Issue: Closing an account

Subissue: Funds not received from closed account

Consumer Complaint: My husband sold his company recently. The acquiring organization is based in XXXX. He received about {$320000.00} from the sale and had it deposited in my bank account, Capital One 306. We had access to the money for about three weeks, but funds were frozen just as we issued a large wire payment to repay a debt ( 2 payments, equal to {$110000.00} ) and scheduled a transfer of most of the remaining funds ( roughly {$120000.00} ) to XXXX XXXX to invest in a mutual fund. Conveniently for the bank - who pays us 0.1 % interest on over {$250000.00} and uses that as the basis to lend out {>= $1,000,000} at 8 % interest- they decided this amounted to " suspicious activity. '' So they closed my account. Their official justification is that my husband set up the wire transfers ( at my request, because I'm not great at that kind of thing ). Which is fine. If they don't want our money after 10 years, that's fine. They then sent us an email ( we kept a copy ) saying that a check would be mailed to us in 7 to 10 business days. That was 20 business days ago. Since we haven't received it, we called... we were told that our account hadn't been closed, and it was under investigation. No funds would be released until after the investigation was completed. So, they lied to us ... and have probably made about {$15000.00} in interest in the meantime. Then they gave us the phone number of an anonymous voicemail box that assured us we'd get a call back in XXXX hours. That was 50 hours ago. So, they lied to us again. Today, when we called to figure out why we didn't get a callback within 48 hours, the first person hung up on us. The second person didn't help us and did his best to not connect us with a supervisor. We then connected with a supervisor who... hung up on us after saying his name. So, where is our {$250000.00}? Why is it being investigated? Do we get a voice in this process? Why has the bank lied to us twice now? Is there a consequence to them lying to us? When can we expect our money?

Issue: Improper use of your report

Subissue: Credit inquiries on your report that you don't recognize

Consumer Complaint: Capital car financing gave pre approval options so I went with the pre approval so my credit wouldnt be affected! A person from capital one reaches out and tells me I didnt qualify for pre approval but stated they could try other options and would give me a call back. I told the representative that I didnt want to go through the process if it wasnt a soft inquiry and they said okay. Two days later capital one submits 2 credit applications without my approval DAYS LATER to 2 different loan companies one being capital one and one being XXXX who I never even heard of until it hit my credit report! I tried contacting capital one about this issue since XXXX and they keep giving the run around not acknowledging that they rep kept my SSN on file after I denied they service and used my social to apply for car loan applications TWO days LATER without my consent! This is damaging behavior to the consumer to hit their credit with 2 hard inquiries when they did not consent of this and is bounds for identity theft. It is illegal to use some SSN days later without having their consent and also to store someones credit number is absolutely INSANE. That kind of information is sensitive and a representative should not still have access to my ssn days later after we talked!

Issue: Problem when making payments

Subissue: Problem during payment process

Consumer Complaint: I received a billing statement with a balance of {$1700.00} that reported that I needed to submit payment before the payment due date of XX/XX/XXXX. I sent payment in full for {$1700.00} in a legal tender payment form via mail on XX/XX/XXXX. I called Capital One and they confirmed that they received my mailed-in payment on XX/XX/XXXX and would process payment accordingly. On XX/XX/XXXX I checked to see if the account balance was updated but I realized that they did not apply my payment to my account. Capital One then reported the closing of the account to XXXX and all other credit reporting bureaus on XX/XX/XXXX without correctly the billing error of the account balance or letting me know why they decided to close the account. Instead, they reported a new interest-increased balance month to month without the application of my payment. They are reporting the account as closed but increasing the account balance each month requesting I repay a new balance without acknowledging that my original payment has not been applied to my account. I sent letters on XXXX XX/XX/XXXX, XXXX, and XX/XX/XXXX all in an effort to correct this but Capital One has refused to do so. Now they have reported a balance of {$1900.00} on my consumer report without adjusting my payment of {$1700.00}.

Issue: Managing an account

Subissue: Deposits and withdrawals

Consumer Complaint: On, or about, XX/XX/2023, I was notified by Capital One, via email, that both my checking ( account ending in XXXX ) and savings account were to immediately have withdraws from the accounts frozen. There was absolutely no explanation as to why Capital One decided to take this action, which is understandable given that the notification was by email. I immediately called the support number ( XXXX ) that appeared on the web portal, along with a message reiterating that my accounts had withdraws frozen. After entering my information into the validation portion of the automated phone response, I was prompted to " leave a voicemail to be reviewed and the support center will determine if a return call it warranted ''. How can this be an appropriate response to locking someone out of their funds? Never-the-less, I left a voicemail and waited for two weeks with no response. In the first week of XX/XX/2023, I decided to continuous call different Capital One support numbers until I finally reached a representative that could see details as to why Capital One decided to freeze my accounts. This representative kept reiterating that she could not tell me anything other than that Capital One decided to freeze my accounts and that I am never allowed to open another account with them. There was no explanation as to how long my accounts would be frozen and even any detail as to why this happened. The next day I decided to call the same number again, hoping to reach an actually helpful representative. This time, the representative told me that Capital One was investigating my checking account and would close my savings account and send me a check with the remaining amount. Still, I was not given any explanation as to why this happened or how long I would be locked out of my funds. I was told, however, that someone would call within the week to give me details about what is happening and why. Needless to say, I never received this call. In the first week of XXXX I decided to call the same number to get an update in regards to this call I was supposed to receive. Again, the representative told me nothing in regards to why this happened or how long it would take. The representative told me that they would definitely be calling within two weeks with a call regarding what is happening and why. It's now XX/XX/2023 and I have not had access to my funds ( {$6700.00} ) since XXXX. I have still not received any explanation as to why this happened. How can Capital One legally be allowed to immediately freeze an account with XXXX XXXX dollars and still not give any explanation. This is absolutely absurd.
