Consumer Complaint: On XX/XX/2023, after months of research on an ideal hotel with an mountain view and private on-air bath in mind, I booked XXXX XXXX XXXX XXXX for 2 nights through Capital One Travel portal XXXX My booking that I placed had the following requirements which affects the hotel pricing : XXXX person, no breakfast, no dinner Guest Name : XXXX XXXX Confirmation # : XXXX Check-in:12/16/2023 XXXX 2 Nights, 1 Room Total Cost Divided Per Night XX/XX/2023 ( Night XXXX ) Accommodation {$360.00} Taxes and Fees {$36.00} XX/XX/2023 ( Night XXXX ) Accommodation {$360.00} Taxes and Fees {$36.00} Accommodation Total* {$730.00} Taxes and Fees Total {$73.00} Total Cost {$810.00} In total, my booking at XXXX XXXX XXXX was XXXX which was around XXXX XXXX XXXX XXXX I arrived at XXXX XXXX XXXX XXXX XXXX on XX/XX/2023 and was told i had no reservation with them. And that my reservation was with their sister hotel " XXXX XXXX '' which is exactly the opposite hotel style and luxury of XXXX XXXX I asked how could this had happen and XXXX said Capital One booked the incorrect hotel for me. As I was in the country side of XXXX without knowing a single XXXX, there was no argument here and I had to take their sister hotel or I'll be living in the streets of the country side in XXXX. XXXX had XXXX shuttle bus ride me to the sister hotel but did not communicate with the driver at all and the driver drove me back to the train station. Not knowing a single XXXX, i used XXXX translate and was able to get the driver to drive me back to the correct hotel. This issue caused a time waste of more than 1 hour. Arrived at the sister hotel " XXXX XXXX XXXX, '' I was told my booking was the following : 2 double beds, 2 guest, breakfast and dinner plan. 1 ) In my booking on Capital One, I clearly stated 1 person only myself, no guest 2 ) I didn't opt in to no breakfast and dinner plan knowing there's a cost involved. XXXX ) Hotel room type is totally different, not only it had no private balcony with open-air bath, it was a standard double bed room. XXXX ) The sister hotel was a lower end hotel than the one i booked which was XXXX a night. I checked the sister hotel " XXXX XXXX XXXX '' pricing for the same 2 nights and 1 person, the price was XXXX a night. Totally different pricing On XX/XX/2023, I called Capital One XXXX support from overseas in XXXX and was on the phone with them for close to XXXX hours which the XXXX XXXX XXXX XXXX came into my room to talk about what happen. Apparently capital one travel utilizes a XXXX party agency to book and they book the incorrect hotel for me. I told capital one i did months of research and booked this hotel in advance just for this view, to not get this view, this is false advertising as I wouldn't had book this in the first place. I also asked for a price adjustment between the two hotels as I'm paying a premium for a downgraded hotel. I asked the sister hotel for this adjustment as well, but they rejected and say it was capital one 's fault. So here I'm now, stayed at a hotel that wasn't my choice and had to fork out XXXX which was the most expensive hotel in my entire trip just for that view to be screwed by capital one travel booking. Capital One has only offered XXXX credit and said they can't adjust the price of my bill on the XXXX. The hotel has said the same thing. As this issue was caused by Capital One, I believe they should inherit this hotel cost as this is false advertising to give me a service that I wasn't willingly to pay for in the first place.

I first contacted the police to report my vehicle stolen and upon doing that they did some research and informed me in their system my car was stating it was repossessed. Once I got in contact with the auto loan company they sent me to a company called Loss Prevention Recovery which then gave me information to the company XXXX XXXX XXXX. The term consumer report means any written, oral, or other communication of any information by a consumer reporting agency bearing on a consumers credit worthiness, credit standing, credit capacity, character, general reputation, personal characteristics, or mode of living ( 2 ) Exclusions ( A ) ( i ) report containing information solely as to transactions or experiences between the consumer and the person making the report ; Reporting Transaction history is illegal Privacy Act of 1974 ( 5 U.S. Code 552a ) Important Definitions ( 4 ) the term record means any item, collection, or grouping of information about an individual that is maintained by an agency, including, but not limited to, his education, financial transactions, medical history, and criminal or employment history and that contains his name, or the identifying number, symbol, or other identifying particular assigned to the individual, such as a finger or voice print or a photograph ; This includes consumer reports ( b ) Conditions of Disclosure.No agency shall disclose any record which is contained in a system of records by any means of communication to any person, or to another agency, except pursuant to a written request by, or with the prior written consent of, the individual to whom the record pertains, unless disclosure of the record would be ( 12 ) to a consumer reporting agency in accordance with section 3711 ( e ) of title 31. Again they need prior written instruction of the individual to whom it relates. Section 3711 ( e ) of title 31 States ( 1 ) When trying to collect a claim of the Government under a law except the Internal Revenue Code of 1986 ( 26 U.S.C. 1 et seq. ), the head of an executive, judicial, or legislative agency shall disclose to a consumer reporting agency information from a system of records that a person is responsible for a claim if ( E ) the head of the agency has established procedures to ( iii ) get satisfactory assurances from each consumer reporting agency that the agency is complying with all laws of the United States related to providing consumer credit information ; and Either way they have violated not only the Fair Credit Reporting Act but also the Privacy Act of 1974 Opt Out Laws PART 1016 - PRIVACY OF CONSUMER FINANCIAL INFORMATION ( REGULATION P ) 12 CFR 1016.1 Purpose and scope. Consumer Complaint: I am writing to express my extreme dissatisfaction with the recent delay in posting my payment to my Capital One credit card account. On XX/XX/2023, I made a full payment of {$550.00} with my checking account I normally use. However, I was informed that the funds will not be released until XX/XX/2023, resulting in a six-day delay. This delay is unacceptable and unfair. My payments to this card, issued by the same bank I used for payment, typically post within 24 hours. This sudden and unexplained delay is not only inconvenient but also raises concerns about the reliability and efficiency of your system. This delay have negative consequences for my credit score and even cause late fees on other accounts linked to my credit card. I have not been able to buy food, pay my bills or buy my medicine due to this. It is unacceptable that paying my bill in full, through your own systems, could lead to such penalties. I request immediate action to expedite the posting of my payment and ensure this issue does not occur again. I expect a clear explanation for the delay and a confirmation that no late fees will be applied to my account as a result of this error. Consumer Complaint: According to the Fair Credit Reporting Act, 15 USC 1681 section 602 ( a ) states : " There is a need to ensure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' XXXX, XXXX, and XXXX are consumer reporting agencies and I am the Consumer. I have the right to make sure my private information isn't shared which is backed by 15 USC 6801, which states : It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. Capital One is a financial institution by definition under that title. 15 USC 1681 section 604 ( a ) section 2 states that : " In general, Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' Capital One the financial institution and the Consumer reporting agencies XXXX, XXXX, and XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX, XXXX, and XXXX, ( Furnisher of information to credit agencies ) whether it be verbal, non-verbal, written, implied or otherwise, is revoked. 15 USC 6802 ( b ) ( c ) states that : " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' Capital One never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states : " Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states : " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. XXXX, XXXX, and XXXX are not maintaining reasonable procedures. Also 12 CFR 1016.7 states that : " A consumer may exercise the right to opt out at any time. '' I am opting out of your reporting services.
