Attempts to receive refund were rebuffed. Promises made to deliver a " return label '' was promised and not kept. Telephone calls would be listened to with no warning of a supervised line. My limitations are documented in the files of XXXX XXXX XXXX, XXXX, Surgical Faculty at the XXXX XXXX XXXX, practicing at the XXXX XXXXXXXX and XXXXXXXX XXXX XXXX. I was XXXX by a XXXX XXXX XXXX XXXXXXXX effective XXXX. The State of Maine is under a US DOJ ADA Section is under a Consent Decree providing for special attention for developmentally delayed and XXXX persons. Should the CFPB need medical records to adjudicate my claim, I will provide records for protected review to establish the claim.

Consumer Complaint: On XX/XX/, I used my credit card as defined under 15 USC 1602 ( a ) ( l ) to extend my credit through Capital One company. On XX/XX/, I received an adverse action letter from Capital One company attempting to explain why I was denied. According to 15 USC 1691 ( a ) ( 3 ), this was an act of discrimination. I, in good faith, exercised my right to extend credit as a consumer and a creditor, and I was denied for no specific reason. Capital one also violated federal law and will be held civilly and criminally liable because Capital One violated 15 USC 1602 ( a ) ( p ). Capital One used my credit card without authority, and I, the cardholder and consumer, received no benefit. They are now civilly criminally liable under : 1. 15 USC 1611 2. 15 USC 1640 3. 15 USC 1691e

Consumer Complaint: Last summer I requested Capital One to comply with the agreement we had on payment of a balance due. This agreement was if I paid the balance owed they would take all negative information off and report me as current. Not only have they refused with our agreement to comply stating they do not remove negative remarks, especially upon a payment agreement when they have done so with a past account I had with them, they are also not reporting it as paid, hurting my credit. If I had known this I would not have paid the almost {$300.00} and told them to buzz off.

Consumer Complaint: I have been a customer with Capital One for over XXXX years. This was my XXXX credit card when turning to an adult. With that being said, recently I opened additional credit card with them and had no issues. I also have a checking account with them which i barley use and multiple times when i make a payment it reverts to my capital one checking account instead of my XXXX XXXX checking account for my payment. Mind you that i made several payments prior to my credit card payment being due. Since i have made several errors with my payment method, capital one closed both of my credit cards, due to returned payment. 99 % of those returned payments was because of the system auto filling it to my capital one checking account and not my XXXX XXXX checking account. This is my error as well which once i see the mistake was made, I immediately go back on the app and re-submit my payment from my XXXX account. Them closing my XXXX credit cards for this mistake caused a negative impact to my credit and also created a negative affect to my financials. I am seeking Capital one to reopen my credit card accounts and also report it to the credit bureaus.

Consumer Complaint: According to the Fair Credit Reporting Act 15 USC 1681 section 602 a states " There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' XXXX, XXXX and XXXX are consumer reporting agencies and I am the Consumer. I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states '' It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' Furnisher of information to credit agencies is a financial institution by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' Furnisher of information to credit agencies the financial institution and the Consumer reporting agencies XXXX, XXXX and XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX, XXXX and XXXX that Furnisher of information to credit agencies whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' ( Furnisher of information to credit agencies ) Never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. XXXX and XXXX are not maintaining reasonable procedures. Also XXXX XXXX XXXX states that " A consumer XXXX exercise the right to opt out at any time. '' I am opting out of your reporting services.

Consumer Complaint: Hello, My checking and savings accounts with Capital One were first restricted on XX/XX/XXXX. I called Capital One the same day. They informed me my account was restricted due an issue with XXXX payments. They removed the restriction and I was able to use the accounts again. XXXX days later on XX/XX/XXXX my accounts were restricted again. After speaking to a representative I was informed Capital One would be " terminating the relationship '' and my accounts would be closed immediately. I was told I would receive a check in the mail with my balance within 1-2 weeks. The total balance of my funds with Capital One is around ~ {$8000.00}. On XX/XX/XXXX I received an email from Capital One stating I would receive my balance within " 7-10 business days ''. I have included the email in my complaint. On XX/XX/XXXX I called and was informed there is suddenly an ongoing " investigation '' of my account. According to the representative my funds will be held until said " investigation '' is over. The representative was unable to provide a reason for the " investigation '' or a timeline it would be completed by. Today is XX/XX/XXXX. I have not received my check or any letter related to this incident. I find this extremely frustrating as my balance was fundamentally stolen from me and I have been offered XXXX recourse or even an expected date my money will be returned. I am no different than anyone else, I have bills to pay, a stomach to feed. This theft has negatively affected my daily lifestyle and my ability to support myself. I believe I have done nothing to warrant an " investigation '' and this gross corporate malfeasance seems like a predatory excuse to retain my funds indefinitely. Thank you for your time.

Consumer Complaint: Capitol One Bank has been sharing my personal non-public information with non-affiliated third parties including consumer reporting agencies. on XX/XX/2023 I notified Capitol One Bank that I am opting out of all and any authorizations whether written, unwritten, verbal or non-verbal for the sharing of my non-public personal information pursuant to 15 USC 6802 of the Gramm - Leach Bailey ( GLBA ) Despite my explicit opt out request and my clear assertion of my rights under the GLBA, I have reason to believe that Capitol One has continued to furnish my nonpublic personal information to non-affiliated third parties and consumer reporting agencies without my consent. This unauthorized use of my personal information constitute a serious violation of my privacy rights and a breach of federal law. I am deeply concerned about the potential consequences of this unauthorized sharing, including the potential for identity theft, fraud or other financial harm. Can the Consumer Financial Protection Bureau please investigate this matter thoroughly and take the appropriate action to ensure that Capitol One complies with all federal regulations and laws, including the GLBA, to protect the privacy and information security for consumers like me.
