Consumer Complaint: There are 2 phishing charges on my account and capital one actually alerted me about these charges and asked me if 1 of the charges were legitimate at XXXX XXXX. I obviously was not making a charge at XXXX XXXX while sleeping, so it was not. At that time I looked back at charges and noticed another {$5.00} charge from the same vendor and realized this was from XXXX XXXX XXXX, and called them in the morning & they told me it was a common phishing scheme. I called capital one as instructed to get a new card and report these charges as fraud and was told that phishing isnt fraud. Its a scam. And they do not cover scams and Im responsible for the charges. Umm what? Since when are scams not fraud? I then said that I ordered a product and never received it and they told me that they would try to reach out to the company listed on the charges but if they couldnt reach them, Id be responsible for the charges. I said I could prove I never got the product, and they said it didnt matter because I fell for a scam. Ive never seen such a thing from a bank or credit card company. Theyve always covered these things!! And capital one states they Do cover such things with their Savor One Card.

Consumer Complaint: Capital One advertises their auto rental collision damage waiver without clearly disclosing that it does not apply to foreign rentals lasting longer than 30 days. I rented a car in XXXX for 34 days, it was damaged, and the car rental company charged me {$1700.00}. I submitted a claim for the damages and it was denied based on fine print buried deep in the current terms and conditions ( which may have changed since I took the card out several years ago ). Had Capital One and Visa clearly disclosed this limitation on the XXXX benefit, I could have broken up the rental or taken other steps to make sure I was protected. I have asked them to make an accommodation as matter of customer service, and they refused.

Consumer Complaint: BJS CREDIT CARD WHICH IS NOW XXXX XXXX : I AM DISPUTING THE CASH ADVANCE BALANCE TRANSFER FEE OF {$150.00} PLUS ANY LATE FEES AND/OR INTEREST CHARGED TO MY ACCOUNT. THE BALANCE TRANSFER REQUEST WAS NOT HANDLED IN A REASONABLE TIME FRAME. THIS FORCED ME TO OBTAIN ANOTHER LENDING SOURCE TO PAYOFF MY XXXX XXXX ON TIME. DOZENS OF MESSAGES AND PHONE CALLS WERE MADE TO CUSTOMER SERVICE AND TO SUPERVISORS IN THE BALANCE TRANSFER DEPT. WHICH PROVIDED NO REASON AS TO WHY THIS TRANSFER TOOK 8 WEEKS TO COMPLETE. SINCE THE BALANCE TRANSFER WAS NEEDED TO AVOID ANY INTEREST ON MY XXXX XXXX, I OBTAINED ANOTHER LENDING SOURCE. THE SECOND LENDER APPROVED MY BALANCE TRANSFER REQUEST AND SENT THE MONEY TO MY XXXX XXXX. BJ 'S BALANCE TRANSFER STILL HAD NOT GONE THROUGH AT THAT POINT. WHEN IT FINALLY DID GO THROUGH, MY ACCOUNT AT XXXX WAS ALREADY PAID IN FULL, SO I PAID BACK THEIR TRANSFER IMMEDIATELY IN THE AMOUNT OF {$5300.00}. SINCE BJ 'S BALANCE TRANSFER MONEY WAS RETURNED, THERE WAS NO REASON TO CHARGE A FEE, ESPECIALLY DUE TO THE LENGTH OF TIME FOR THE TRANSACTION TO COMPLETE. I HAVE NO INTENTION OF PAYING A FEE TO BJ 'S FOR SERVICES THAT WERE NOT PROPERLY HANDLED. I HAVE REQUESTED MANY TIMES FOR BJ 'S TO CREDIT MY ACCOUNT IN THE AMOUNT OF {$150.00} PLUS LATE FEES AND THEY HAVE IGNORED MY REQUESTS. THIS ACCOUNT HAS BEEN FLAGGED ON MY CREDIT REPORT AT XXXX XXXX AND OTHER CREDIT BUREAUS AND IS DAMAGING MY GOOD CREDIT. I HAVE ADDED A CONSUMER STATEMENT REFERRING TO THIS ACCOUNT ON MY CREDIT REPORT. I HAVE NEVER HAD A LATE PAYMENT TO THIS COMPANY IN ALL THE YEARS I WAS A MEMBER. THIS BJ 'S ACCOUNT HAS NOW BEEN TRANSFERRED TO XXXX XXXX.

Consumer Complaint: On XXXX XXXX XXXX around XXXX in the morning, I went to a Capital One ATM located at XXXX XXXX XXXX XXXX in XXXX, Virginia to make a cash deposit of {$1000.00}. As usual, I inserted my bank card and deposited XXXX ( {$100.00} ) dollar bills to the machine. The machine sounded like it normally does when you deposit cash to the ATM machine. This time, however, the machine was taking much longer than usual and for about 5 minutes I continued to wait in hopes that I would be able to receive a deposit slip. After 5 minutes, the screen went black and did not receive any confirmation nor my bank card back. Immediately I was concerned and went inside to speak with someone in the bank. I was informed by a bank teller that they do not have a key to that ATM and was instructed to submit a claim. My claim ( # XXXX ) for my account ending in XXXX was submitted. Over a month later on XX/XX/XXXX, I received an email reply stating that my claims has been denied. Their reasoning is that their review of ATM systems do not show a record of a deposit into your account at the ATM terminal. This is completely unacceptable and I'm very concerned and upset about this matter for the following reasons : 1- My money was inserted into the machine so how could {$1000.00} dollars NOT be accounted for? 2- Not only does the ATM stole my money, but it also stole my bank card 3- They should have camera surveillance of me inserting money into the machine 4- They are adamant about helping their customers with fraud, however, they are the ones robbing me of the {$1000.00}! Please, I urge you to help me in getting my {$1000.00} and bank card back. There should be no reason why they are not able to locate my money in the machine. Thank you so much for your help and please let me know if there is anything else that I can provide to get this matter resolved. Best Regards, XXXX XXXX

I am co-signing/the co-signer for the legal person ( XXXX XXXX ) when Im entering into any consumer credit transaction/consumer transaction.. Adverse action against a consumer is AGAINST THE LAW according to the Equal Credit Opportunity Act ( Regulation B ) which is codified in 15 U.S.C 1691 ( a ) ( c ) and is pursuant to civil liability under 15 U.S.C 1692k. Also they willingly and knowingly provided false and misleading information to me to make that decision 15 U.S.C 1611, while denying me extension of my OWN credit. They also alined themselves with the dealer in trying to make me put down a down payment when its a consumer credit transaction and thats breaking the law 15 U.S.C 1605, 15 U.S.C 1611. A creditor shall not refuse to grant a individual account to a credit worthy applicant for ANY prohibited basis 12 CFR 1002.7 ( a ). You are subject to criminal liability for violating 15 U.S.C 1691 and 15 U.S.C 1611 as I have proof that I was discriminated against by CAPITAL ONE due to the response I received. CAPITAL ONE is in violation of 15 U.S.C1642, U.S.C 1681 ( m ) and 12 CFR 1002 because I, the consumer, made a application in good faith, but credit was not issued. Furthermore, because my social security number ( credit card ) 15 U.S.C 1602 ( l ) was used and I received NO benefit. This is proof of fraudulent activity ( unauthorized use of credit card ) on behalf of CAPITAL ONE 15 U.S.C 1602 ( p ).

Consumer Complaint: I am writing to lodge a formal complaint against Capital One Auto Finance regarding the unauthorized reporting of a charge off on my consumer report, associated with Account # XXXX. This inaccurate information has caused serious injury to my creditworthiness, leading to multiple account rejections, including my inability to secure a home loan. As a result, I request the immediate removal of the charge off entry from my credit report. Additionally, I seek compensation of {$8000.00} for the violations caused by this unjust reporting. The false charge off entry has had severe consequences on my financial well-being and personal life. Due to this violation, I have been unable to obtain approval for numerous credit accounts and financial opportunities, leaving me financially strained and dependent on my family for housing. The impact of this inaccurate reporting has been devastating, as I am currently staying with family due to my inability to get approved for a home. The strain on my financial stability has caused immense stress and arguments with my spouse, ultimately leading to our separation. This unjust reporting has disrupted my life and has made it extremely difficult for me to achieve stability and security. I urgently request the Consumer Financial Protection Bureau 's assistance in conducting a thorough investigation into this matter, ensuring that Capital One Auto Finance rectifies the unauthorized charge off entry and takes full responsibility for their actions. Additionally, I request your support in securing the requested compensation as a means of rectifying the damage caused and providing some relief in this distressing situation. Issue: Closing an account
Subissue: Can't close your account
Consumer Complaint: In XX/XX/2023 I received an email from Capitol One that an account had been opened. I was unsure if this was a phishing email or not, so I did not click any of the links and instead called Capitol One using the phone number listed on the website. Capitol One confirmed that an account had in fact been opened with my name. They stated that they would close these accounts ( checking and savings ) and investigate the fraud. I froze my credit and reported this incident to the 3 credit bureaus as suggested by Capitol One. I did not receive a follow up. A few days ago I get an email from Capitol One stating that they needed additional information to move forward with my accounts, which I had told had been closed. I again called Capitol One and they transferred the call a few times. Ultimately, I was told that I would have to leave a message and they would get back to me. Given that I did not have the account numbers ( because I didn't open the accounts ) it was difficult to get help. I have yet to receive a return call and it has now been 5 days. This needs to be fixed immediately.
