Issue: Opening an account
Subissue: Account opened as a result of fraud
Consumer Complaint: Sat. XXXX XXXX at XXXX XXXX EDT received a text from Capital One saying " Thanks for giving Capitol One your mobile number. You XXXX get texts with important info about your account from XXXX or XXXX. You also now have access to XXXX, your Capital One assistant. You can talk to XXXX by sending a text to XXXX. Reply HELP for more info. Reply STOP if you don't want to receive text messages from Capital One. Msg frequency varies. Msg & data rates may apply. '' This text alert was not solicited but I assumed it was phishing so I didn't click on anything and ignored the message. That is until I checked my emails and found a new message from Sat. XXXX. XXXX at XXXX XXXX EDT titled " Congrats! Your new XXXX Checking account is open. '' I called Capitol One on Monday XX/XX/XXXX around XXXX XXXX. They closed the account, and told me to destroy the debit card that was already on its way ( I received it XXXX XX/XX/2023 ) and were unable to tell me who or how this account was opened under my name, phone number, and home address. I have never banked with Capitol One so this checking account being opened under my name was very suspicious. I would like to know who/how this happened, if possible. Thank you

Consumer Complaint: Capital One repossessed my vehicle XX/XX/XXXX after I made a payment XXXX, XXXX XXXX. With further examination of my retail installment contract given to me by a dealership they recommended and partner with, XXXX XXXX XXXX XXXX of XXXXXXXX XXXX. My finance charge for the loan was falsified. It was {$11000.00} lower than the actual finance charge I was supposed to get. I did not notice that it was incorrect due to the finance charge being provided inconspicuously on a black and white form. Ive been making payments on a vehicle that is under an invalid unlawful contract for almost 2 years now. Ive had problems with this dealership before, they falsified an extended warranty prior to this incident which added XXXX to the principal agreement in which I had to fight tooth and nail to get reimbursed. Issue: Closing an account
Subissue: Company closed your account
Consumer Complaint: I wanted to switch banks from Capital One to XXXX, so I submitted a wire transfer request to Capital One on XX/XX/XXXX. The following day, on Monday XX/XX/XXXX, Capital One sent me an email saying they froze my account, worth almost {$400000.00}, providing a phone number for me to call. I called them and provided extensive verification information ( such as my social security number, passport details, travel history, account details, family member information, and current location ). On the call, they then told me they've decided to " end the business relationship '' and freeze my funds to do an " investigation '' that takes " 1 to 3 '' months. I asked why and they said that they can't tell me because it may " jeopardize '' their investigation and I was told that I can not appeal. I received no follow-up email. I can no longer pay my taxes, which are due in less than a week. I can not buy groceries or pay rent. I'm a simple marketing freelancer, and my banking history is simple payments from clients, and everyday transactions like taxis and restaurants. I travel to many places as a tourist, going to countries like XXXX, XXXX, XXXX, and XXXX. In the call with Capital One, they asked about my travel history, and they seemed to not know that XXXX is a country, as they asked me if I meant " XXXX. '' In any case, a private business froze my funds and I have no recourse. I am happy to verify any account information, transactions, travel details, or anything else. I told this to Capital One, and instead of asking me to provide more information, they froze everything I have.

Issue: Managing an account
Subissue: Banking errors
Consumer Complaint: Summary : Capital One quietly " deprecated '' my savings account at some unknown date and froze the interest rates at 0.3 %. They gave no notice that the type of savings account I had was being " deprecated '' or even what that meant. When I raised the issue with them, they tried to pretend I was just unhappy about the interest rate, and told me I was negligent for not checking interest rates regularly, and it was my fault for not opening a new savings account. THAT IS NOT THE ISSUE. The issue is that my savings account was effectively converted to an Certificate of Deposit with a permanent fixed rate, with zero notice given to me. Background : I originally opened this savings account with ING Direct in XXXX. In XXXX it was bought out by Capital One, and the account was converted to " Capital One 360 ''. I continued to receive all the same service and updates to the account as I had before. Interest rates updated, I could transfer money in and out, and I received regular notices. At some point in XXXX Capital One " deprecated '' every single previous Capital One 360 Savings account with ( apparently ) no notice to clients [ XXXX, XXXX ]. This unannounced change froze savings interest rates in place, preventing Capital One from having to pay out more interest on this large number of accounts. There was no effective notice -- I received no email or mail that I could find -- and current interest rates for this this specific type of savings accounts are hidden behind a small pop-up button on the website. My complaint is not about the interest rates. My complaint is about this stupid shell game that Capital One is forcing on its customers. Every so often they " deprecate '' a certain type of savings account and lock everyone into horrible interest rates. They don't give any notice, or if they do give notice it's behind a wall of fine print. If a customer wants to keep getting market-standard interest rates, they have to CLOSE OUT EVERY SAVINGS ACCOUNT and then OPEN UP A TON OF NEW SAVINGS ACCOUNTS. There's no legitimate reason for this. I filed a complaint with Capital One, and they basically said " we see you don't like your interest rate and if you don't like your interest rate just open a new savings account. '' But that's not the problem. The problem is I DON'T WANT TO HAVE TO KEEP OPENING NEW SAVINGS ACCOUNTS just to prevent Capital One from scamming me out of money. My savings account still works in every way EXCEPT updating interest rates. They didn't force me to close it or say that I had to move my money out. Capital One is completely happy to let my money sit with them, they just defraud me out of hundreds of dollars of interest each month because they can. Issue: Managing an account
Subissue: Funds not handled or disbursed as instructed
Consumer Complaint: I sometimes help/folks within the XXXXXXXX XXXX to help setup their projects as a side fun activity whenever I have time outside of work. And I have been doing so for the past 3-4 years, from which I have been collecting small payments that I also been reporting on my personal taxes as gains. Other banks that I use for this service are XXXX XXXX and XXXXXXXX XXXX through their XXXX platform. On XX/XX/XXXX a man that I have known ( online ) for about a decent 1-2 years, approached me and asked me if I could help him out with his side project that he was working on. After carefully reviewing I gave him a price quote of {$2700.00} < this includes my expenses close to {$2000.00} to help this individual. ( I attached pictures of our conversations ) He agreed and asked me if he could simply just XXXX the full {$2700.00}, in which I agreed. But he made up some excuse and asked me to only send {$980.00} form his personal account because he reached his daily limit ( picture attached - XXXX XXXX XXXXXXXX XXXX ) XXXX he then asked if he could send the rest of the payment from his girlfriends XXXX account which was {$1700.00} ( XXXX XXXX ) The next day I wake up to an email stating that my account was restricted and would need to call you guys for support and resolve this issue. I run through with the rep and explain everything to him, the first thing that comes out of his mouth is that what I'm doing as a service is against TOS of XXXX because I'm operating a business. In which I'm not, I do this for fun and my profit is just my labor as my expenses to help the individual is subnational and close to 85 % of the total payment. Nevertheless, I have been accepting payments for such gig since early XXXX from banks like XXXX and XXXX XXXX and they have never complained to me once nor have I caused any XXXX related problems. The user issued a merchandize scam with their bank which is clearly XXXX, I have never met the individual in person, I live in XXXX and have not been out of state since early XXXX.

Issue: Getting a credit card
Subissue: Delay in processing application
Consumer Complaint: I applied for a BJ 's credit card that is issued through Capital One around the beginning of XXXX. I filled out all of the pertinent information on the initial application. They came back asking for more information such as copies of my drivers license and social security card. They wanted me to mail the info, but I felt uncomfortable putting all of that information in one envelope. Instead, I faxed in the information which was allowed. After not hearing back from the credit card company, I called Capital One on XX/XX/10 to find out the status and they started asking for more information than what was already requested. They wanted my drivers license blown up in size and mailed along with a current bill. However, they never requested this initially. They seem like they are trying to deny my credit card, and are looking for a reason. My credit score is very high and there should not be a reason to be denied. I have never been denied before. The requirements from Capital One seem extreme and not consumer friendly.

Issue: Getting a credit card
Subissue: Card opened as result of identity theft or fraud
Consumer Complaint: Capital one, clearly motivated by profit, continues to insist that the fraudulent accounts belong to me because the SSN, DOB and contact information belong to me and statements were sent to my address. However, this is a case of identity theft and there is nothing surprising about information matching and the fact that it was open online also provides further proof. Capital one has not provided me with the information related to the IP address that was linked to the account opening. Moreover, within the police report, which has been provided to Capital one, the defendant in this identity fraud theft case admits that he lived at the same address and did in fact make payments to the accounts he opened fraudulently so that he could continue using them because he was not a legal permanent residence with a valid SSN thus could not open his own accounts. Additionally, last week the prosecutor who is handling this identity fraud case sent me the attached sworn affidavit from the defendant in which the defendant admits to opening among others, the Capital One credit cards There is no evidence that Capital One has properly investigated this matter. I have been in touch with the police and prosecutors working on the identity theft case and they have confirmed that no representative from Capital One has reached out to them. The same information that was used to open account ending in XXXX is the same as the one used to open account ending in XXXX. Both are fraudulent.

Issue: Problem with a purchase shown on your statement
Subissue: Credit card company isn't resolving a dispute about a purchase on your statement
Consumer Complaint: On XXXX I bought a system for {$1900.00} at XXXX, but their system didn't work as promised. I learned about this on a XXXXXXXX XXXX 30 days later I asked for my refund back, and they wouldn't give me my money back. Even though they had a XXXX money back guarantee refund. I told capital one about this on the phone a few times and proved to them I was telling the truth twice through fax. But they told me through snail mail that I lacked the evidence to win my dispute and decided just to give my money to this scammer instead. When I tried to repeatedly to follow up with them about the status of my dispute on the phone. They kept pretending they didn't get all my documentation I sent them through fax. And kept wanting to put me on hold, until they eventually hung up on me and wouldn't call me back like they should have.
