Consumer Complaint: I just looked at my consumer reports and noticed a late payment on an account that I was never late for. Consumer reporting agencies have assumed a vital role and have a responsibility to report consumer information to the best of their ability with maximum possible accuracy like the Fair Credit Reporting Act clearly says. I have never been late on payments and did not provide written consent to report the account : Capital One : [ XXXX ]. Please investigate and provide proof with statements showing that these payments were late and proof that I authorized the reporting of this information. If proof can not be provided I demand these payments to be updated to on time as they should be as I was NEVER late.

I called to make an automated call and noticed my balance on my account was larger than on my written statement. I sought a live customer service and inquired why the increase and was told that a Late fee was added today after XXXX!!! I was surprised and never knew this timeframe for payment ... .Never heard of such-however I was speaking to someone in California of a Pacific Time Zone not a XXXX time. I am in TEXAS CENTRAL Time zone. *Question on my statement its East Time Zone written. I am So anger and Why should I paid NOW-today with a late fee already added ... .I spoke to a Supervisor and was rudely stated that " how it is '' ... And a {$35.00} was added. I don't want to paid the Late Fee or will Close the account but why pay now-wait to next month if I do at All!! When I contact the Online Chat to complain that I have the money and just gotten home for the evening!! I received a message that I can reapply for another card from XXXX XXXX XXXX and transfer my current balance for a interest of XXXX for 15 months and if I make purchases of {$500.00}, I would get {$200.00} cash bonus!!! This is unfair practice and to keep consumer in DEBT. I never heard of this kind of practice FEES and its not a midnight cut-off. I am Protesting the Time-Zone practice and seeking advice!!! I need justice and will presume legal affairs.

Consumer Complaint: According to the Fair Credit Reporting Act ( FCRA ) 15 USC 1681 section 602 ( a ), it is essential to ensure that consumer reporting agencies carry out their significant responsibilities with fairness, impartiality, and respect for the consumer 's privacy rights. As a consumer, I have the right to safeguard my private information, as supported by 15 USC 6801, which emphasizes the Congress 's policy that financial institutions must actively protect customer privacy and the confidentiality of nonpublic personal information. A " furnisher of information to credit agencies, '' classified as a financial institution, falls under this title. 15 USC 1681 section 604 ( a ) ( 2 ) stipulates that a consumer reporting agency may only provide a consumer report in accordance with the written instructions of the respective consumer. I want to make it clear that both the financial institution ( Furnisher of information to credit agencies ) and the consumer reporting agencies, XXXX and XXXX, lack my consent to furnish this information, and they certainly do not possess my written consent. Any form of consent, whether verbal, non-verbal, written, implied, or otherwise, granted to XXXX, XXXX, or the Furnisher of information to credit agencies is hereby revoked. Referring to 15 USC 6802 ( b ) ( c ), a financial institution can not disclose nonpublic personal information to a nonaffiliated third party without explaining how the consumer can exercise the nondisclosure option. The Furnisher of information to credit agencies failed to inform me of my right to exercise this option. Furthermore, 15 USC 1681C ( a ) ( 5 ) explicitly prohibits a consumer reporting agency from including adverse information in a consumer report without authorization. This account, reported as an adverse item, is being presented without my permission, violating the law. According to 15 U.S. Code 1681s2 ( a ) ( 1 ) ( A ), a person must not furnish information to a consumer reporting agency if they know or have reasonable cause to believe the information is inaccurate. 15 U.S. Code 1681e mandates every consumer reporting agency to maintain reasonable procedures to prevent violations and restrict the furnishing of consumer reports to specific purposes. XXXX and XXXX are failing to uphold reasonable procedures. Additionally, 12 CFR 1016.7 affirms that a consumer has the right to opt out at any time. I am choosing to opt out of your reporting services.

Consumer Complaint: XXXX XXXX of XXXX XXXX the manager in fraud with Capital one stated this account is not mines he has no record of this account at all. This account was verified numerous times and I told XXXX multiple times this account was fraudulent. They kept it on my credit report for a year almost reporting fraud. Both Capital One and XXXX are reporting an account that was open fraudulently harming my credit resulting in me getting many denials and inquiries because of the payment history. Ill will show all the screenshots I have taken of my credit to prove I tried to get this account removed multiple times and tried various ways to get it removed. I also spent XXXX hr XXXX mins on the phone with them to get no results but ran around to 5 different departments. Just for them to say call XXXX to have to remove it we cant do anything for you. We dont deal with credit reports is what The manager stated of Capital One.

Consumer Complaint: Last month I sent a dispute letter to your company regarding an alleged charged off account on my credit report. I asked your company for the debt validation letter as well as the 1099c form for the debt you claimed was written off in the amount of {$14000.00}. I also informed you that I was instructed by the IRS to file form 3949a for illegal tax violations. I was waiting until Capital One did their due diligence and properly investigated, but I will now move forward with filing form 3949a because I am now under the impression that maybe some dishonest and unprofessionalism is going on. This dispute is to inform you that not only have you failed to send the requested documents, but you also failed to inform the credit bureaus that this account was/is in an open dispute so that they can properly notate the account to inform other creditors. You have potentially caused me to lose out on offers due to reporting this inaccurate item and not notating it was disputed. I am attaching my credit report as of XX/XX/24 to show that there is no note on the account as well as the discrepancies in the payment history being reported. How can XXXX report XXXX missed payments while XXXX report XXXX? Your company is not credible, and this is obvious gross misconduct. I am also attaching the dispute letter, which is dated, and time stamped, which will also show that you failed to provide the required documentation.
