Consumer Complaint: Please see the attached letter regarding the account that is not mine due to identity theft. I have filed all of the necessary forms including the FTC online form and affidavit. This is all equivalent to a police report as well. This is my second request to you to remove these fraudulent accounts from all three of the credit bureaus before I take legal action. Send the validation of these accounts as well with your response back to this complaint. I want the account name, account balance, past due amount, and date of last activity verified and provided to me as well.

XXXX XXXX XXXX XXXX, XXXX XXXX XXXX 15 U.S. Code $ 1681c-2 a consumer reporting agency shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from an alleged identity theft, not later than 4 business days after the date of receipt. It has been 30 days and you are in VIOLATION of this law because I am a victim of identity theft!! Please delete these items IMMEDIATELY! These accounts should not be furnished on my consumer report as they are in VIOLATION!!! Under, 15 U.S Code 1681b - Permissible purposes of consumer reports ( a ) IN GENERAL Subject to subsection ( c ) any consumer reporting agency may furnish a consumer report under the following circumstances and no other : ( 2 ) In accordance with the WRITTEN INSTRUCTION of the consumer to whom it relates. I NEVER gave any consumer reporting agency WRITTEN CONSENT to report anything on my consumer report which violates my rights as a federal protected consumer. NO CONSENT IS IDENTITY THEFT. As a consumer I am demanding the deletion of the accounts listed IMMEDIATELY!

Consumer Complaint: I disputed a charge in XX/XX/23 because an item I purchased had been returned and not properly refunded ( {$10.00} of {$210.00} ). XX/XX/XXXX I received a letter saying they were rejecting the dispute unless I provided more information, I sent them a detailed signed statement as requested, the purchase receipt and the invoice showing them the item had been returned. Within an hour, I received an automated letter saying I failed to provide any evidence and my case was closed.

Clearly states that I have the right to privacy. 15 U.S.C 1681 Section 604 A Section 2 : It also states a consumer reporting agency can not furnish an account without my written instructions. 15 U.S.C 1666B : A creditor may not treat a payment on a credit card account under an open-end consumer credit plan as late for any purpose. Remove these late payments and update this account immediately as you in direct violation of several laws under The Fair Credit Reporting Act.

Consumer Complaint: Completely ignored the fact that I was double charged on the same transaction and then they stole the refund from the merchant as if that was a fix for the double charge when it was actually a refund for the returned merchandise!!! They have nobody clearly working in the company who can do the math or see that I was double charged and the refund has nothing to do with them fixing double charge, but it is for the returned item!!! For the whole year they are not even able to read or do the correct math except trying to steal the money from me!!! Double charged for the same transaction, let them know XXXX times, disputed and all, but they continue to ignore it and stole my refund which the merchant provided for the returned item!!!

Consumer Complaint: I was offered to purchase a machine used as a demonstrator at an attractive price, but the company wanted me to use XXXX, where I did not have an account. I started setting up the account, but before my identity was verified as required by XXXX laundering laws and XXXX XXXX, the machine had been sold to someone else. In compliance with its policy, XXXX cancelled the transaction, including any fee it may have obtained, since it had not met XXXX 's policy. My XXXX account has since been completely closed. Capital One apparently sent money to XXXX, but, since the transaction was cancelled, reversed the charge to my credit card. Later, Capital One recharged my card even though the legal requirements to set up the XXXX account were never completed ( i.e. it was started, but not verified ), XXXX cancelled the transaction, the machine was never sent to me, and I no longer have an account with XXXX. I do not know what XXXX will do with money sent for a cancelled transaction to a closed account, but they should refuse it ; I also do not know what Capital One will do with money they send in violation of XXXX/anti-money trafficking laws and the policy of the recipient, but suspect if they so blatantly violate the law, they will steal the money. Due to a medical event, I have cognitive difficulty and Capital One has ignored my request for assistance.
