Consumer Complaint: I have called them trying to resolved my issue but they gave me little to no help. These missed payments from both accounts I have with capitol one is stopping me from securing a home for me and my children. The Act ( Title VI of the Consumer Credit Protection Act ) protects information collected by consumer reporting agencies such as credit bureaus, medical information companies and tenant screening services. Information in a consumer report can not be provided to anyone who does not have a purpose specified in the Act. Companies that provide information to consumer reporting agencies also have specific legal obligations, including the duty to investigate disputed information. In addition, users of the information for credit, insurance, or employment purposes must notify the consumer when an adverse action is taken on the basis of such reports. The Fair and Accurate Credit Transactions Act added many provisions to this Act primarily relating to record accuracy and identity theft. The Dodd-Frank Act transferred to the Consumer Financial Protection Bureau most of the rulemaking responsibilities added to this Act by the Fair and Accurate Credit Transactions Act and the Credit CARD Act, but the Commission retains all its enforcement authority. Consumer Complaint: Capital One Lied to Me About Removing Its Wrong, Late Payment Fee That Stays On My Account : I paid {$100.00} to Capital One, through my XXXX XXXX XXXXXXXX online bill pay service. But Capital One did not quickly post my payment, despite getting it on XX/XX/XXXX. Capital One instead, sat on my payment, as I kept checking my account with them online. So, on XX/XX/XXXX, I called my Capital One Quick Silver Master Card customer service, at XXXX, to see why my payment still wasn't posted. XX/XX/XXXX was the deadline date for my payment, but the female agent I first spoke with, said Capital One had nothing from me, so I should check with my bank about what happened to my payment. My bank assured me my payment was with Capital One. So, I called Capital One again on XX/XX/XXXX, and got a male agent, who said he was checking to see where was my payment. The male agent put me on hold a few times, I heard a child in his background, and the agent finally, told me Capital One had no payment from me. The agent added, Capital One will of course place its late fee on my account, if my payment would not arrive by that day! I got angry, since no honest worker should prematurely speak of late payment fees not yet added! It seemed like the agent already knew Capital One was premeditatively planning its " late '' payment fee! I hung up, found online the name of XXXX XXXX, as Director of Operations for Capital One, and e-mailed him at XXXX. I got no reply to my XX/XX/XXXX email. But as I checked my Capital One account online on XX/XX/XXXX, I saw my {$100.00} finally posted that date, according to Capital One records. And I saw no late fee, and believed Capital One was not going to incur any. I was wrong! I checked online again in early XXXX, and saw their {$25.00} late payment fee! So, I called customer service again, since I read any credit card customer who always pays on time, may easily get a first-time late fee waived, by asking their card 's customer service agents to do so. And as I spoke with a Capital One agent, he said Capital One will remove the late fee. But that was a lie! The late fee remains on my account, as no one replies to my XX/XX/XXXX email to XXXX, nor honors what one agent claimed about waiving that fee! Capital One 's monthly written statements say I could pay my debt within 3 years, by sending {$70.00} every month. So, I send {$100.00}, as I try to get out of their debt a little sooner. But Capital One wants to keep me indebted for longer, by imposing their bogus " late '' payment fee!

I sent them a letter certified mail asking them to reassess my consumer credit transaction and approve my application as a denial is unlawful. They sent me a vague letter responding to my initial letter asking me to contact them about the matter and when I did they couldn't find my application.

Consumer Complaint: During the COVID-19 pandemic, my state was in lock down and my employer was closed. I contacted all of my credit cards for some assistance and capital one was the least helpful. During this time, I made 5 late payments ( XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX ). Once I obtained employment again, I was able to catch up on my payments and have not had any late payments ever since. I reached out to Capital One via telephone to see if they can lower my interest rate as it is astronomical and I have been trying to pay off this credit with little luck. They told me they are unable to do so. I also asked if they can review the late payment history so it can potentially be removed from my credit report and evidently, they could not help me with that either. I have multiple other credit cards and this is the only one that is reporting missed payments during a global pandemic. They refuse to help me in this situation and this is impacting my credit score greatly. I do not believe that I should have this reflected on my credit report for 5 years when the entire world was struggling to pay their bills. I have proven to be a good customer and have remained in good standing since my employment continued.

Consumer Complaint: I deposited a check for {$1900.00} via mobile deposit on Saturday XX/XX/XXXX from XXXX XXXX On Monday XX/XX/XXXX it was accepted and placed on a full hold till XX/XX/XXXX. I called the same day on XX/XX/XXXX around XXXX ct to speak with an agent to see if my check could be released early ( due to me having autopay set up on my bills and I didn't want the payments to be returned. The first I agent in the dept that placed the restrictions was trying to assist me with getting the check verified and released. We tried contacting XXXX XXXX XXXX but their hold time was 30 to 40 min and from what I observed capital one only allows agents to wait on hold for 10 mins.So I was advised to call back in an hour and we could try again. I called back around XXXX XXXX and was advised that my account didn't qualify for early check release. When I asked you they couldn't answer, so I asked you speak with a supervisor. I spoke with a lady in which she already had an attitude and advised me that my account was not eligible for early release because I have a history of items returning. I explained I don't have a history of checks returning, I have consistent dd biweekly ( I also work at a bank ) I have been a customer of capital one since XXXX with 1 checking account, 2 savings, car financed through them and 3 credit cards. But because I have auto pay set up which has caused my account to go negative and payments returned as NSF they decided to not release. The manager was even hesitant on calling XXXX to verify the check and explained that she didn't have to because it was a courtesy. Technically it's not a courtesy to call to verify a check if alleged account is a risk due to returns tjays something that is automatically done to ensure there is no risk. So, the manager placed me on hold for exactly 10 mins and said she tried to contact XXXX. And advised me that she has tried and they wait time was 30 mins and at this point I will have to wait till XX/XX/XXXX for my check to be released. Same day as my direct deposit comes in. At this point I'm furious because them being able to only wait in que on an outbound call to verify a check is ridiculous. I currently work at a bank in their financial crime dept. If a customer is on the back line ( to verify their personal information with third party ) to have check released to pay bills the least the agents can do is wait up to XXXX mins. Other than nsf due to auto pay over dracting my account I have not given this bank any other reason to hold checks. I have deposited checks into my account in the past that was more money and they were able to be released. Now I'm really upset because right after I filed a XXXX complaint on XXXX. I received an email advising my capital one account was restricted at XXXX am on XX/XX/XXXX. I thought the email was a scam until I logged into my account and noticed that all accounts were fully restricted, due to unusual activity. Now how in the world can their be XXXX unusual activity on my account when I just called twice today? My account was restricted for no reason at all. There are no unusual logins, if they check IP ITS THE SAME AND CONSISTENT, the exact same transactions post to my account consistently ( XXXX XXXX, loan payments, direct deposit, credit card payments, XXXX or XXXX here and there ). I am furious cause for 1 they have my check on hold and 2 now my account is fully restricted and advising me to call into capital one, yet again to verify recent transactions. So I have to wait for capital one to open because it's XXXX XXXX CT so more than likely I will have to give part 2 of this complaint on how it's handled but I can already tell it's not gon na go well

Consumer Complaint: Enclosed find for card ending in XXXX an email received XX/XX/2023 through our email at like XXXX XXXX I did not nor do my wife on joint account that you have issued to cards for with different numbers that we can not even track. The purchase as at a XXXX XXXX XXXX for {$79.00} never heard of or would we use a credit card. So, first issue is we are not able to check this, second is we didnt make this purchase, third same account never had different numbers on cards and very disappointed we can not track both cards on this account since you chose to do this. We are married been so for 37 years and everything is joint on all other accounts and we dont appreciate you deciding to make it separate and hard for us to track. Next issue is of your crediting our account payments sent each month that state principal only, our balance not being reduced and we have questioned this for years. Sent number complaints with nothing be done we are including just a few for last8 months, however we want years of applying payments corrected and our account to reflect the correct amount we owe. We often paid amount for amount charged but you did not apply correctly but charged us interest no problem. we have sent them copies of the payments and amounts that they don't apply corrtectly.

I have 4 payments showing late during XX/XX/2019, XX/XX/2019, XX/XX/2019, and XX/XX/2019. I have written letters to the CEO of this company, as well as made several phone calls to this company in an effort to have these remove these items as it has not only tainted my credit report, prohibited my growth, financially, and has strongly effected my ability to gain membership with Capital One and other creditors as well.
