I called again today XXXX XXXX XXXX and spoke to an agent who informed me I could not receive a fee refund because 40 days had passed since the fee was charged, and 39 days was the limit. I informed the agent that the fee was charged early ( prior to the anniversary of the card ). They did not care. I pointed out I had called before but was unable to speak to a representative. Moreover, on XXXX XXXX, XXXX I purchased my XXXXXXXX XXXX building at XXXX XXXX XXXX XXXX, XXXX, IL XXXX where I have been the sole Property Owner for XXXX years. Fortunately, on XX/XX/XXXX I was approved for a {$140000.00} mortgage refinance from XXXX XXXX XXXX XXXX. I am so proud that all of my hard work of paying my bills on time for over XXXX years has finally paid off! Unfortunately, on XX/XX/XXXX I had to have a total XXXX XXXX XXXX at XXXX XXXX. While recovering from my XXXX XXXXXXXX on XX/XX/XXXX I was contacted by Capital One that someone illegally opened up a Capital One Walmart credit card ending in # XXXX on XX/XX/XXXX in the amount of {$2100.00} in my name. This someone stole all of my personal information including my name, address, cell phone number, email address, date of birth and social security number. Equally disturbing, they listed my XXXX XXXX, XXXX XXXX XXXX and XXXX XXXX XXXX as authorized users on the credit card with their birthdates, social security numbers and cell phone numbers. Immediately on XXXX XXXX, XXXX I filed an identity theft police report under XXXX. # XXXX with the XXXX Police dept. ( See attached police report copy ). Consequently, I faxed and mailed my signed and notarized Affidavit to Capital One stating that this fraudulent credit card is not mine. ( See attached copy of Affidavit ). Although I have taken all the necessary steps to prove to Capital One that this account is not mine, Capital One continues to bill me and call me every day demanding payment. More importantly, Capital One is reporting to all 3 credit bureaus : XXXX, XXXX and XXXX this fraudulent and delinquent credit card on my credit report! Furthermore, Capital One has not provided me with one shred of evidence or PROOF that I am the one that made these transactions! They REFUSE to provide me with the transaction history. They have not provided any VIDEOTAPES of me making these illegal purchases. Isnt it a fact that in the United States justice system that a U.S. Citizen or Consumer is INNOCENT until PROVEN guilty?! Consequently, Capital One is allowed to destroy my credit that I worked so hard to build for over XXXX years!! Now, I am being violated by Capital One along with the someone who is stealing my identity. This is morally unjust and illegal for Capital One to report this fraudulent credit card on my credit report each month without providing PROOF to me and the 3 credit bureaus! In conclusion, I urge XXXX, XXXX and XXXX credit bureaus to demand that Capital One provide factual PROOF that this is my account. Consumer Complaint: It is disconcerting that a reputed credit bureau would permit the dissemination of misleading information without thorough verification. The information listed on my credit report reflects a late payment on the aforementioned account. I emphatically contest the accuracy of this reporting, as I have consistently maintained a punctual payment history with the creditor in question. There has never been a situation where a payment has been overdue, and it is perplexing to find such misleading information tarnishing my credit profile. I was the victim & Im not sure why the CRA is not complying with the law. Im very confused why this one seems to ignore my requests. CAPITAL ONE XXXX Those payments were made on time. I am requesting that the late payment markings be updated to reflect my accurate payment history. Consumer Complaint: I had a legitimate dispute with several charges from XXXX that was not rectified with the airline. I disputed the charges on my Capital One account. Bottom line- we purchased XXXX flights from XXXX XXXX who then cancelled XXXX flight and changed another at our request as they let us know we would not make our connection. We were transferred to XXXX. We had paid for preferred economy though XXXX XXXX. XXXX said they could re book the same upgraded seats but had to charge us initially and the refund would be within 21 days. It was not. I disputed the charges in great detail with Capital One on XXXX. I received a form letter indicating I did not provide the information asked for. I called and provided the information and resubmitted ( I did not sign or date the documents and now they were ). I received the same form letter on XXXX. I called again and provided the requested information. This went on until my last call to them on XXXX when they told me the time had expired. I talked to XXXX. The last manager I talked to before this told me everything looked good and I just needed to respond to XXXXXXXX XXXXs dispute. The airline dispute was absurd as they did not seem aware that we had been moved from XXXX XXXX and already paid for seats once. I did not think it needed a response as my reports were very concise and clear as to what happened. I accused Capital One of delay tactics. XXXX person told me to call the XXXX. I did another report regardless. I had provided every bit of information they wanted but each time I called it was something different until time ran out. It is not legal to charge a customer twice for upgraded seats. It was a simple case and proven by me. Capital One said they had guidelines but when I questioned their method they clearly did no actual investigating on my behalf, their customer.

Inside the delivery packaged was bonded paper, color imprinted CC : ATTN Indenture Trustee, Chief Financial Officer, & CFB which inside contained a Master Promissory Note stamped and signed to fit applicable law 31 CFR 328, an allonge to the original Master Promissory Note, an explanatory statement to the Master Promissory Note, a Notice of Amendment to Master Promissory note and request for validation of debt, an affidavit of emancipation and status as an adult, explanatory statement to the affidavit of emancipation and status as an adult, a copy of the original terms and agreement contract, Power of Attorney, signed and notarized in the XXXX XXXX XXXX XXXX XXXX Supreme Court Located on XXXX XXXX XXXX where the notary saw me " natural person '', of mind, sound and body, showing certifications authenticating my identity and account holder reflecting account number and principal holder of securities account XXXX, " XXXX ''. On the XXXX of XX/XX/XXXX, Capital one without my consent, restricted the use of both of my credit accounts taking the ability to access my securities. A letter and email were received where they continued to demand payment from me, dishonoring the evidence I provide as mentioned in applicable laws UCC 3-305 & 42 USC 12203 .
