Consumer Complaint: My cell phone had been taken in the early morning hours or XX/XX/2023. Later that same morning my brother came by to let me know he had sent a transfer to me via XXXX XXXX. I dont have an extensive history in using XXXX XXXX but my brother had helped me set it up and I knew I would receive the payments into my Capital One account automatically. Upon his leaving I began getting ready to head to work when I noticed my phone and wallet were missing. I went in to work a bit stressed at having neither of the items. I get to work and log into the Capital one site, only to see that what should have been a balance of {$1300.00} had in the course of a couple hours was showing a balance of NEGATIVE {$3600.00}! I got light headed and dig deeper into the transactions. I those couple of hours the person who had possession and control of my device had XXXX {$190.00} transactions to XXXX XXXX and XXXX {$190.00} transactions to XXXX XXXX, then processed to shuffle the money through various Third Party XXXX apps. In XXXX case even using my stolen identification to open accounts in my name to shuffle this money back and forth to create one of the most confusing digital trails Id ever seen. Lin a few instances even moving money back into my Capital One account then back out and even used the mobile app to pay my Capital One Credit card bill. At no time did internal bank controls block these transactions or notify me. Capital One should make me while under the EFTA as I was defrauded. They will not. Please help as I am only 1 person bs large bank who think they do t have to follow the law. I am in dire financial straits as they not only want ME to bet this overdraft but have reversed LEGITIMATE transactions I made and never one of this aforementioned {$190.00} FRAUDULENT charges. This has made me have to not only repay merchants but also late fees and return payment fees. I followed Capital Ones dispute process only to have them deny my claim and provide me with a 1/2 page PDF document saying they were denying the claim. I sit here tonite awaiting the reply to the rebuttal I had made to the first dispute. I must tell you that my hopes are not high. They dont want to admit that their internal controls failed me. And that they failed me. Please help me in forcing their hand into doing what is just and fair.

I have contacted capital one the last 2 years concerning this because this is not right. Nothing has been done. Consumer Complaint: On XX/XX/XXXX, my late husband and I opened a Renters Security Deposit Interest Bearing Saving Account i.e. Landlord Tenant Security Account in XXXX XXXX XXXX [ now Capital One Bank since XXXX ] and deposited our tenants security deposit of {$1400.00}, as required by law. XXXX XXXX XXXX utilized a savings FBO [ For The Benefit Of ] account, in which the account has the tenants name, the landlord has exclusive access to the bank account and the bank is a neutral entity. We had done this previously with XXXX for our prior tenant. In XXXX of XXXX I was informed by Capital One that I would no longer be receiving statements as there was no activity other than interest on this account. On or about XX/XX/XXXX I went into the XXXX XXXX as a Customer Service representative informed me that this account was not in my profile. Sometime between XX/XX/XXXX and XX/XX/XXXX, during Capital One 's Conversion to Capital One 360, our names and address were deleted from this account along with the FBO, the address changed to the tenant 's address and the account was placed in his profile. Despite all of the bank documents and statements I provided them with, they deny their error and state that the money belongs to the tenant. Capital One Bank did not, does not have the authority to do that. Additionally, I provided them with a copy of NYS law supporting all of which I outlined in regard to the FBO. I have requested they reverse the error their back office created during their conversion, they have refused.

Consumer Complaint: I signed up for a new Capital One 360 Checking Account - the account was offering a bonus if you made two direct deposits of {$250.00} or more. I made two direct deposits from the exact same brokerage account - yet Capital One told me one of the deposits was ineligible. I called up to ask for an explanation and they were unable to provide one except that their app may have caused the problem. Capital One sent me an offer - I signed up - then they didn't fulfill their terms. This is fraudulent activity.

Consumer Complaint: On XX/XX/2023, I received a notice alert on my ID Theft Protection account about a new Kohl 's card account opened under my name on XXXX XXXX. I also received a letter from Kohl 's confirming the said account and congratulating me for approval. I never applied for any Kohl 's card, never had XXXX and I rarely go to the said store. Luckily the card hasn't been used. I reported the said fraud to Kohl 's and I was told they'll close the account. I also called my ID theft Protection ( provided by XXXX card ) to report and put fraud alert on my name. I did same through XXXX credit bureaus. I also froze my credit report. There should have been an extended XXXX fraud alert on my name from last year 's incident bec same thing happened to me but XXXX denied receiving the police report. If the extended fraud monitoring was placed on my name, I believe this should have been prevented.

Consumer Complaint: Capital one Auto Loan I have been a loyal customer of capital one and I lost my job during the pandemic of 2021 and went through a financial hardship. I accrued some late payments due to this situation. These late payments are damaging my credit report. According to consumer Law U.S. 1681A it is illegal to report late payments on my credit report which hinders my credit worthiness. I am unable to get approved for new line of credit and a mortgage loan due to these delinquencies.
