Consumer Complaint: We were originally charged 0n XX/XX/XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX {$48.00} I called and spent 45 minutes explaining we did not make or give permissin to incur this charge and they refunded it to us on XX/XX/XXXX. Then on XX/XX/XXXX they put the charge back on our account and I called on XX/XX/XXXX and spent 85 minutes talking with 3 sepperate reps and was told that I did not respond to a letter they sent requesting all documentation in regards to my efforts to resolve this issue with the vendor and I explained very clearly that I had no documentation due to that company not having a phone number or email address that i could find. I then explained again that back in XX/XX/XXXX we purchased a 1 month subscription to that company to stream a series.This charge was posted to our account XX/XX/XXXX for {$21.00} then no charges from XXXX were posted on our account after that untill XX/XX/XXXX for {$48.00} which doesnt reflect XXXX monthly amount or the cost for a full year. After explaining my issue to the 3 Represenatives on my XX/XX/XXXX call I said if you can not see your way to returning the charge I would like to close my account They then put me on hold 4 different times while going thru their process of closing an account in seppperate steps. I was on the phone for an additional 65min and when the rep attempted to put me on hold for a 5th time I said close the accountand hung up so I dont think my account even got closed

Consumer Complaint: On XXXX there is a charge posted for a charge on my Capital One credit card account ending XXXX for an item that I have canceled with the merchant but have been unable to receive a refund. I send a dispute form to Capital One to initiate a dispute for this and received a confirmation that it was delivered to Capital One on XXXX XXXX XXXX XXXX XXXX However, Capital One has not done anything since to actually start the dispute process or help me in any way. Consumer Complaint: I sent a communication to CAPITAL ONE, regarding my option to opt out of having my nonpublic personal information shared/reported to any credit bureaus including XXXX, XXXX and XXXX. In regards 15 USC Code 6802, it states that : a financial institution may not, directly or through any affiliate, disclose to a nonaffiliated third party ( CAPITAL ONE AND THE BUREAUS MENTIONED ABOVE ARE NOT AFFILIATED ) any nonpublic personal information, unless such financial institution provides or has provided to the consumer a notice that complies with section 6803 of this title. ( b ) Opt out ( 1 ) In general A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless ( A ) such financial institution clearly and conspicuously discloses to the consumer, in writing or in electronic form or other form permitted by the regulations prescribed under section 6804 of this title, that such information may be disclosed to such third party ; ( B ) the consumer is given the opportunity, before the time that such information is initially disclosed, to direct that such information not be disclosed to such third party ; and ( They NEVER gave me this information/option ) ( C ) the consumer is given an explanation of how the consumer can exercise that nondisclosure option. ( Again, they never gave me that option when the transaction was initially done ). *Also see ; 12 CFR Part 1016 Subpart A* They DID NOT give me full disclosure when the transaction initially took place, which is misleading and fraudulent. NONPUBLIC PERSONAL INFORMATION MEANS : personally identifiable financial information ( i ) provided by a consumer to a financial institution ; ( ii ) resulting from any transaction with the consumer or any service performed for the consumer ; or ( iii ) otherwise obtained by the financial institution. NON AFFILIATED THIRD PARTY MEANS : any entity that is not an affiliate of, or related by common ownership or affiliated by corporate control with, the financial institution, but does not include a joint employee of such institution. I am demanding that this information that I choose to no longer have shared with the bureaus, be removed from all of my credit reports immediately. In addition, compensation for their violations of the law and making my life difficult.

Consumer Complaint: I'm just gon na start this off by saying these people are so annoying. I wrote a letter to capital one to inform them that I am opting out and revoking all previous permission that I may have given them in terms of sharing my nonpublic personal information to any non-affiliate. Capital one knows that they are not affiliated with XXXX XXXX XXXX and XXXX and that it does not fall under any exemption that is either in 12 CFR 1016 or 15 USC 6802 of course they always have some stupid excuse as to why they can't do something or you can't speak to a representative who has a little bit more power to get anything done so I'm making this notice available to the CFPB to demand remedy. Capital one received an opt out notice from me about a month ago dated XX/XX/. The opt out notice stated that I was revoking any verbal or nonverbal permission that I gave them to share my nonpublic personal information with any non-affiliate indefinitely. Capital one finally called me on Monday, XXXX XXXX XXXX XXXX XXXX to tell me that they can't do anything as it pertains to sharing my nonpublic personal information with non-affiliates such as XXXX, XXXX XXXX and XXXX who by the way do not fall under the exemptions for who Capital one can share non-public personal information with. This is irritating because Capital one along with these other creditors never follow the rules but the consumers are always supposed to follow the rules. in addition they did not give any notice on how to opt out of sharing my nonpublic personal information with non- affiliates which is also against the law. I am demanding that Capital one rectify the situation by removing my non-public personal information and stop sharing my non-public personal information who is non-affiliates who do not have an exemption under 12 CFR 1016 and 15 USC 6802 such as XXXX XXXX XXXX XXXX XXXX. If anyone is confused about what non-public personal information is here is the formal definition of the term as provided by both 12 CFR 1016 and 15 USC 6802. 12 CFR 1016 : Nonpublic personal information means : ( i ) Personally identifiable financial information; and ( ii ) Any list, description, or other grouping of consumers ( and publicly available information pertaining to them ) that is derived using any personally identifiable financial information that is not publicly available. 15 USC 6802 : Nonpublic personal information ( A ) The term nonpublic personal information means personally identifiable financial information ( i ) provided by a consumer to a financial institution ; ( ii ) resulting from any transaction with the consumer or any service performed for the consumer; or ( iii ) otherwise obtained by the financial institution. ( B ) Such term does not include publicly available information, as such term is defined by the regulations prescribed under section 6804 of this title. ( C ) Notwithstanding subparagraph ( B ), such term ( i ) shall include any list, description, or other grouping of consumers ( and publicly available information pertaining to them ) that is derived using any nonpublic personal information other than publicly available information; but ( ii ) shall not include any list, description, or other grouping of consumers ( and publicly available information pertaining to them ) that is derived without using any nonpublic personal information. This makes the whole transaction nonpublic personal information as the transaction itself is private.

Consumer Complaint: According to the Fair Credit Reporting Act FCRA 15 USC 1681 section 602a states " There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumer 's right to privacy. '' XXXX, XXXX and XXXX are consumer reporting agencies and I am the Consumer. I have the right to make sure my private information isnt shared which is backed by 15 USC 6801 which states It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. Capital One Financial Corporation is a financial institution by definition stated in 15 U.S. Code 6827 ( 4 ) ( a ) The term financial institution means any institution engaged in the business of providing financial services to customers who maintain a credit, deposit, trust, or other financial account or relationship with the institution. Gramm Leach Bliley Act section 501 ( b ) ( 1 ) states that an agency or authority need to to insure the security and confidentiality of customer records and information and section 502 ( a ) states Except as otherwise provided in this subtitle, a financial institution may not, directly or through any affiliate, disclose to a nonaffiliated third party any nonpublic personal information, unless such financial institution provides or has provided to the consumer a notice that complies with section 503. Capital One Financial Corporation may not disclose my transactions and credit utilization to any nonaffiliated third party, such as and including XXXX, XXXX, and XXXX. 15 USC 1681 section 604 a section 2 states that In general subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. Capital One Financial Corporation and the consumer reporting agencies XXXX, XXXX and XXXX do not have my consent to furnish non public information of my credit transactions and credit utilization and they surely do not have my written consent. Any and all consent to Capital One Financial Corporation, XXXX, XXXX, and XXXX whether it be verbal, non-verbal, written, implied, non written or otherwise is revoked. In 16 CRF 313, which is under the authority of 15 USC 6801, part 313.6 ( a ) ( 6 ) it states that privacy notices must include An explanation of the consumer 's right under 313.10 ( a ) to opt out of the disclosure of nonpublic personal information to nonaffiliated third parties, including the method ( s ) by which the consumer may exercise that right at that time ;. With that, 12 CFR 1016.1 also requires that the financial institution Provides a method for consumers to prevent a financial institution from disclosing that information to most nonaffiliated third parties by opting out of that disclosure, subject to the exceptions in XXXX, XXXX, and XXXX. Capital One Financial Corporation did not provide an adequate or reasonable opt out notice to me to opt out of nonpublic personal information pertaining to my transactions and credit utilization to non affiliated third parties. I am exercising my right to opt out of any nonpublic personal information Capital One Financial Corporation is disclosing to nonaffiliated third parties pertaining to transaction details of monthly payments, effective immediately and back dating to XX/XX/XXXX. There will be an opt out letter attached in supporting documents. 15 USC 6802 ( b ) ( c ) states that A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless- the consumer is given an explanation of how the consumer can exercise that nondisclosure option. Capital One Financial Corporation never informed me of my right to exercise my nondisclosure option. In addition, 15 USC 1681c ( a ) ( 5 ) states Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information. Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. This transaction information and credit utilization is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s-2 ( A ) ( 1 ) A states A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681 e states Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishings of consumer reports to the purposes listed under section 1681b of this title. XXXX, XXXX and XXXX are not maintaining reasonable procedures. Not only have these listed agencies violated the Fair Credit Reporting Act, but also the Privacy Act of XXXX 5 USC 552a, and the Gramm Leach Bliley Act as these grievances fall under these Acts as well.

I have not been able to access my Capital One Account online for approximately one year because Capital One locked me out and requested that I provide my Bio Metrics to gain access again. By not being able to access my account I have not been able to provide any address updates or phone number updates so that Capital Could contact me. I call over a dozen times and was advised I could not visit a branch I could only use the link they provided to update BIO Metrics & gain access to make any updates on my account or retrieve billing statements. My account went 100 days past due during this time. Note : As of XX/XX/2024 I spoke with a very nice representative who has finally allowed me to update my phone number for contact and to allow me log in access after one year!!! My car was repossessed and XX/XX/2024 and On XX/XX/2024 I contacted the Lien Holder Capital One to satisfy my past due balance. I was advised to contact XXXX XXXX to retrieve my personal belongings & Vehicle. I contacted XXXX XXXX and was told by XXXX XXXX that I would not be able to retrieve my childrens medication, personal belongings or even my vehicle until 4days later because the company was under staffed, closed on the weekends & closed on the holiday. I advised that I need my childs medication & the staff member was very rude stating well what do you want me to do I cant cancel other peoples appointment just so you can get your things. We have transporters debtors and other people waiting. XXXX XXXX has taken on much more work than they can handle and because of greed consumers have to suffer. I would like a refund of my repo fee which was {$420.00} and statutory damages. Capital One is aware of the deceptive practices this company uses to run up additional fees and to put consumers at a disadvantage. Capital One has chosen to ignore the complaints in exchange for the lower prices charged by XXXX XXXX. I am not the first person this has happened too and ask that the XXXX/CFPB take action immediately against this company

Opened it up and showed XXXX as my score. Went to look at credit report and I had over 14 new open issues at top and below showing all open accts from XXXX of XXXX and a couple in XXXX.
