Consumer Complaint: This creditor engaged in abusive, deceptive, and unfair practices of the FDCPA which it prohibits. According to 15 USC 1666b it is a billing error I did not receive a statement 21 days before the late payment error. If finance charge included, there should be no late payments pursuant 15 USC 1605 ( a ) due to finance charge bring sum of all charges so I can not be penalized for something that is already paid in full.

Case Number : XXXX On XXXX, the amount of {$79.00} was unlawfully and without my authorization placed on my Platinum Capital One Credit Card by XXXX Airlines. I contacted XXXX XXXX XXXX customer service department 3 times to discuss this issue and each time I was placed on hold for over 1 hour or a manager never returned my phone calls, so I contacted Capital One to dispute the charge. I submitted all the documentation Capital One was requesting to dispute the unauthorized charge to my account, however, Capital One is refusing to credit the {$79.00} to my account.

Consumer Complaint: My old credit card ( ending in XXXX ) was set to expire in XX/XX/XXXX, so as per Capital One Bank rep their system auto-generated new cards and mailed them to my address on file on XX/XX/XXXX. Capital One said the letter was supposed to be delivered by XX/XX/XXXX ; however, I never received the letter and the new credit card that they sent. On XX/XX/XXXX, between XXXX and XXXX, I received numerous texts and calls from random numbers, but I didn't respond or click any links. I even had to turn off my phone because I'm in the middle of review for my exam and was getting distracted. At XXXX, I saw a notifications from Capital One detailing three large unauthorized transactions ( {$7000.00}, {$12000.00}, and {$7700.00} ) at XXXX XXXX XXXX XXXXXXXX at XXXX XXXX XXXX XXXX XXXX NY XXXX I immediately called Capital One to dispute the charges and lock my card. On XX/XX/XXXX, Capital One informed me that the dispute process was completed, and the charges were considered valid ( case # XXXX ). When I called to dispute their decision, they insisted that I needed a person of interest for reconsideration. The representative, XXXX ( XXXX : XXXX ), explained that the new card which I never received ( XXXX exp XX/XX/XXXX ) was activated using my phone number and used at XXXX XXXX XXXX XXXX. I contacted and visited XXXX XXXX XXXX XXXX XXXX XXXX, but she said further details could only be provided to law enforcement. When I went to the police station, they told me they needed an affidavit letter from the bank stating the charges were fraudulent and suggested hiring a civil litigation lawyer. On XX/XX/XXXX, I found and retained XXXX XXXX XXXX to help with the dispute. Despite our efforts, Capital One refused to provide an affidavit letter, as their system showed the transactions were made using the new card ( which I never received ) and microchip activated with my phone number. My detailed XXXX phone records prove that I never called Capital One to activate a card during XXXX or on XX/XX/XXXX, but they still won't accept this as evidence of fraud. They said they can not compel the merchant to submit evidence of the transactions.

I have filed two complaints with CFPB and Capital One have made fun of it. Capital One answer is that XX/XX/XXXX and XX/XX/XXXX, credit was made for the payment and choose to ignore the payment dated XX/XX/XXXX. Since then, I have made interest payment, as my {$3000.00} was not credited. I am attaching as evidence a copy of Electronic Fund Transfer Report from XX/XX/XXXX, to XX/XX/XXXX from XXXX XXXXXXXX XXXX I am requesting CFPB to open an investigation and sanction Capital One for abuse of client. I am requesting that Capital One credit my account with the {$3000.00} payment that I made on XX/XX/XXXX and reimbursement me for the interest payment they made doing the client abuse.
