Consumer Complaint: My name is XXXX XXXX, a federally protected consumer, and I am making this complaint against JEFFERSON CAPITAL SYSTEM for committing identity theft. I have never given JEFFERSON CAPITAL SYSTEM any permission to use any of my identifying information to commit mail fraud by contacting me about an alleged debt they claim I owe. I am legally refusing to pay this debt pursuant to 1692c ( c ). I am demanding a cease and desist of all illegal activity, any communication and collection activity, of this and any alleged debts until JEFFERSON CAPITAL SYSTEM can provide me with sufficient documentary evidence, such as a trilateral contract, that I have any legal obligation to pay them. If this documentary evidence can not be produced and JEFFERSON CAPITAL SYSTEM continues its collection efforts, I will file for litigation for actual damages caused and JEFFERSON CAPITAL SYSTEM will be held criminally liable for aggravated identity theft pursuant to 18 USC 1028A, extortion, theft by deception, securities fraud, and mail fraud. They have also had ownership of this account for years and previously removed it because they could not validate the debt. They now put it back on my report as a brand new debt collection. It is also for 6 times the original amount. Attempting a complaint here before I pay the lawyer I consulted with.

I asked the original company to show me proof of debt not using automated machines and this has not happened. I have disputed in emails that Jefferson Capital has sent me again asking for validation, proof that I owe this debt and I have not received this. No one is providing me with legitimate proof just responding yes you owe. This is against the law. And if we can not get this taken care of I will have to pursue this legally my rights are being violated

It is also a direct violation of 15 USC 1692e - False or Misleading Representations under 15 USC 1692e ( 8 ) because credit information that is known to be false is being communicated to consumer reporting agencies. This company violates 15 USC 1692g - Validation of Debts, as well for the reason that I was never never sent a written notice to dispute the debt.
