Consumer Complaint: Comenity Capital Bank, part of Bread Financial, creates late fees by setting an arbitrary cut-off time to submit payments on your due date. The self-imposed time of XXXX XXXX is there for no reason other than to generate revenue for Comenity Capital Bank . At this point, my debt with them should have almost been paid off if it wasn't for this practice. I have never, NEVER, been late more than a day and that is only because of this arbitrary cut-off time, they have created. I have tried many times to work this out with them. They stonewall me at every turn, They claim the cut-off time is so they can take payments out the same day ... that has never happened. They take it out almost a week later in some cases the payment date. ( will attach proof, payment made on XXXX taken out on the XXXX ) In most places, the quickest turnaround time for payments between banks is XXXX day. With the way payments are made through FTP servers and text documents, Their argument that they have set a time limit of XXXX XXXX to make sure they get paid the same day is laughable. They have caused multiple late fees while I still have XXXX hours left on the due date to inflate their profits. For the record, they have made their money back almost in full at this point if not completely. They aren't out any money, there is no risk on their part.

Consumer Complaint: I applied for a card during my checkout process at Victoria 's Secret. I was told there was a problem with my application but the cashier didn't know what the problem was. So I paid cash for my purchase. I received a letter in the mail stating that XXXX XXXX needed more information from me. I shredded the letter because I no longer wanted to receive credit with this creditor. I never received a card because I didn't comply by giving them the information requested. Then I started getting collection calls and turned into collections for a card I was never approved for and never received. I don't owe this debt or else I'd pay it!

Consumer Complaint: I've noticed you have been reporting my information to the 3rd party credit bureaus which are on my credit report XXXX and I never gave you Consent to do so which is in violation, also you can not disclose my information unless you have given me an explanation on a non disclosure option to opt out which you have not done, according to The Federal Trade Commission. 15 U.S. Code 6801- Protection of nonpublic personal information a ) Privacy obligation policy It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' XXXX XXXX XXXX XXXX Comenity BankXXXX XXXX XXXX XXXX information to credit agencies ) is a financial institution by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' ( XXXX XXXX XXXX Comenity Bank, XXXX XXXX XXXX to credit agencies ) the financial institution and the Consumer reporting agencies XXXX and XXXX, and XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX, XXXX, ( Furnisher of information to credit agencies ) whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' ( Furnisher of information to credit agencies ) Never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. XXXX and XXXX are not maintaining reasonable procedures. Also 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. '' I am opting out of your reporting services. 15 U.S. Code 6805 - Enforcement ( a ) In general Subject to subtitle B of the Consumer Financial Protection Act of 2010 [ 12 U.S.C. 5511et seq. ], this subchapter and the regulations prescribed thereunder shall be enforced by the Bureau o f Consumer Financial Protection, the Federal functional regulators, the State insurance authorities, and the Federal Trade Commission with respect to financial institutions and other persons subject to their jurisdiction under applicable law. There are also multiple violations of the Privacy Act of XXXX.
