Consumer Complaint: According to the Fair Credit Reporting Act 15 USC 1681 section 602 a states " There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' XXXX and XXXX are consumer reporting agencies and I am the Consumer. I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states '' It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' ( Furnisher of information to credit agencies ) is a financial institution by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' ( Furnisher of information to credit agencies ) the financial institution and the Consumer reporting agencies XXXX, XXXX, and XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX, XXXX, XXXX, XXXX XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX, XXXX, XXXX XXXX, Dept of Ed/XXXX, US dept of education XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXXXXXX Capital One, XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' XXXX XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX, XXXX XXXX XXXX, Dept of Ed/XXXX, US dept of education XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, Capital One, XXXX XXXX XXXX XXXX XXXX XXXX, and XXXX Never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. XXXX, XXXX, and XXXX are not maintaining reasonable procedures. Also 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. '' I am opting out of your reporting services.

Consumer Complaint: I initiated a dispute for a transaction that was billed to my account on XX/XX/XXXX in the amount of {$140.00}. The credit card issuer sent me a letter, dated XX/XX/XXXX saying that if I had wanted to continue the dispute, I would need to send a statement saying that I didn't receive the service provided and a brief description of how I tried to resolve the dispute with the merchant. I faxed this information ( attached ) to the credit card issuer ( Capital One ) on XX/XX/XXXX ( fax confirmation attached ). On XX/XX/XXXX, I received a letter ( attached ) from the credit card issuer ( Capital One ) saying that they are unable to assist me further. I am not satisfied with the response from the credit card issuer ( Capital One ) because the merchant ( XXXXCapital One Travel ) in dispute is a company that is directly operated and owned by the credit card issuer ( Capital One ) and I never received the goods or services from this transaction through no fault of my own because the service was cancelled by the operator prematurely without any type of notification to me at all. The credit card issuer has a responsibility to protect the consumer especially when the company in dispute is operated by the credit card issuer and the service was never provided.

Consumer Complaint: I was told by capital one both my accounts were closed after. Paying both cards off XXXX found out attempting to rent a car. I could not use the card. One of the cards that they stated was closed was used months prior to secure a hotel reservation. Upon finding out the accounts were closed I used a paid debit card exiting the hotel. I do not know how that card was charged. They can check their hotel cameras. I had to use my sons pay pal to secure the car rental that day for my youngest son college trip. I remember this day because I was devastated and shocked I could not use the cards for the car rental because I was not aware my accounts were closed by capital one and I thought I wasnt not going to be able to make the trip with my son.

Consumer Complaint: On XX/XX/23 my vehicle was totaled in a car accident. I began the process with having my insurance handle their end, started the process with my Gap and notified Capital one so they could submit the needed paper work. I also called capital one ( all recorded on their line ) many times about getting back my XXXX that was through the same company as my GAP. They kept telling me it needed to wait 60 days and I would get it from them directly. Yesterday XX/XX/23 I called again to check up on things. Only to find out that they never used my Gap insurance even though the process had been started. They took the money from my XXXX after my insurance paid them and applied it to my balance. I found a notice in my junk email from Gap about this. I financed my GAP and XXXX and paid intrest on these items in my loan. It states no where in my agreement that this is allowed. When I asked for a copy of their policy and procedures saying they could do this, they refused. So Gap denied my benefit coverage. There was nothing left to pay and I was out almost XXXX that capital one kept telling me I was going to be getting. I desperately need help with this.

Until this day, 1 of those cards ( which has the most rewards achieved ) is still restricted despite countless calls and verification processes that were the same for all 3 cards. They keep asking for the same things or things that don't exist for me like an EIN number since I am an attorney who uses my SSN for my own private business as a sole proprietor. Now they threaten to close that account for failure to comply despite my 3 weekly calls to them and continued timely payments despite unable for use and despite for account specialist to return calls since XXXX XXXX

Consumer Complaint: I have 3 cards with Capital One ( Walmart, and 2 other Capital One Cards ). Each month when I pay on my accounts I suddenly am over the limit when I didn't even use my cards. For instance, the card payment for Walmart {$120.00}, they take all of that each month in interest and sometimes saying I am over the limit when I didn't even use my card. These suddenly increased interest rates should be unlawful and Capital One needs to pay me back and/or decrease these fees as this is ridiculous. Like stated, these rates happened suddenly. I am paying all three cards and having no balance.
