Consumer Complaint: XX/XX/XXXX XXXX XXXX XXXX XXXX XXXX XXXX, TX XXXX Subject : Complaint Regarding Refusal to Provide Form 1099-C by Capital One Auto Finance Dear Sir/Madam, I am writing to file a formal complaint against Capital One Auto Finance regarding their refusal to provide a Form 1099-C ( Cancellation of Debt ) for a charged-off debt. This complaint is made in accordance with the authority of the Consumer Financial Protection Bureau ( CFPB ) and the Federal Trade Commission ( FTC ). Creditor Details : Creditor : Capital One Auto Finance Account Number : XXXX Date of Charge-off : XX/XX/XXXX Despite multiple requests made through certified mail, Capital One Auto Finance has persistently refused to provide the necessary Form 1099-C. The Form 1099-C is crucial for accurate tax reporting and compliance purposes. This refusal hinders my ability to fulfill my tax obligations appropriately. According to the Internal Revenue Service ( IRS ), creditors are required to provide a Form 1099-C when they cancel or forgive a debt of {$600.00} or more. The creditor 's failure to provide this form not only violates tax regulations but also affects my ability to address my tax liabilities accurately. I respectfully request the intervention of the Consumer Financial Protection Bureau ( CFPB ) and the Federal Trade Commission ( FTC ) in investigating this matter. I urge you to take appropriate action against Capital One Auto Finance for their refusal to provide the Form 1099-C. Furthermore, I kindly request your assistance in compelling the creditor to provide the required tax documentation promptly. Alternatively, I request that the charged-off debt be removed from my credit report due to the creditor 's non-compliance. Consumer Complaint: I sent a letter out XX/XX/XXXX to XXXX, XXXX, and XXXX is my tracking number XXXX. However its been more than 30 days and the credit bureaus failed to send my investigation back.This is not making any sense. According to the law 15 U.S. Code 1681i- Procedure in the case of disputed accuracy.If the completeness or accurancy of any items of information contained in a consumer 's file at a consumers reporting agancy directly, or indirectly though a reseller, of such dispute, the agency shall, free of charges, conduct a resonable reinvestigation to determine wheter the disputed information is inaccurate and recored the current status of the dispute information, or delete item from file in accordance with paragrah ( 5 ) before the end of the 30 day period beginning on the date which the agancy recived the notice od the dispute from the consumer or reseller.

Consumer Complaint: I received a statement ( XXXX ) from Capital One and I paid my account in full ( so I thought ). I went in to check my account to make sure it showed a XXXX balance and to my surprise there was a {$3.00} charge that they said had accrued from XXXX. I asked, how could that be and why wasn't it included in my balance on my XXXX statement. They tried to explain which only they would know how it is calculated and there is nothing on my statements other than the statement that says " Interest is accrued daily ''. They told me that I had to call to actually get a payoff amount in order for my account to have a XXXX balance. My concern is that no one can do the figuring on their own credit card according to what I was told. Also, if someone wants to pay off their account in full, it should be stated on the statement to " Call for an actual payoff amount ''. I have not had a problem paying off any other of my credit cards and then to see a continuing running balance because of something that is not stated on my statement. I asked for a waiver of the {$3.00} since it was not noted but to no avail. I then asked what was my payoff amount and was told it was {$3.00} if paid today, which I did. If I had not asked about the payoff amount, my next statement would have had another amount on it that I would not have known amount which could have resulted in an unpaid credit card ( if I had not checked ) and they would have reported me to the credit bureau. This should be made clear on your current statement that you have to call for a payoff amount. Any other credit card that I have paid off has been a {$0.00} balance as long as the amount of the balance showing was paid by the due date.

Consumer Complaint: I closed my money market account with Capital One on XX/XX/XXXX. They supposedly sent me a check which I never got. The amount is {$23000.00} I have had to call them no less than 5 times to beg them to send me my money and every time I get the run around. They finally sent me an affidavit they insisted I get notarized and emailed to them. I did that on Thursday XX/XX/XXXX and they STILL have not confirmed receipt and they're telling me I have to wait 95 days for them to send my money! First of all I do not trust them at all. I think they will hold on to these funds for one lame excuse after another. Secondly they now have {$23000.00} of MINE which I am not earning interest on and they are. Theyre holding my money hostage and I NEED my money. They could have simply put a stop payment on the first check but they refuse. Now I closed my account on XX/XX/XXXX and if they were going to make me wait 95 days the clock should have started ticking THEN, not NOW. I am angry and this is causing me immeasurable stress. PLEASE HELP!
