Issue: Problem with a credit reporting company's investigation into an existing problem

Consumer Complaint: During the months of XX/XX/XXXX-XX/XX/XXXX, my wife and I disputed by mail and contacted by phone with recordings Jefferson Capital LLC., XXXX XXXX , and XXXX XXXX XXXX , and the three credit bureaus. We submitted the claim disputing the adverse account that was reported to the credit bureaus on both of our credit reports. What was once a charge off on both of our credit reports became an open collection account. This was done after an inquiry was made, without notification, and investigation of a claim. What my wife and I both inquired, in two different disputes and multiple phone calls on the following dates : XX/XX/XXXX, XX/XX/XXXX-XX/XX/XXXX, XX/XX/XXXX,XX/XX/XXXX,XX/XX/XXXX, and XX/XX/XXXX, was the validity of Jefferson Capital 's claims. We requested during conference calls, an itemized document that furnished a full account summary and itemized calculations of the alleged debt. We requested the company provide, the dates and times used in the attempt to make payment arrangements, or alert us that a debt was owed of {$100000.00}. Before we had any knowledge of Jefferson Capital on our credit reports I, the husband, was pre-approved for a home loan. Two months passed as I waited for my house to sell. It was during this time when I submitted for my annual credit report and noticed Jefferson Capital was listed as a negative account and made my first dispute. When the home finally sold, three months had gone by and I had to re-score to pre-approve for the home. It was then that our lender said there was a dispute on my credit report and we could not be approved with an open dispute. XX/XX/XXXX, Agent XXXX XXXX explained my wife and I that she could not identify or locate any account with my nor my wife 's social security number, maiden name, married name, address, nor phone numbers. Before Dispute Was Made 1. Jefferson Capital 's agents reported, " The alleged account could n't be identified or located using neither my nor my wife 's social security number, maiden name, married name, address, nor phone numbers. '' 2. After dispute on XX/XX/XXXX, Jefferson Capital reported over the phone, The account in question is now assigned to XXXX XXXX. Please call them. '' My wife and I called XXXX XXXX and they sent us back to Jefferson Capital because they were also unable to locate the account using neither my nor my wife 's social security number, maiden name, married name, address, nor phone numbers. ( After alerting the companies that we were recording their statements, Jefferson Capital and XXXX XXXX responded saying, " Speak with XXXX XXXX XXXX, our assigned representation. '' ) The company no longer spoke to myself or my wife about the questions and concerns we had about our alleged loans or the status of our dispute. Jefferson Capital reported they owned the loan. XXXX XXXX reported they serviced the loan and assigned it to a firm. XXXX XXXX XXXX reported that they are the company 's representation and could answer my concerns regarding the status of the dispute. XXXX XXXX XXXX furnished a letter during XX/XX/XXXX in response to our dispute letter sent on XX/XX/XXXX confirming : 1. Who my wife was before marrying me. 2. She owed and was obligated to pay XXXX XXXX XXXX XXXX XXXX Account in the amount of {$10000.00}. 3. A contract signed by my current wife given to them from the date XXXX/XXXX/XXXX. The company also mailed a bill of sale and assignment in response to our dispute. What was signed on XX/XX/XXXX was a Signature Student Loan Promissory Note. A contract Jefferson Capital allegedly made between themselves and my current wife. Section B ( cosigner information ) and Section C ( cosigner signature ) are both blank on the contract Jefferson Capital furnished. This further confirmed to me that I had no parts in obtaining this loan. The contract was allegedly obtained on XX/XX/XXXX and I did not marry my now wife until 10 years later. This confirmed to me that I was not obligated after all payments credits and offsets had been applied according to the letter furnished by XXXX XXXX XXXX on XX/XX/XXXX. The credit bureaus XXXX and XXXX mailed a completed report concerning the investigation. The alleged loan is still in collection status. My wife and I sent another dispute on XX/XX/XXXX reporting the errors Jefferson Capital made and their response to our dispute sent on XX/XX/XXXX. 1. We verified debt does not belong to me, the husband, according to Section B and C of the contract they furnished. 2. All of my wife 's student loan debt, private and federal, has been consolidated by XXXX XXXX. XXXX was the original owners of XXXX XXXX 's federal loan accounts. XXXX was the owners of XXXX XXXX 's private loan accounts. XXXX XXXX took over both companies accounts with my wife and has established a repayment schedule since XX/XX/XXXX. XXXX XXXX, XXXX XXXX, nor XXXX XX/XX/XXXX XXXX have yet to furnish myself nor my wife with any written or verbal notification itemizing in detail this alleged debt. XX/XX/XXXX my wife sent a second dispute and was told on recorded phone calls and was told by XXXX XXXX XXXX that the dispute had been received XX/XX/XXXX, but results could take up to 60 days to receive. The status of the dispute was pending after the 30 day mark according to the agents when we would call and record. My wife and I indicated prior to each recorded call that the calls were being recorded. My wife also reported to XXXX XXXX XXXX that XXXX sent a letter and that she had questions about the results of the investigation. The agents from XXXX XXXX XXXX and Jefferson Capital both reported that no determination had been made regarding my nor my wife 's dispute and XXXX 's letter was sent in error and investigations can take up to 60 days. XXXX XXXX XXXX continued to take my wife 's contact information and ensured we would be contacted when a decision was reached. XXXX XXXX XXXX also said they would forward a message to Jefferson Capital to expedite their investigation process, but this never happened. We have recorded phone calls for the dates we contacted both companies and questioned how XXXX could send an outcome that both XXXX XXXX and XXXX and XXXX denied ever reaching. Those phone call dates are as follows : XX/XX/XXXX at XXXX XXXX, XX/XX/XXXX at XXXX XXXX, XX/XX/XXXX at XXXX pm, XX/XX/XXXX at XXXX XXXX, XX/XX/XXXX at XXXX XXXX and XXXX XXXX, XX/XX/XXXX, and XX/XX/XXXX at XXXX XXXX and XXXX XXXX. My wife finally contacted XXXX on XX/XX/XXXX and asked how it was possible they sent a letter with an outcome to our dispute on XX/XX/XXXX while both Jefferson Capital and XXXX XXXX XXXX continued to report that no decision had been made, there were no results, claimed investigations could take up to 60 days, and that XXXX made an error in sending the reports to myself and my wife with an outcome listed. The agent from XXXX refused to be recorded, but reported to my wife that the decision was made on XX/XX/XXXX by Jefferson Capital and that is why the XXXX outcome report was sent to myself and my wife. XXXX reported no error was made on their part, but rather my wife and I were sent what was given to them at the conclusion of the investigation from Jefferson Capital and XXXX XXXX XXXX.

Consumer Complaint: I have received multiple letters from Jefferson Capital Systems stating they are attempting to collect a debt for XXXX XXXX. I have made several attempts to contact the company to inform them the account is not mine and was opened with my stole personal information. My credit report states the account was originally reported on XXXX XXXX, 2017 in the amount of {$620.00} and I have had a different cellular phone carrier for over 5 years. I have also emailed the company filing a complaint with them so that they can send some kind of verification that the account was actually opened by myself but again no response has been sent from the company.

Consumer Complaint: Approx XXXX I had an account with XXXX XXXX, which ended when the cell company refused to show me reasoning for the amount claimed owed approx. {$750.00}. I specifically ask for dates, reasoning for the extra charges, why we were being charged the extra fee 's, who authorized any additional plans, etc ... XXXX responded back stating the account had been turned over to a collections agency. We immediately contacted the collections agency requesting the same intel as with XXXX. The collector replied stating they were unable obtain the intel we were requesting, but demanding to be paid. So we refused to pay the amount of the debt we simply did NOT owe, but simply offered to pay what they could prove we owed ... I admit we owe them money, but only XXXX of what they claimed. Now, 5 years later, we have a different collector requesting to be paid, but each time, with each collector, the amount keeps growing ... Now, the bill has grown to {$1000.00} but offering if we pay in full, they 'll reduce it to {$530.00} and show on our credit report " AGAIN '' as a debt write-off ... Which I 'm sure they will sell that amount to a different collector ... How can our XXXX allow for the credit companies to keep selling and re-selling, and re-selling, and keep re-selling a debt and keep putting it on your credit report without having to show how or why you owe the amount claimed ...? Any help is greatly appreciated ... Many thanks,

Consumer Complaint: C/C TO C.F.P.B. In the court case referred to above, the Federal Trade Commission alleged that Jefferson Capital Systems , LLC violated the Fair Debt Collection Practices Act, 15 U.S.C. 1692 et seq. and participated in unfair and deceptive business practices under the Federal Trade Commission Act, 15 U.S.C 45 ( a ). ( See Federal Trade Commission v. XXXX XXXX and Jefferson Capital Systems , LLC, Case XXXX XXXX. Ga. , 2008. ) Is it conceivable you could get your company to remove this unlawful, and illegal stain off my credit report concerning account number? In nearly 50 plus years dealing with any companies, I have never been so victimized and wronged so severely about an account that is not mine. I have left several messages with no responses from your employees. I have told your company this is not my account, and I dont have a clue where this originated from. I have sent them a police report to substantiated I had identity theft, and this is not my account. I need to hear from you to make an informed decision about your claim that I owe this money. I am extremely distraught that your companys defilement of another Veteran credit report. I am open to communicating with you for this purpose, only! In order to make sure that I am not put at any disadvantage, in the interim, please consider this debt as being in dispute, not mine, and under dialogue amongst us. The federal Fair Debt Collection Practices Act ( FDCPA ) offers consumers protection in contradiction of excessively antagonistic debt collection actions by collection agencies like yours. Your company has violated federal law in its dealings with me. Your company has forced me to report your company to our government agencies, and I have given them revelations to your violations, and using unfair, and the illegal credit bureau reporting tactic regarding a debt that doesnt belong to me, sadly. I do not appreciate your process, and the way your company trying to strong arm me by implementing a deceptively with your quixotically unlawful assault on my character. The last time I talked to your company an employee made a racist statement stating, You people never pay your bills! Really? This is very disrespectful, and a direct degradation of my personality with unwarranted racist undertones expended by this individual. I do not comprehend this, or grasp this on any level. I have never ever been talked to, or talked down to like this in my entire life, and I was reared doing the Civil Right Movements. This is a sneaky way to justify your company qualification without concrete evidence, and using deprived services ; I am writing today to complain of the unprofessional service I received in this un-forgetful process. I only wanted to get a V.A. Loan after I sacrificed my life for this country with honorably behavior. I will make sure every V.A. Associations aware of your company unprofessional and racist ways, and I am prepared to inform folks about your company on all social media sites. I just now researched this company, and you all are notorious for lowballing customers, using derogatory, and racist languages to XXXX. XXXX XXXX is XXXX and gone ; however, the ghost of XXXX XXXX is alive and well. Currently, I have to deal with his nephew and niece, XXXX XXXX XXXX XXXX, XXXX. I would welcome the opportunity to discuss matters further and to learn of how you propose to prevent a similar situation from recurring. I eagerly await hearing from you.
