Consumer Complaint: I purchased product from the company XXXX using a pay in four service, XXXX. I returned the merchandise within company guidelines for a full refund. The money was returned to XXXX which was then refunded to my account at Capital One. XXXX provided me with the following ARNs for the refunds : XXXX : XXXX ( {$130.00} ) XXXX : XXXX ( {$130.00} ) XXXX : XXXX ( {$130.00} ) XXXX : XXXX ( {$26.00} ) and XXXX ( {$100.00} ) Only two transactions for {$130.00} were actually returned to my account. Capital one has instructed me to try many different things including filing two different disputes and a deposit search, all of which did not return in my favor. XXXX is no help, and neither is capital one. Someone has my money and they refuse to give it to me.

Consumer Complaint: This company put a fraudulent credit card on my credit reports, for like {$230.00} as a charged off account after 30 days???? It was confidently charged off after I had contacted them refuting this account and debt as mine, and then they just charge it off as bad debt? To spite me Im sure, because I have read 1,000s of complaints about Capital One doing fraudulent activities such as this to 1,000s of other people.! I already filed a complaint against them that I never opened this account to begin with, and now they are trying to make it worse by saying that its charged off as bad debt nowI will NEVER DEAL WITH THIS COMPANY EVER AGAIN IN MY LIFE.! My personal information was stolen, along with my personal belongings, such as my wallet and phone, which had my SSN card among other identifying information, which I know was used for a lot of other fraudulent activities, because Ive had to get other account la removed for the same thing. And as per advice from my attorney, so have given this one and only time for Capital One to rectify this situation. By deleting this fraudulent account off of my credit reports ( XXXX, XXXX, XXXX ) IMMEDIATELY! Or litigation will commence against them, and they will be sued to the fullest extent of the law allowed.! First and last warning.!

Consumer Complaint: I filed a charge back with Capital One after the company XXXX XXXX XXXX XXXX ( XXXX ) had me pre-pay for a service, violated our contract by not performing that service ( they never showed up on our scheduled date and time ), and then not refunding my payment. At first, Capital One provided me with a credit. Then, they reversed the credit. I called and asked why, and they stated that it was reversed because XXXX lied and told them that I canceled the appointment. That is not true. I waited for the detailer to show up, and when no one showed up, I called XXXX and the agent said she couldnt get ahold of the detailer. She offered to reschedule, and that it would be with a different detailer, but she wouldnt be available to detail my car until days later. I declined and said I would like a refund since I didnt receive the service. She obliged and said she put in the refund and I would receive it in 7 to 10 business days. That time came and went, and when I would email XXXX they never responded. When I called, I would constantly get the runaround and agents would state my refund should have processed by now and that a manager would call me back. A manager never called me back. At this point, my only choice was to file a charge back with Capital One. This business ( XXXX ) has dozens of the same reviews on XXXX. That no one shows up to perform the service, and they never refund the customers. Im surprised that a company like Capital One believed their lies that I canceled the appointment.

Consumer Complaint: On a reply from Capital One on XXXX XXXX I am being informed that Capital One has stated " In your request, you also indicated that you believe we should not be reporting your account to the CRAs. However, according to the terms of your Customer Agreement, we may report information about your accounts to credit bureaus. Late payments, missed payments, or other defaults on your accounts may be reflected in your credit report. '' While according to 15 USC 1681b ( 2 ) ( I ) exclusions in reporting containing information solely as to transactions or experiences between the consumer and the person making the report. Reporting a Late payment is a violation of 15 USC 1666B Timing of payments ( a ) Time to make payments, A creditor may not treat a payment on a credit card account under an open-end consumer credit plan as late for any purpose. Capital One has asserted and enforced upon a consumer right directly violating the right to report certain information on my behalf. I have never been given the right to opt out of the reporting on this account this is my final attempt of removal before a small claims will be filed for violations of consumer rights and rights under the Fair Debt Collection Practices Act, Fair Credit Reporting Act and Gramm-Leech Bliley Act. The account is reporting as closed but not removed from still reporting.

Consumer Complaint: I've been attempting to apply for credit limit increases with Capital One for XXXX years now. I have XXXX cards with the company and have been a customer for upwards of 6 years now. Starting roughly XXXX years ago, they claim that there is pending legal action against me and that they are unable to authorize my credit limit increase request because of this. I have called them multiple times requesting additional details on where this information is being sourced from and how I can correct this and making sure they understand that there is no pending legal action against me. I have also confirmed firsthand and relayed to Capital One that my credit reports from the XXXX major bureaus do not show any evidence of pending legal action. Everytime I try to solve this issue by calling them, they tell me they can't provide me with information on where they get their information from, and then when I attempt to escalate to a manager I am being told that they will file a ticket and follow up with me but never do, or tell me that there's nothing they can do for me and that I'm welcome to try applying for an increase again if I believe this is in error. I have tried applying at least XXXX times now, and everytime I get the same denial with the same reason.

I also sent Certified Mail # ( XXXX ) to XXXX XXXX XXXX XXXX ( Capitol One ) XXXX XXXX XXXX XXXX XXXXXXXX XXXX XXXXXXXX ( which was delivered on XXXX XX/XX/2023 ) a Letter Of Instructions, Claiming the Interest & Equity Owed to XXXX XXXX XXXX Principal accounts ( XXXX ) ( XXXX ) ( XXXX ). I sent the Endorsed Bills per Bill Of Exchange Act 1882 Chapter 61, I sent a Durable Financial Power Of Attorney, to show I am the agent for the principal and I also sent a letter titled Federal Reserve Act Section 16. Notes Issues, just in case they have forgotten their duties as CFO. I mentioned in the instruction letter for the CFO to contact me in writing within XXXX business days giving reason for non-performance of his fiduciary duties. Then the XXXX XXXX XXXX XXXX Closed all three of my XXXX XXXX without my authorization and reported a false statement to the XXXX reporting companies that it was canceled by the creditor which is a lie because I'm the XXXX XXXX and I did not authorize what is going on now. 12 USC Sec. 1431 shows the powers and duties of the bank, they are the borrower and they pay the interest all Banks are security transfer agents and are committing securities fraud daily. Capital One XXXX XXXX XXXX XXXX is in Violation of the Federal Reserve Act Sec. 16 Note Issues ( 1 ) ( 2 ), Bill of Exchange Act 1882 Chapter 61 and the Federal Reserve Act Sec. 29 Civil Money Penalty. Capital One has a pattern of misconduct when it comes to upholding the Federal Reserve Act Section 16. Note Issues ( 1 ) ( 2 ), Bill of Exchange Act 1882 Chapter 61, Hart-Scott-Rodino ( HSR ) Act and the Constitution of the United States. Capital One and XXXX XXXX XXXX XXXX is knowingly and recklessly causing a substantial loss to the principal and is in breach of his fiduciary duty. I am now in the Second Tier of The Federal Reserve Act Sec. 29 Civil Money Penalty with this company. I guess I will have to take this to Federal Court because it seems like the CFPB is in the pocket of all these banks and does not do a thorough job of investigating these Banks for breach of contract and securities fraud, heck maybe they don't know the Law either.
