In accordance with the Fair Credit Reporting Act this creditor has violated rights under 15USC 1681a2Ai states I have the right to privacy. Under 15 USCS 1666b a creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose unless the creditor has adopted reasonable procedures designed to ensure that each periodic statement including the information required by 1637 ( b ) of this title is mailed or delivered to the consumer not later than 21 days before the payment due date. Ive recently requested verification of inaccurate accounts reporting on my credit report and received a response stating the account was verified and unable to remove accounts. I am formally requesting a description of the procedure your bureau used in providing all information to the original creditor in processing my dispute under FCRA 611 ( a ) ( 7 ). To be clear, per FCRA 611 ( a ) ( 2 ) ( b ), your agency is requirea to forward all relevant information to the original creditor to ensure a proper investigation of my dispute. I am requesting you provide me ALL information used for your investigation, as required by FCRA 611 ( a ) ( 7 ). Per the FCRA you are required to provide this information within 15 days or delete the negative items from my report. Also, for a lender to CHARGE OFF any debt the lender that cancels or forgives a debt must send Form 1099-C to the IRS and the borrower. If I receive a 1099-C, I may have to report the amount shown as taxable income on your income tax return. I applied for quick silver an was approved had finally got my score up high enough to do so. Open the account on the XXXX of XXXX they closed it on the XXXX of XXXX. I have not even received the card till XXXX XXXX. An on XXXX XXXX got a letter that I have not followed rules with a platinum card that I never had. They said a gym membership had been bought an online streaming purchase I have not had platinum card with them so I called. A specialist said that the platinum card had been ruled fraud. So then they try an say I was authorized user on a platinum card back in XXXX I was not but the thing is they said charges was to a platinum card that was ruled fraud. I had nothing to do with either of these issues oh ya the card holder from XXXX was desist. They then reported this to credit berous an I lost 30 points off my score it took me 6 years to get my score above 650 it was 679 when they did this I did nothing wrong I had no perpitacition in either issue an they won't fix it they said oh I'm sorry there's nothing I can do to help you. I can not believe this bull it. Is everybody in America out trying to scam someone please help me this destoried my credit my business my life I did nothing to deserve this I'm I innocent of these charges thank you XXXX.

Consumer Complaint: A company named XXXX XXXX hired me for a new position, prior to my start date I had to do a few cases to show I was capable for the job. The last case was to purchase cell phones and mail them to their XXXX XXXX office. I purchased 3 cell phones, 2 cells phones with a charge of {$2000.00}, and 1 cell phone with a charge of {$710.00}. and both were shipped to XXXX XXXX, XXXX XXXX XXXX, XXXX, NJ XXXX. They gave me two accounts that were supposedly their business accounts, one to pay off my credit card and purchase one XXXX, the other to pay the credit card I used to purchase the other 2 phones. About a week before my employment start date I realized all payments that were made by my new business credit account to my Capitol one credit card was reversed, and payments made removed four weeks after paying off the card, but also the company was fake. so I lost my job, but they also stole {$2700.00} plus fees from me Capitol One has done nothing to help me these past 5 years. I was clearly a victim of Identity Theft and fraud, which occurred on XX/XX/2018, and was reported to XXXX XXXX XXXX POLICE DEPARTMENT : on XX/XX/18, REPORT NUMBER : XXXX. Capitol One reach back and said they couldn't find the receipts/charges. Hello! Because it's a fraudulent account!!!!

Consumer Complaint: On XX/XX/XXXX I called CapitalOne Customer Service regarding the promised reward on their XXXXXXXX XXXX XXXX credit card which I had signed up for in XX/XX/XXXX. This was in response to their advertised on the internet offer of a {$200.00} reward if customers spent {$500.00} in the first XXXX months of receiving the card. Between XXXX and XX/XX/XXXX I actually spent {$1700.00} but received no reward as promised in the promotion. The Customer Service employee tried to first say, the reward was not attached to the card. He suggested it was not included and that I may not have qualified for the reward. I responded that the only qualification indicated in the offer was an expenditure of {$500.00} in the first 3 months. I requested to speak to a supervisor and was told they had to submit an internal complaint and that a supervisor would call or e-mail me a response. I requested both media. On XXXX, XXXX, a supervisor called to say there was no rewards with my card. She then attempted to say there were several types of XXXX cards and suggested this card XXXX have been issued as a " Good Credit '' card. While she admitted she had no knowledge regarding my credit, she explained that he later type XXXX card is issued to participants who needed credit. I am XXXX XXXX XXXX and have had credit cards all my life. I expressed my displeasure feeling I was a victim of " XXXX XXXX XXXX ''. In fact, when I XXXX XXXX XXXX XXXX card online, XXXX had several customer complaints regarding this very card. I ask CapitalOne to " say what you will do and do what you say ''. This rewards promise has not been kept to many of us in the public who responded to this offer. I desire that CapitalOne be held accountable for, in my opinion, a false promise. When there no " disclaimers '' to the contrary a business must fulfill their promise to the public.

Consumer Complaint: On XX/XX/XXXX, I mailed a billing error notice to Capital One Auto Finance. I called Capital One customer Service to put them on notice. Capital One does not allow verbal communication with their legal or disputes department. This complaint serves as record of the notice sent, stating the following : Description of Problem : Hello, I received a bill for {$3000.00} on XX/XX/XXXX. I believe this to be an error based on the following. XXXX ) This note/bill is a debt security. The debt security was issued as a bearer bond with an interest coupon attached. According to the Capital One XXXX XXXX, in the description of debt securities,. the debt securities will be our direct, unsecured obligations. Whereas, this bill is a bond security, with the bottom being a coupon. As such, the sum {$3000.00} is in fact a credit and an interest payment due and payable to me. In the attached letter, you, Capital One, requested me, XXXX XXXX, to pay you this amount thus resulting in securities fraud. XXXX ) This bill and previous communication indicate there is an open consumer credit contract. As such, XXXX CFR XXXX applies to this transaction and defines a consumer credit contract as ( i ) Consumer credit contract. Any instrument which evidences or embodies a debt arising from a Purchase Money Loan transaction or a financed sale as defined in paragraphs ( d ) and ( e ) of this section. This provides proof that the consumer credit contract in place is evidence of a purchase money loan, in which case, according to 16 CFR 433.1 ( d ), Purchase money loan, I was supposed to receive a cash advance, and Capital One was supposed to receive a service fee. As such, I am claiming my rights to the cash advance that I never received at the beginning of this contract. Additionally, according to 15 USC 1666d, whenever a credit balance in excess of {$1.00} is created in connection with a consumer credit transaction through. Since capital one decided to discontinue business, fair business practice would be to have contacted me first so i can make arrangements to transfer my funds. this my hard earned money i worked for. what right do they have to put me in financial hardship. i feel like my money was stolen because im not getting an answer on where my money is. i have absolutely no access to any of my funds. capital one has placed me in financial hardship i have financial responsibilities ( i.e, car payment, rent, utility bills etc. that are due now ). i was told that my XXXX is being mailed to me through regular standard mail and and i can expect my check within XXXX to XXXX business days. i have not gotten any feedback on the status on the status of my funds in my checking account. my check can be stolen easily in regular standard mail capital one clearly has no regard for this matter my XXXX check they allegedly mailed. i asked why would they not send my check overnight mail i was told by the phone rep thats how they mail checks out. On XX/XX/XXXX i went to the capital one branch located at XXXX XXXX XXXXXXXX XXXX, ny XXXX at approximately XXXX. I spoke with the branch manger XXXX to discuss writing me a check for my funds the branch manager stated she can not help me or give me any of my money. i have no cash. The actions of capital one has been detrimental to my mental health. I cant sleep i have high XXXX, deeply XXXX, and extremely frustrated. This is my life savings i worked for and earned rightfully capital one has no right to instill their own form of discipline over a verbal dispute to this extent. If they decided they didt want to do business with they should have contacted me and set up a way for me to get my money from one of their local branches this was done unfairly and there needs to be accountability on capital one. these actions are unprofessional and in my opinion whomever made such decision did this to hurt me and to be spiteful this is just pure evil i seeking justice on this matter through civil action against capital one. im not letting this go!!
