S.C. 1681g I have the right to demand that you disclose to me all of the documents that you have recorded and retained in your file at the time of this request concerning the accounts that you are reporting in my credit report. Please dont respond to my request by saying that these accounts have been verified. Send me copies of the documents that you have in your files that were used to verify them. If you do not have any documentation in your files to verify the accuracy of these disputed accounts then please delete them immediately as required under Section 611 ( a ) ( 5 ) ( A ) ( i ). By publishing these inaccurate and unverified items on my credit report and distributing them to 3rd parties you are damaging my reputation and credit worthiness. Under the FCRA 15 U.S.C. 1681i, all unverified accounts must be promptly deleted. Therefore, if you are unable to provide me with a copy of the verifiable proof that you have on file for each of the accounts listed below within 30 days of receipt of this letter then you must remove these accounts from my credit report. Please provide me with a copy of an updated company letter showing these items removed. I demand the following accounts be properly verified or removed immediately as these alleged debts continue to be resold by the last payment date should remain the same by Texas Finance Code 392 and the FCRA regulations. This company is also attempting to collect debt that has exceeded the statute of limitations in the state of Texas. This company does not have my permission to call me on any cell phone I may have possessed, currently possess or will possess in the future. They need to cease and desist their threats to sue requesting that I submit a written plaintiff statement in my defense and schedule a time and location for delivery of whatever, which is a violation of collection practices to threaten to sue someone or deliver lawsuit/judgment items to their place of employment. I am seeking an attorney to discuss a class action lawsuit as I believe this is their practice and they are violating several laws including Texas Finance Code 392.202 ( b ) ( 2 ), FCRA, FDCPA, Texas Debt Collection Act and TCPA 47 U.S. Code 227. These calls are harassment and have been going on for months, which is a violation of FDCPA. A complaint has also been filed with the Texas Attorney Generals office. I will also be filing a lawsuit in the state of Texas due to the violation of the TCPA and FDCPA. Please reply with your response via US MAIL. Do not contact me by phone as it is inconvenient. Do not contact my family, acquaintances, or employer in any manner. Please note I am fully prepared to pursue my rights for the harm this inaccuracy has done to me. Sec. 392.403. CIVIL REMEDIES.
