Consumer Complaint: On XX/XX/XXXX, a former housemate used my personal information to open up a Big Lots and Express credit card. The bank used is : Comenity Bank, XXXX XXXX XXXX, XXXX, OH. The former housemate charged {$990.00} to the express card and had items shipped to my former address at XXXX XXXX XXXX, XXXX XXXX, VA XXXX. I last resided at that address in XXXX of XXXX. Since XXXX, I have resided at XXXXXXXX XXXX XXXXXXXX XXXX, XXXX, VA XXXX. On XX/XX/XXXX I looked at my credit report and noticed my credit score had dropped XXXX XXXX so I looked at my recent activity. It's highly likely one of my former housemates used mail to find my social security number and birthday in order to fraudulently open the account. I have filed a police report and reported the fraud to Comenity Bank.

Consumer Complaint: Dear Consumer Financial Protection Bureau, I am writing to request the removal of a charge off from my credit report. The negative marks are having a significant impact on my credit score and decreasing my chances of being approved for loans, credit cards, and other financial products. The charge off occurred due to a recent change in my living situation. Starting in XX/XX/2022, I was homeless for three months and was unable to make payments on my account. As per UCC 2-725, this situation falls under the category of " impracticability of performance '' as my ability to fulfill my financial obligations was hindered by circumstances beyond my control. I understand that charge offs can remain on a credit report for up to seven years, but I am hoping that the circumstances surrounding my situation can be taken into consideration. I have since secured stable housing and am working to rebuild my financial stability. I mailed this company a letter asking for them to remove the late payment and I received a letter back stating we are unable to make any adjustments to your payment history as requested In accordance with the fair credit Reporting act XXXX Account # XXXX, has violated my rights. 15 USC 1681 Section 602 States I have the right to privacy. 15 USC 1681 Section 604 A Section 2 : It also states a consumer reporting agency can not furnish a account without my written instructions. 15 USC 1666B : A creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose.
