Consumer Complaint: When using Capital One 's bill pay feature the bank deducts the funds from my account the day the ( paper ) check is sent ( via XXXX mail ). I understand that some transactions are electronic and XXXX therefor warrant an immediate deduction but that's not the case here. The latest incident involves a payment request for a local electrician who has not provided his bank account information and does not receive electronic transfers so sending a paper check is the only option. On XX/XX/XXXX I requested that the bill be paid to the electrician and the bank immediately deducted the funds from my account. Yesterday, XX/XX/XXXX, the electrician contacted me saying he had not received payment. I called the bank ( speaking with XXXX and XXXX in XXXX ), stopped payment on the check, and was told that they would open an investigation and pending the results, the funds might be returned to my account in 4-6 business days. I asked where the money was and was told that they sent it to the electrician, which unless they sent an envelope full of cash, is not true. They've still got my money and are earning interest on it in the interim. Is this legal? It's not the first time Capital One has deducted funds in advance of payment ; it's just the most recent example.

Consumer Complaint: On XX/XX/XXXX at XXXX XXXX I received 2 texts from Capital One, one asking if I just made a {$600.00} charge at XXXX followed by a 2nd text stating the charge was declined as there was not enough credit. I was home at the time so responded 'No ' as I did not make the charge. Additionally, knowing {$600.00} would not take me over my credit limit I immediately logged into my account and there were 3 additional pending charges from the day that I did not make : {$1400.00} to XXXX, {$450.00} to XXXX, and {$210.00} to XXXX XXXX XXXX XXXX. Immediately called Capital One to report the charges as fraud. A credit was issued for all 3 transactions on XX/XX/XXXX. On XX/XX/XXXX the credits for {$450.00} and {$210.00} where then charged back to my account. When I called Capital One to question this, they indicated that these transactions were reportedly made with a chip, and those could not be tampered with ( not true at all! ) and as such they could not 100 % be sure it was fraud, although they are acknowledging the XXXX charge as fraud from the same day as it was done online. The fact there was also a 4th large charge that was declined the same day clearly indicates someone making purchases who was not familiar with the account. I am being held responsible for over {$700.00} in fraudulent charges and they are refusing to help me any further.

Consumer Complaint: Capital One fails to uphold their obligation and duty to be accurate, fair, clear and concise, and uphold consumer laws. 15 U.S Code 1681a ( 2 ) ( A ) ( i ) states that excluded from a consumer report are transactions ( late payments ) and experiences ( utilization ). Why, after my many letters and calls to dispute this, are they still reporting anything on my account? Late or not, this information is private and should not be listed. I have opted out of being reported and they still share my private information with their third party agencies, ones who have not been granted permissible purpose. I called in yesterday XX/XX/23 to dispute this again and the woman told me she refused to talk about laws. She put me on hold to talk to a supervisor, and after 2 minutes it automatically hung up. I just spoke with XXXX XXXX XXXX # : XXXX. She told me there was nothing she could do as far as the consumer report. Interesting when the consumer reports reflect information capital one furnishes. I asked her to provide me with disclosures on how to dispute and she told me she could not send me anything but the she could tell me over the phone. What!? I literally had to try to write down word for word the address and information to include in a dispute. Not to mention she was speaking so fast. I told her you seriously can't slow down? Let alone send me disclosures and information i am requesting? I literally have to write down all this because you are failing to correct my information? I've never heard of a company that will hide information that should be clear and easily accessible to all consumers. Capital one is not listening to their consumers. They are STILL not being accurate on consumer reports. And when consumers try to get information to dispute and correct them, they are making it unclear and difficult to receive the information to exercise our right to dispute.

Consumer Complaint: Capital one I have 2 accounts autoloan and credit card. I was suffer from nsf fee due to XXXX XXXX XXXX. My car was reprocessed when I owed them $ XXXX from {$48000.00}. But it was my fault so I understood and paid off my vehicle with fees and fines total combined was around {$4500.00}. Belonging lost XXXX location found in towing company location was lost, never found. Got vehicle back to find out that capital one denied my access to my own autoloan that paid off. A month later when I check with dmv and capital one didnt release my lien yet. I call and they denied my account was ever existed so I told them that can you check if you released my lien yet. Ive paid off a month ago. They suddenly found that the lien was not released yet and they released it on XX/XX/XXXX when I paid off XX/XX/XXXX. So I asked capital one just to waive late fees for last XXXX months of my autoloan ( around {$100.00} ) that I was late and got it reprocessed and used them as credit to the credit card that I owe them. They said they will escalate it and when I call another day. My account couldnt be found again, never exist. Capitol one left me credit card that I owe them rewards points were deleted. Since credit score was bad my card was closed as well but the account was open so I paid for my debt until XX/XX/XXXX that I paid off my account. I paid interests and late since the day coronavirus started until the day I paid off. I only asked them that I need my autoloan statements for tax return. This is the answer I got from them a couple of day after my credit card account was paid off, you dont have account with us this time. Call ask for full account number, full credit card number, ssn provide but couldnt find anything. End up find tax return with those expenses. XXXX-my account has checking and credit card. Checking was closed with no reason. They said it was negative and cant be negative more than 60 days and my account had no movement for months. But I had my direct deposit coming in every 15 days. So I asked them Id like to pay for the negative amount that I owe you so I can have access to my statement. They said the amount was XXXX now because the couple of direct deposit bring them to positive so they closed it. Until now I sincerely dont understand why did they close my account and never give me a statements. For XXXX XXXX credit card - I just closed it this year XXXX. I missed a few payment so my credit score went bad and credit card was closed since XXXX kept account open to pay the debt and interests. I asked them about the coronavirus fee relief and I never be able to waive a single cent. I paid off my credit card with interest and fee. Same issues occurred but this time my login was block I couldnt log in to my account. Call them to be ask for full credit card info that I was closed in XXXX or account number that I had only last 4 digits. I try to get my information to be told that my account was locked due to fraud transactions. What? My credit card was closed by XXXX, I only paid during the time after it was closed. I couldnt use any credit on that card even if I paid off. Now my accounts was ban from fraud transactions. Need full credit card numbers of over two years ago card, full acc number when I have left was last 4 digits of my account number on my email, ssn is not allowed to be used for searching at the time. Statements will be paper released only if I provided XXXX digits number card or account. XXXX what are you afraid of? Or hiding? The number never lie, I paid off by sending fund from another account. The day I asked you to waive late fee because I was short about {$10.00} from over {$200.00} minimum payment. Your customer service said only {$10.00} I should have no problem. She did great though to remind me {$10.00} was lower than my minimum wage for an hour and I would definitely be charged if I failed. I dont know how to say it so I hang up. Just want to explain I was laid off suddenly late XXXX, XXXX payroll records. All my last paycheck was used to paid credit card capital one, XXXX, and XXXX credit account. I can borrow from friends and family but I did that before and not really proud of it. Charge me if you think it is necessary it is just gon na take me a day longer to pay you off. Never claimed unemployment nor plan to claim it. That was the message I want to tell her.

Consumer Complaint: Currently i have been monitoring my credit and recently found there were 2 credit card accounts where someone has apparently opened them in my name from California, and it was not me. One account is showing as Capitol One ( I HAVE NO CAPITOL ONE ACCT ), the second account is showing as XXXX XXXX XXXX ( I HAVE NO XXXX XXXX XXXX Acct ). I have absolutely NO knowledge of these accounts and i have verified with each of these entities that each of these accounts were not mine nor do i have any knowledge of them what-so-ever. I have also provided verification that to each entity the account is NOT mine and they are reporting inaccurately! As of this date they are STILL SHOWING on all 3 credit bureaus as delinquent accounts! Please help me get these fraud accounts off all three credit reporting bureaus!!!

Consumer Complaint: Capital One sent my a prequalified offer for a credit card. I used the pre-qualified offer and opened an account. I was given a {$2000.00} credit line and sent a card. I was using the card and paying it off once the charge posted. I never once was late on a payment and I never put more than {$600.00} on the account. Capital one suddenly closed my account and gave me very vague information as to what effected their decision to close my account. nothing new had come up on my credit report since I opened the account besides the hard inquiry from Capital One themselves. They had the option to first not send me a pre-qualified offer and secondly to not open an account. I now have another closed account on my credit report because of Capital One and don't have a clue as to why they actually closed the account. I spoke to Capital One customer service to inquire about my account being closed and they refused to provide any information and refused to let me dispute the closing of my account. The account was opened in XXXX of 2023, I was never late on my payments and was never over my credit limit and payed my account off early. My account was closed in XXXX of 2023. That also when I spoke to customer service. My account currently has a XXXX balance.

Consumer Complaint: On XX/XX/2023 I called in to Capital one to pay my two accounts and the Walmart card which they also manage. The man said he was sorry that my autopay had failed last month and I said me too, and we spent an hour on the line setting up auto pay again with a new checking account number and also I went through the long process of paying each account as well. This is all recorded by Capital one and I am formally requesting that this be listened to in order to validate my statements here. On the XXXX late in the day, ( my due date is the XXXX before XXXX eastern ) I received multiple letters from Capital One. No one called me, they just mailed letters which meant I had no time to contact them in order to pay on time. Sending letters to me meant I missed all my payments and was assessed a late fee for each account and also all three accounts were then sent as late to the credit reporting agencies. here is what the letters said : your payments made over the phone on XX/XX/XXXX did NOT go through, and your auto pay for each account has also been cancelled. We attempted to process them and your bank rejected them. ( I called my bank and they said NO ATTEMPTS WERE MADE BY CAP One. ) Also the letter said I could never use my checking account to make payments again. so, how in the world should I make payments now, I thought. So I called Capital one on XX/XX/XXXX after their XXXX cut off, to make the payments. I was told too bad, you are late because you missed the XXXX deadline, but had just gotten the letters. I called as soon as I got them from the mailbox. I am formally requesting that this call on XX/XX/2023 also be listened to, to support my claims. I was told that the checking account number they had on file for me WAS in fact the correct number! We verified it against my checkbook several times!! she said she didnt know how this could have happened. She and I spent an hour on the phone setting up auto pay once again for all three accounts, and I made my payments ( again ) but NOW I had to pay the EXTRA {$45.00} late fee for each account as well!! Inn order to keep my accounts current, I agreed and I received a confirmation code for EACH PAYMENT that we made again on XX/XX/2023. Today, XX/XX/2023 these payments were cancelled. They have NOT been presented by Capital One to my bank, and have NOT been paid. I am attempting to keep my accounts current and preserve my credit, but seem unable to do so. All I want to do is make payments and keep autopay on, but I am now THREE Months behind as I am UNABLE to get Capital One to accept my payments!! please help me thank you XXXX XXXX XXXX XXXX XXXX
