Consumer Complaint: I left XXXX and was home in the XXXX on XX/XX/XXXX. On XX/XX/XXXX, my credit card bank, Capital One, declined a transaction ( {$2500.00} USD ) posted on XX/XX/XXXX after I confirmed that it was not my transaction. The next day, XX/XX/XXXX, Capital One posted a transaction from the same vendor, XXXX XXXX in XXXX XXXX XXXX, XXXX in the amount of {$4800.00} USD. I reported that transaction as fraudulent online with my Capital One account. Immediately, Capital One closed that card and made preparations to send me a replacement card. My account was credited in the amount of the fraudulent transaction ( {$4800.00} ), pending an investigation. Capital One sent me a secure link for documentation submittals. I also sent hard copies to the designated address for " Disputes ''. My card was never out of my possession and is still in my possession. It was never stolen, lost, or misplaced. Somehow, the " chip '' and credit card information were obtained illegally ( scanner? ) and used in the contested transaction. I sent a photocopy of my card that was supposedly used in the fraudulent transaction. I produced copies of my boarding passes that show I was in the XXXX on XX/XX/XXXX. Capital One never acknowledged receipt of my documents which were sent by certified mail but never signed for. Capital One informed me on XX/XX/XXXX that they have closed the investigation and determined that there was no evidence of fraud. They stated, " After researching your case, we found insufficient evidence of fraud because : Information we discovered leads us to believe that you or another account user benefitted from the transactions. I believe that there never really was an investigation. I was told that their conclusion was based on information that it was a " chip '' transaction, which is not possible. Was this misinformation from the vendor, who could be complicit in the fraudulent transaction? I requested, but never received, copies of documents from their investigation. It is my understanding of the applicable laws, that the bank must provide me with documentation and the burden of proof is on the bank, not me. I would like Capital One to atone for their mistake of posting this fraudulent charge and credit my account accordingly.

Consumer Complaint: On XX/XX/23, someone was able to open a Capital One Performance 360 Savings account in my name. I have already frozen my credit with XXXX, XXXX, and XXXX. I had also placed a freeze with XXXX XXXX ( initiated XX/XX/23 ). Please stop allowing anyone to an open account in my name. This is the fourth time this has happened in the past year or two ( x3 with XXXX XXXX XXXXXXXX ). This is ridiculous. Is there nothing I can do to protect myself? Every time this happens it costs me hours of time on the phone.

Subissue: Credit card company isn't resolving a dispute about a purchase on your statement

Consumer Complaint: On or about XXXX of XXXX, I contacted XXXX XXXX XXXX and asked them if they offer services to my home air conditioning/heating system and they said 'yes '. Specifically, I asked them if they would pay for freon for my air conditioning system if it needed it. They said 'yes '. So I started paying them {$75.00} a month for the next 6 months. On or about XXXX, XXXX, I called XXXX XXXX XXXX again and requested a free home inspection which is one of their offers for opening the account. At that time, I again asked them if they cover the freon if it became necessary, only this time they said 'no '. At that point, I asked them to immediately close the account and asked for a full refund of the monthly payments to date. They refused, and then I was hung up on. I subsequently disputed the charges with Capital One Bank, the issuer of the credit card that I had used for these monthly transactions, to protect my rights and receive the refunds. At first Capital One issued the refunds, however the next month, they recharged my account of the charges. I feel that I have been defrauded with incorrect information from XXXX XXXX XXXX and now Capital One is not protecting my rights. What's more, to date I have not received ANY services from XXXX, despite my monthly payments to them. So they expect me to pay for services that I never received along with accepting their fraudulent information. I am asking the Consumer Finance Bureau to protect my rights and secure the refunds. Thank you.
