Consumer Complaint: I received an ad for a capital one credit card and in the top left it says no credit score needed to apply so I figured it was no risk to apply. When I did it, I got notice that it was a hard inquiry. I would not have done it if the advertisement said no credit score needed. This is dishonest.

Under 15 U.S. Code 1681 section 602 states, I have a right to privacy. Under 15 U.S. Code 1681 section 604A Section 2, it also states that a consumer reporting agency can not furnish an account without my written instructions. Under 15 U.S. Code 1666B, A creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose.

Consumer Complaint: I previously contacted capital one to pay the quicksilver card in full for the amount of XXXX but the payment would have to be delivered by mail. I sent the letter containing the case number and a check for the full amount on XX/XX/2023 through USPS certified mail with a XXXX business day ETA. The letter was stuck in transit for over XXXX weeks and I sent out another mail containing the exact same things. The original payment was due on XX/XX/XXXX but since the letter got lost in the mail the payment was not received. After calling them to confirm the letter was not received and I was unable to pay online or over the phone, all I could do was wait for the check to be received. After their fraud investigation concluded on around XX/XX/2023 was I finally able to pay over the phone. At the time I confirmed with the representative that no interest or late fee would be added to the account as I paid the account in full for XXXX on XX/XX/2023. Now as of XX/XX/2023 I was alerted that capital one said I had an outstanding balance of XXXX due to paying late.

Consumer Complaint: The Fair Credit Reporting Act ( 15 U.S. Code 1681 ) says ( 1 ) The banking system is dependent upon fair and accurate credit reporting. Inaccurate credit reports directly impair the efficiency of the banking system, and unfair credit reporting methods undermine the public confidence which is essential to the continued functioning of the banking system. So whenever there is a violation under the FCRA, it impairs the efficiency of the banking system. This is a violation of my privacy with my consumer report, since I control what is listed and what is not. In the event that any accounts are reported without my written consent, that is considered identity theft. This is a violation of both 15 U.S. Code 1681b ( 2 ) and 15 U.S. Code 1681c-2. This leads way to civil liability against the credit reporting agency for negligent and willful noncompliance under 15 U.S. Code 1681n, which allows for {$1000.00} per violation, for account listed without my expressed written consent.

Consumer Complaint: This complaint is in regards to XXXX. I did not see the companies second response until today, when I went to the CFPB website. Capital One 's response was : We took another look at our previous investigation and have confirmed the actions taken were correct. To help with your records, we've enclosed a copy of the letter we sent you about your case. Additionally, you sent information showing that the company compensated you for the issue. We are respectfully declining your request for further compensation from Capital One. This is not true! The company did not compensate for anything. I had to take XXXX to court to get the money from the clearly fraudulent charge that Capital One allowed. Capital One did not reimburse me for the {$97.00} of interest on the fraudulent charge. The total compensation was XXXX! The pain for Capital One forcing me to take XXXX to court instead of doing what was right, was tremendous.
