Consumer Complaint: I mailed a dispute with Capital One on XXXX I had sent negotiable instrument for payment and it was not credited in violation of UCC 3-104, UCC 3-603 , 15 USC 1666, 12 CFR 1026-13, 15 USC 1693, 16 CFR 433.1-.2-.3 while under dispute and without sending notice that I had sent a dispute and the requested full accounting they closed my account which violated the Fair Credit Billing Act. To dispute a charge, you need to mail a letter that includes your name, address, account number and a description of your billing error, and send it to your creditors billing inquiries address. You should also include copies of anything that backs up why youre disputing the billing error ( like a receipt showing a different purchase amount than what was billed, for example ). The letter must reach your creditor within 60 days after you receive the billing statement that contains the error. The creditor must acknowledge receipt of your complaint within 30 days of receiving it, unless they resolve the issue first. And no matter the outcome, the creditor must resolve the dispute within two billing cycles after receiving your letter. While you dont have to pay for the disputed transaction during the dispute, you do have to make payments related to all other purchases. The creditor is not allowed any actions related to the dispute that might ding your credit, but they can note the dispute. If after receiving the results of the investigation you disagree with the decision, you can dispute that, too. You have 10 days ( beginning from when you received the results ) to do so, and you can note that you will not pay the disputed amount. At this point, the creditor can begin trying to collect on the amount owed and report you as delinquent if you fail to pay the amount owed. That said, creditors must also report that youre disputing the amount owed when reporting the payment delinquency. If the creditor fails to meet any of the timelines required by the Fair Credit Billing Act during the investigation process, they cant collect the amount in dispute, regardless of whether the bill was correct or not.

Consumer Complaint: In accordance with the fair credit reporting act XXXX Account, Has violated my rights. 15 USC 1681 Section 602 States I have the right to privacy 15 USC 1692g - Validation of debt law This account with Capital One has been Charged off but is still reporting derogatory and balance to my credit report. I have requested a 1099c form so I can audit them to make sure they are in compliance but have yet to receive one. This is account is not reporting accurately to 2 to the bureaus. They are violating 15 USC 1681 e ( b ) for reporting information that is not 100 % accurate.

Consumer Complaint: Received a notification from XXXX XXXX regarding a hard inquiry. I reviewed the information and knew immediately it was not something I had done. I pulled my XXXX credit report which did not show any information regarding this inquiry. I called capital one and was assisted in closing this fraudulently opened account. The customer service representative informed me they would close the account and flag it as fraud and their fraud department would be investigating. My major concern is now knowing my SSN has been compromised and I am unsure of how to prevent these people from continuing to open accounts in my name. My next concern is that I was a victim of the XXXX breach of 2017 and although I have credit monitoring I was not informed by their services of this transaction.

Consumer Complaint: Capitol One XXXX Credit Card which I opened around XXXX. I have a {$450.00} limit which a submitted a {$200.00} deposit to get that amount. It is used similar as a pre-paid card, I put money on it and make purchases with it. As the balance runs low I reload it from my XXXX XXXX Checking Account. I have always used the same checking account to add money to the Credit Card and make multiple deposits throughout the month. I never had any issues until about XX/XX/XXXX. I made a {$350.00} deposit into the card to pay for a rental car and fuel for an upcoming trip. After XXXX days the {$350.00} was not placed into my available funds, however I did received an email from Capitol One that they received the deposit. I spoke with a XXXX with Capitol One and was told they placed a 26 day hold on the money and there was nothing they could do. I was never notified of any type of hold and I was told that they sometimes place holds on funds. This had never happened prevousily. On XX/XX/XXXX I made a {$200.00} payment into my account and on XX/XX/XXXX I made a {$150.00} payment to my Capitol One Credit Card. After XXXX days I received emails from Capitol One stating they received my deposits, however again It was not credited to my account for me to use. I contacted a XXXX XXXX, and was told that they placed 26 day holds on both amounts and I wouldn't receive the use of my money until XX/XX/XXXX. I was told again they have no control on holds being placed. Once again I was never contacted that they were placing holds on my account. No reason was ever given for these holds, Since I have made multiple deposits every month for years, no payments were ever missed, I have a credit card which if I want to use will have to place additional funds into up to the maximum of {$100.00}, since my limit is {$450.00} and they have {$350.00} on hold. I ask XXXX what if they place a hold on another deposit and she told me I could go to XXXX of their ATMs or XXXX and place a deposit. I am stunned as a XXXX Veteran at their actions.

Consumer Complaint: My Capital One card was due to expire on XX/XX/XXXX. I was away on vacation in XXXX XXXX FL for my Anniversary in XX/XX/XXXX was using my card up until it expired in XXXX. I waited about 3 wks & I contacted them after I had made a XXXX payment on a XXXX credit limit, statement online said I had available balance but when I made a charge it was declined, when I called the company the 3rd week of XX/XX/XXXX they said they had sent another card to me & verified my mailing address & they closed the card I should have received, then they said it would take 7 to 10 days for me to get the new card. I waited 9 business days still no card came. There is a authorized user on my account who has a card of their own which also has expired & not replaced. I called again spoke with a rep that was able to research further & find out that the company placed a block on my account to not allow a new card to be mailed even though its expired, due to another account that was charged off over 8 yrs ago which is over the statue of limitations. My current capital 1 credit card is not past due is in good standing not late, nor closed by me or the creditor, in fact I have paid the entire balance of XXXX. I am being charged interest on a account I am not allowed to make purchases with & now has been paid in full but only interest is due, my authorized user has no legal obligation to the charged off account 8 yrs ago why are they penalizing them & not sending them a new card. Why is this company charging me fees for a card they will not allow me to make any purchases on & the balance was paid in full.

Consumer Complaint: On XX/XX/XXXX we spoke with cabelas capital one in regards to my husband recently being in an accident and unable to work. Capital one stated on the phone that we would have 3 months interest free and late payment fee free. They continued to charge over {$130.00} of interest each month. We finally paid the card off with our taxes because we couldnt afford the payment with one income. On XX/XX/XXXX we paid our capital one ( Cabelas ) credit card off. We checked our account to make sure it was completley paid off and XX/XX/XXXX they charged us with interest again even though the card was paid off. We spoke with capital one today and they stated that they understood our frustration but we were told we are still responsible with that interest.
