I have not given you permission to access my credit profile and you have no permissible purpose by law to contact third parties with my private or personal information. Your offenses amount to Aggravated Identity Theft pursuant to 18 U.S.C. 1028A. You have knowingly transferred, possessed, or used, without lawful authority, a means of identification of me, which is a felony punishable with up to 2 years of imprisonment, in addition to civil liability. By obtaining my XXXX consumer credit report on XX/XX/XXXX without my permission, or without a permissible purpose by law, you are also in violation of the Fair Credit Reporting Act ( " FCRA* ) codified at 15 U.S.C 16186 ( a ) 3 ( 1 ) ( i ). Chester v. Purvis, 260 F. sup 2d711 ( S.D Ind.2003 ) I have not initiated any transaction with Capital One furthermore, I do not have an " account '' as defined under 15 U.S.C. 1693a ( 2 ) with Capital One for review for collection. Pursuant to 15 U.S.C. 1681n ( a ), " Any person who knowingly and willfully obtains information on a consumer from a consumer reporting agency under false pretenses shall be fined under Title 18, imprisoned for not more than 2 years, or both. Consumer Complaint: On XXXX XXXX, I noticed a pending transaction on my CapitalOne credit card in the amount of {$120.00} from " XXXX XXXX ''. Because I was XXXX shopping a lot during this week, I was checking my credit card transactions often and I immediately knew {$120.00} from XXXX XXXX wasn't something I recognized. " XXXX XXXX '' is not even on XXXX, so it was fishy to me right away, so I called CapitalOne to report the fraud transaction asap. In short, CapitalOne got back to me a week later and still charged me {$120.00} from XXXX XXXX saying to me that the transaction was made " in person '' using the " chip '' so they did not deem it as fraud because the card wasn't lost. The fact that I had the credit card in my possession, but someone was able to charge my credit card as if it were me is what's most worrisome to me. Because that is what fraud is, right? I have reported this to identitytheft.gov, the credit bureau, and the local police. I'd be happy to provide anything CapitalOne or help Police or any government agencies requests in order to get to the bottom of this type of fraud where the credit card companies are even fooled, and the consumer ultimately suffers due to it.

Consumer Complaint: Capital one has not applied my payments to my accounts. XX/XX/2023 a payment of {$930.00} on one account and {$2000.00} on another account. On XX/XX/2023 was the last date I mailed in 3 payments of {$5000.00} on the 2 accounts that weren't applied on my accounts and was sent certified mail with my payment coupons. Still no actions from them to apply my payments to my principal account. They never sent back any payment coupons that I sent in, nor did they apply any of the coupons to my account. If they didn't send them back then they have accepted them and have yet to apply the payments to my account. The negotiable instruments have been filled out and endorsed by me the living being.

I called them several time but all they said that this was FRAUD. Someone at the company that this was from a mortgage company. I sent them a rentals agreement that we have but of no use. Also called XXXX XXXXl and no response. My wife found out that they had paid a refund to individuals. Since this was done, I didn't not send this complaint in.

Consumer Complaint: I setup my payment a head of time, got a letter date before it was due saying my banking info not working please update. I been on phone from XXXX to almost XXXX off and on still no help, even told me to call my bank who just said as always funds and account fine, suggested ask for someone who inputs payment and get confirmation which after time calls and even tried to contact corporate office said their system not able to process my checking account of ATM master card, no idea why and after all the calls and chats to them, my bank even XXXX XXXX but it is their store card and process that the issue so more of a run around then helpful. XXXX XXXX XXXX XXXX XXXX and do not need stress or XXXX XXXX beat trying to fix something thats not my fault or in my ability to fix as if mail check same info on the check as they inputted or had computer input. Its expensive enough to use credit card without being ding for no payment when its their issue or machine holding issue up out of the blue after months or years of working. I am stressed, tired and confused by this mess please advice. Letter letting me know showed up today payment was to been processed today due tomorrow.

Consumer Complaint: To Whom It My Concern Dispute Center In reviewing my XXXXXXXX XXXX XXXX on Friday, XX/XX/XXXX, I noticed my score changed from XXXX to XXXX by dropping XXXX points from previous credit reports. The drop in score is due to my Capital One account needing to be listed on my XXXX XXXX XXXX Since Capital One did not list my account on the XXXX report, the report showed a fair credit score versus an Excellent score. Earlier this year, I experienced the same problem with Capital One not reporting my credit information to XXXX, and it took months to rectify the situation. Since I am self-employed, my credit score assists with my borrowing capital. Please report Capital One on my XXXX credit report immediately to alleviate any problem with my XX/XX/XXXX credit report. Capital One Credit Bureau Resolutions notified me by letter on XX/XX/XXXX, stating that they verified that the above-referenced account is reporting to my credit file and advised that I contact the credit reporting agencies directly to assist with my request. On XX/XX/XXXX, at XXXX XXXX I reached out to XXXX and spoke with XXXX XXXX XXXX representative identification # XXXX. He stated that I must contact Capital One to resolve the problem.

Per the FCRA, as a federally protected consumer, I am opting out of any authorization, I, the consumer may have given you. i.e., written, non-written, verbal, non-verbal, but not limited to such. The law states that it is illegal to report transaction history. Effective immediately and indefinitely, I demand that XXXX XXXX XXXX stop reporting to any and all non-affiliates pursuant to : 15 U.S. Code 6802 Obligations with respect to disclosures of personal information a ) NOTICE requirements Except as otherwise provided in this subchapter, a financial institution may not, directly or through any affiliate, disclose to a nonaffiliated third party any nonpublic personal information, unless such financial institution provides or has provided to the consumer a notice that complies with section 6803 of this title. To this day, despite providing the XXXX number, the remittance details, Capital One is incapable to give me an answer as of where my money is. I also went to XXXX bank to see if they can help me. Since the money will not go to a XXXX account they will not be able to help me. This is their own words. I strongly believe that one of them ( XXXX or Capital One ) has my money and doesn't know where to send it. It is crazy that they can not wire it to my account. I checked the account number on the remittance details to make sure it was correct. I checked the routing number to make sure it was correct. EVERYTHING IS CORRECT. XXXX is my last resort as I am getting nowhere.
