Issue: Attempts to collect debt not owed
Subissue: Debt was result of identity theft
Consumer Complaint: I disputed this Jefferson capital system account and did not get a proper dispute result. The validation letter I sent reads as such : I checked a copy of my credit report and realized that there was a collection reported from your agency, which I was not notified about. I do not reject to provide with the debt amount. However, this is a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 ( b ), that your claim is disputed and a validation is demanded. This is asking for proof regarding the debt that I owe and verifying it. I am requesting you to stop all collection activities including reporting this information on my credit report. I am sure that you are aware of the fact that non-compliance with this request may end up in legal obligations.
Please dispatch copies of the following with your reply : 1. The agreement which authorizes you to collect debt on the assumed debt. 2. The signed agreement from the debtor confirming to pay the debt. 3. The documents regarding the payments made on this account and validation of the amount. Jefferson capital failed to validate this account. This account need to be removed immediately. Jefferson capital system is violating the laws.Company Response:

Consumer Complaint: When I was XXXX ( roughly XXXX years ago ) I opened a {$500.00} limit credit card with XXXX XXXX. I did not close out the account. The debt was sold to a debt acquisition company and sold again to a similar company ( Jefferson Capital Systems LLC ). This company waited until XXXX to enter the judgment against me and used " gutter service '' tactics so I had no idea I was being sued and I had no idea that court date was taking place and I was unable to represent myself. When the judgment was entered in XXXX of XXXX the debt had increased from the original {$500.00} amount credited to {$4500.00}. Jefferson Capital Systems LLC then waited until XXXX of XXXX to begin garnishing my wages. In the four years that passed ( XXXX ) the debt sky rocketed to an unrecognizable amount of {$10000.00}. Yes, a {$500.00} limit credit card turned into a {$10000.00} debt that continues to grow because it still collects interest. I am a single father that works 40+ hours a week and I am XXXX XXXX to try and move vertically in my company to create a better life for my child. I 've already paid over {$7000.00} via garnishment and I still have over {$6000.00} more to pay. This is obnoxious and unreasonable and unfair practices. I have been trying to defend myself but all my motions have been denied. My latest motion cited the federal trade commission to see copies of the original credit agreement and the documents I need to confirm the principal amount and confirm the debt amount was denied. Is there anything I can do to seek justice or will I continue to have the life sucked out of me for a debt that has been paid off 10 fold already?

Issue: Attempts to collect debt not owed

Consumer Complaint: I first asked the cred itor Jefferson Capital Systems to verify the debt, they are collecting on behalf of XXXX . I asked them to provide me with a billing statement to verify all charges from XXXX , my account number from XXXX and the types of services I had. They failed to do this. I disputed this on my credit report as inaccurate info. The Credit Bureau responded and said that the information was accurate. I no longer disputed it and stated that it 's not under dispute anymore ; however, the collection agency sent me an actual copy on my credit report and I noticed that the information they have reported still is n't accurate and does n't make sense. They said the collection account was opened XXXX . They are reporting that the date of first delinquency was XXXX which is incorrect because I still had services with XXXX in XXXX of XXXX and the account was active and open and not delinquent. They also reported that the date the first major delinquency was report was XXXX , so if this is the case then how was the collection account opened before the first major delinquency was even reported. The dates are conflicting and it makes no sense and I requested the Credit Bureaus remove this inaccurate conflicting info but they still have refused to do so.
