Consumer Complaint: I pay my rent from Capital One 360 account each month, I do a transfer from my XXXX XXXX to the Texas Capital One account. On XX/XX/XXXX I transfer {$1100.00} from my bank in California to Capital One. The bank note said the funds would transfer on XX/XX/XXXX. On XX/XX/XXXX the funds were not there, so on XX/XX/XXXX I did a second transfer, that said it would be there XX/XX/XXXX. In the meantime my rent check came out of the Capital one account ( {$1100.00} ) and I transferred {$990.00} dollars from Capital One back to my XXXX XXXX which was now saying it was overdrawn. Couple of days later on around XX/XX/XXXX Capital one said I was overdrawn, and put a hold on my account. I called the bank and the bank said that I needed to pay the {$990.00} back and then they would make a decision as to whether I would keep my account and Im like why wouldnt I keep my account if Im paying the money back, Im not trying to steal any money and they said well. This is the first time that this is ever happened on your account so the bank decision would probably be in your favor, well on XX/XX/XXXX. I paid the money back on Friday XX/XX/XXXX took some time for post on Capital One 360 account-one being that Monday was a holiday XXXX XXXX XXXX and now I called Capital one 360 today XX/XX/XXXX because it still saying that my account is on hold and they tell me that they closed my bank account!!

Consumer Complaint: According to the Fair Credit Reporting Act 15 USC1681 section 602 a states " There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' XXXX, XXXX, and XXXX are consumer reporting agencies and I am the Consumer. I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states '' It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' XXXX XXXX XXXX XXXX XXXX XXXX and Capital One information to credit agencies ) is a financial institution by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' ( XXXX XXXX XXXX XXXX XXXX, and Capital One to credit agencies ) the financial institution and the Consumer reporting agencies XXXX and XXXX, and XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX, XXXX, ( Furnisher of information to credit agencies ) whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' ( Furnisher of information to credit agencies ) Never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. XXXX and XXXX are not maintaining reasonable procedures. Also 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. '' I am opting out of your reporting services. 15 U.S. Code 6805 - Enforcement ( a ) In general Subject to subtitle B of the Consumer Financial Protection Act of 2010 [ 12 U.S.C. 5511et seq. ], this subchapter and the regulations prescribed thereunder shall be enforced by the Bureau o f Consumer Financial Protection, the Federal functional regulators, the State insurance authorities, and the Federal Trade Commission with respect to financial institutions and other persons subject to their jurisdiction under applicable law. There are also multiple violations of the Privacy Act of 1974.

It was a fraudulent transaction. My account statement shows that an automatic wire transfer was made from my bank account ( Capital One ) to XXXX XXXX XXXX Bank However, this transaction was unauthorized. My bank should have fraud detection systems in place to monitor and flag suspicious activities in my account, to prevent unauthorized transactions.

Also, in conformity with the FCRA customers have the right to make sure their nonpublic personal information is not shared according to title 15 USC 6801 which states " It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' CAPITAL ONE, XXXX XXXX XXXX XXXX XXXX XXXX XXXX are financial institutions according to that title and will be referred to as such hereinafter. Title 15 USC 1681b ( a ) ( 2 ) states In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. All forms of consent to XXXX, XXXX, XXXX, and the financial institutions whether it be verbal, non-verbal, written, implied or otherwise is revoked. Title 15 USC 6802 ( b ) ( c ) states A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. XXXX, XXXX, and XXXX are nonaffiliated third parties. None of the financial institutions informed consumer the right or how to exercise my nondisclosure option before my nonpublic personal information was disclosed. Furthermore, title 15 USC 1681C ( a ) ( 5 ) states Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information : Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. The account ( s ) with these financial institutions are adverse items that they are reporting without my permission. Title 15 USC 1681s-2 ( A ) ( 1 ) A states A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate ''. Consequently, 12 CFR 1016.7 states A consumer may exercise the right to opt out at any time. I am opting out. Effective Immediately. See attached copies of my consumer report.
