Consumer Complaint: Capital One Auto Finance, ACCT # XXXX, is being reported on my credit report. Under Section 604 15 U.S. Code 1681 B, it states none of the credit bureaus have the right to report anything on my credit report. 15 U.S. Code 1692 states that upon any disputed item on a consumers credit report, the debt collector shall cease collection of the debt, or any disputed portion thereof. Therefore, this is in violation! According to 15 US Code 681s-2, a person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. This collection, by law, MUST be DELETED from my credit report immediately.

The timeline of events is as follows : - On XX/XX/2023, I submitted my original dispute letter to Capital One. The dispute pertained to eleven late payments associated with a closed account. In my letter, I requested that Capital One remove these late payments unless proven to be accurate. - On XX/XX/2023, Capital One responded, asking for necessary information to properly investigate my dispute. I promptly provided the required information the following week. - The last correspondence I received from Capital One, dated XX/XX/2023, stated, " The Fair Credit Reporting Act requires us to report the account history accurately. We are unable to change our reporting on a courtesy basis. '' Notably, there was no written confirmation or explicit acknowledgment that Capital One had thoroughly investigated the late payments or verified the accuracy of the information. It's crucial to emphasize that my original dispute was not framed as a courtesy request but as a formal dispute under the FCRA. Capital One 's response appears to assume a courtesy basis, overlooking the legal obligation under U.S. Code 1681s-2 to conduct a reasonable investigation in response to a dispute and provide accurate information. Moreover, the necessity of reaching out to Capital One multiple times to reiterate my requests is not only inconvenient but also extends the resolution timeline, causing undue stress and potential harm to my credit. This prolonged process raises concerns about the efficiency and fairness of Capital Ones dispute resolution procedures. I believe there may be violations of U.S. Code and the FCRA in Capital Ones handling of this dispute, particularly regarding the lack of written confirmation, the assumption about the nature of my dispute, and the extended inconvenience caused by the need for repeated communication. I kindly request the Consumer Financial Protection Bureau to investigate this matter and take appropriate action to ensure compliance with U.S. Code and the FCRA.
