Issue: Getting a credit card

Subissue: Card opened as result of identity theft or fraud

Consumer Complaint: I have been made aware that Bank of America continues to violate my consumer rights excessively! I have had multiple encounters with Bank of America and now request that they send me my public and private accounting records, along with all other account records, in accordance with GAAP. Billing statements and letters are not considered documentary evidence and are deemed fraudulent documentation! I did not give my consent or authorize them to furnish my nonpublic personal information! This behavior constitutes dead-right fraud and violates consumer protection laws. Bank of America has ten days to send me all documentary evidence, including my public and private accounting records, or I will submit a whistleblower form to the IRS for tax fraud. In addition, the continuous CALLS, EMAILS ETC constitutes HARASSMENT AND ABUSE, which is also a violation of the law. Per the FDCPA, it is a {$1000.00} fee per violation! Attached are whistleblower forms for your review, and I am keeping all documentation and evidence to build my case for litigation. This behavior may be considered racketeering, which carries a XXXX prison sentence. Please do not send any more statements or letters ; instead, send me my private and public accounting records or block, remove, and delete my account. Account Number : XXXX

Issue: Closing an account

Subissue: Can't close your account

Consumer Complaint: I have an issue with a check I was issued from XXXXXXXX XXXX I cashed this check on XX/XX/XXXX and it was destroyed shortly after, it seems to somehow have been presented again at another bank ( XXXX XXXX XXXX ) which I do not have an account with. I got this information about XXXX XXXX XXXX and the check images from XXXX XXXX who works at XXXX XXXX and helped me to initiate the fraud claim ( XXXX / XXXX ) due to the check looking like it was altered and should have never been accepted by XXXX in the first place. From here the case was handed over to the office of the Chairman ( XXXX XXXX/ XXXX XXXX ) who has apparently been working on ACH Claim / Adjustments Claim ( XXXX ). Today I was contacted by BoA Risk Closure Dept. They told me that `XXXXXXXX XXXXXXXX from XXXX XXXXXXXX was in contact with them and provided me with your phone number ( XXXX XXXX XXXX ), they said you contacted them and directed them to pay XXXX XXXX in reference to my deposit... They were not able to provide much more details other than XXXX initiated some type of claim against my account and that XXXX XXXX contacted them ( BoA ) to verify XXXX was indeed the intended recipient... This has to be some type of mistake because I do not have a XXXXXXXX XXXX Account and I do not know who XXXX XXXX is nor have I ever endorsed ANY check to him ever. I am writing to you all to inquire about that contact with BoA as well as what XXXXXXXX XXXX is doing for me in reference to this issue. I was further advised by the police to contact the CFBP and FTC as well as I3C, I have done that and when I informed them they told me at this time if the issue is still not resolved to seek legal advice or sue the banks in Civil Court... I contacted XXXX XXXX, he advised he would help me sue the banks involved if I needed to recover the money but he is going to have to charge to represent and file the suit and things are starting to get exceedingly complex in a short amount of time. To be completely transparent I don't need anymore debt than I have incurred already as a result of this incident and I am already losing my mind, please help me get to the bottom of what exactly is going on here, if my account is not made whole at BoA by XX/XX/XXXX they will close my account there and begin charging interest which will bankrupt me. I have already refinanced my house in an attempt to stay whole however XXXX did not adjust my HELOC and as a result you were paid XXXX on XX/XX/XXXX and the account was closed rendering me in a position where I can not make myself whole again while this process remains unresolved. I will have no option but to undo the refinance which will re-open the HELOC to which I have less than 30 days to do so and then to declare bankruptcy and file suit. Please help me to avoid all of this legal process and make myself whole again otherwise I don't know what other choice I will have but to request the further assistance of XXXX XXXX. I am willing to accept any temporary resolution possible such as a personal loan / line of credit / re-opening of my heloc, at the end I would hope you would do a reissue of the check or work with BoA to recover the funds from XXXX since they are the bank of Fraudulent Deposit in this matter NOT Bank of America. Thank you for your help and I look forward to hearing from you soon.

Issue: Opening an account

Subissue: Account opened as a result of fraud

Consumer Complaint: On XX/XX/2023 I received and email that a checking account was opened in my name with Bank of America. I have already had a checking and savings account with them for over a decade, and had no knowledge of this account. I contact bank of america and at first they advised there was no such account, after further investigation, they agreed their was an account opened in my name. They shut it down and advised me my identity was compromised. I am concerned that they did not do their due diligence when allowing someone to open an additional account in my name, they did not notify of me of the application, they did not require a copy of my DL and or any other due diligence. I only found out because I received an email with an account approval

Issue: Managing an account

Subissue: Banking errors

Consumer Complaint: I have been a customer of Bank of America for 35 years and recently was a victim of XXXX XXXX on XX/XX/2023. I received a fraudulent bank check for {$1700.00} for an item I was selling and called BOA customer service and was informed the check had " cleared ''. I acted on this information and sent the money via XXXX to a " fraudulent actor '' only to learn that the bank check was counterfeit and BOA removed the {$1700.00} from my account. After a 4 month investigation, BOA informed me that I received " misinformation '' from their customer service and that they provided the customer service representative the necessary education to ensure " this will not happen again. '' They refused to reimburse me for their customer service error. BOA has already brought this case to their " lawyers '' attention and I have brought this to the attention of the president of BOA ( XXXX XXXX ). Customers of BOA need to know they have no concern for their customers when they are victims of fraud even when they are partly to blame.

Issue: Problem with a purchase shown on your statement

Subissue: Credit card company isn't resolving a dispute about a purchase on your statement

Consumer Complaint: I have been trying to get my credited amount of XXXX dollars on my account since XXXX of XXXX to no avail. Purchase made in XXXX of XXXX in the amount of XXXX to a credit card from Bank of America. Total balance was paid off in XXXX of XXXX. I was notified in XXXX that this was a fraudulent transaction and began the process of reporting this to B of A and to get it resolved. Received a letter on XX/XX/XXXX to let me know B of A was working on my request and to send any information that I had to support my case. That information was sent. Next letter came on XX/XX/XXXX that they needed my signature to continue. Signed on XX/XX/XXXX and sent back to them. Next letter received on XX/XX/XXXX that they were working on the claim. Next letter received on XX/XX/XXXX they were going to temporarily credit my account in the amount of XXXX dollars. Which they did but this went into a new account number. Next letter dated XX/XX/XXXX said " the pending transactions I reported as suspicious never posted to my account. '' Which it had as by the enclosed statement from XXXX XXXX XXXX XXXX and was paid off. Therefore they consider my account resolved. This now shows a XXXX dollar credit in my new account and has every statement since to date. I started calling customer service in the beginning of XX/XX/XXXX to get this money refunded to me. Told they would send but would take 10 to 21 days to receive. Called again on XX/XX/XXXX since I did not receive it. Again I was told the same thing. Called XX/XX/XXXX then the beginning of XXXX and spoke to XXXX and then to XXXX. At the end of XXXX I spoke to XXXX. On XX/XX/XXXX I spoke to XXXX after a few minutes I asked to speak to a manager who I was told was a XXXX XXXX. I only got relayed messages from her through XXXX. She did not allow me to speak directly to XXXX. Was told by all they would send me a check but would take 10 to 21 days. I am now reporting this incident to you to see if I can get this resolved.
