Consumer Complaint: Recently I checked my three credit reports for the first time in over five years. I noticed a late payment reporting on my Capital One credit card account to the three credit reporting agencies for XX/XX/XXXX, which is inaccurate. Because of my XXXX illness and the shelter in place restrictions here during that difficult time, I contacted a Capital One representative by phone to explain my situation about my late payment. At that time there was an agreement made to have any late payment reporting for XX/XX/XXXX waived from my credit history, and instead reported as an on time payment by Capital One. Now I see Capital One never honored our agreement made by phone in XX/XX/XXXX. The CARES Act, which was signed into law on XX/XX/XXXX, amends the Fair Credit Reporting Act ( FCRA ) to stop adverse credit reporting during the XXXX crisis. Under the amended FCRA, if Capital One made an accommodation to me because I was affected by XXXX during the covered period, Capital One must report my account as current to the credit reporting agencies. Additionally, I would like to share that I have been a Capital One cardholder since XX/XX/XXXX, and the only negative mark on my payment history with Capital One since that date is for the XX/XX/XXXX period. Furthermore, this dispute with Capital One is the only negative mark that appears on my entire credit history. Be aware that my Capital One account has a credit limit of ( {$500.00} ), which is less than 1 % of my entire revolving credit limit ( {$51000.00} ) involving twelve creditors. I find it extremely disheartening that one creditor ( with such a small representation of my overall revolving credit ) has damaged my credit for more than two years because they neglected to honor our agreement made during the XXXX crisis. I recently contacted Capital One by writing to resolve this matter and their generic response ( attached ) was that their late payment reporting for XX/XX/XXXX is accurate. No mention was made in their findings about the life changing XXXX restrictions and issues we all faced at that time, and they did not acknowledge our agreement made at that time regarding my payment.

Consumer Complaint: Company was contacted about statement balances that keep showing up every month. On the Bank app the balances are off from the balances they are reporting on my statement. I have been paying my balance down to XXXX according to what the apps says I owe. My XXXX balance is never shown on the statement. Instead they/ their system delays the payments pending for days to allow a balance to show on my statement. On Monday XX/XX/XXXX i spoke to a supervisor that looked over the XXXX balance and assured me that he saw I had already made the payment on XXXX which brought my balance to XXXX. He told me that at XXXX on XX/XX/XXXX the XXXX balance would report on my XX/XX/XXXX statement. Instead, on XX/XX/XXXX there was a new balance as if I had never paid my account down to XXXX. The company is also able to add interest to a balance. As a result of the delay in their system as of XXXX my account is over in payments because their system never shows the real amount you owe. Even tho i pay the balance down to XXXX they always post a balance. Yet my statement balance is {$120.00}. I've spoken to XXXX, XXXX, XXXX, and several others to have this investigated. XXXX refused to escalate for an investigation. They have stated that their system delays real time payments up to 5 business days. I am only allowed to pay down what the system says i owe. Their system lags/delays and does not reflect what is reported on my statements. My account was paid down to XXXX XXXX This type of reporting to the credit reporting agencies has reflected my utilization and drags my credit scores.This is defamation of my character. A furnisher has a duty to report accurate complete information. This information they are reporting is iinaccurate.
