Consumer Complaint: I was a victim of identity theft. Bank of America opened a checking account in my name, that someone else initiated and linked it to my active credit card. This account used a fraudulent wire transfer to send the initial deposit and added their contact information to my online banking and alerts. Upon discovering this I contacted BOA to report identity theft. They said they froze the account while it was under investigation, but when I followed up a couple months later, after receiving another checking account statement they said the theft was filed incorrectly and they said they refiled. 7 months later ( and many similar conversations ) and the account is still open, still linked to my real credit card account, and I can not get them to close it or take the email address that is not mine off of my account.

Consumer Complaint: I inadvertently scheduled XXXX full balance payments, XXXX for XX/XX/XXXX, and another for XX/XX/2023 to Bank of America credit card. This resulted in a negative balance on my credit card. Then I received an email from BOA on XX/XX/XXXX to ask if Id made a mistake and to call if I had, I called the number emailed to me. This was the first of XXXX phone calls over the course of the next week. XXXX payment was given back to my checking account however BOA also added/applied this ACH refund back to my credit card balance as well. I called my bank, XXXX XXXX Bank, XXXX, and asked if XXXX of my payments went through. They confirmed XXXX payment of {$1400.00} was paid and therefore resulted in an XXXX charge against my checking. My bank forgave this charge and also confirmed that a transfer of {$1400.00} was made and deducted from my account. Bank of America says it was returned unpaid. I went to my bank and they supplied me with a letter of Checks paid against insufficient funds along with my checking account statement that does indeed show that XXXX of my payments was taken from my checking account and paid. I have spoken with many customer service representatives from BOA to ask the to see that my account has XXXX payments but also XXXX charges for {$1400.00}, showing no payment at all. They tell me it was returned unpaid. I have documentation of both the deducted payment from my checking and from my BOA credit card showing no reduction in my balance.

When looking at the other emails it says it got denied due to having the wrong information. I called Bank Of America and gave them my SSN and they see that the account was applied for and did tell me that whoever tried making this account will not be receiving any money from my bank account.

Consumer Complaint: This is my second and last attempt, to see will Bank Of America regulatory complaints division, acknowledged there wrong doings by reporting fraud and identity theft accounts to early warning check system, Bank of America has admitted to there wrong doings of reporting fraud accounts and also allowing the same person or whom ever open 3 accounts with them in my name that any bank or organization that keep sensitive information that can affect a person life and financial ability, to have some type of strict fraud observance or identity fraud acknowledgment. Bank of America allowed a account to be open again after closing an account that had fraud checks and fraud transactions which lead to closing, 2 months later they gave the same person which is my name open another account and fraud draft the account again. I was told these accounts would be removed from my report and i am not held responsible. Months later these accounts still reporting on early warning which cause me to get denied a loan and account from multiple banks, I filed a cfpb report and requested that this be removed immediately due to promise to remove items in 15 days, which lead to 60 days and counting, I spoke with XXXX XXXX, with the Bank of America resolution division and was told he will investigate and get back with me within 3 days after I provided him with uploaded documents of proof that I was already granted the removal, XXXX XXXX has sent me more proof that Bank of America allowed someone to have history of check fraud and identity account fraud to open a new account 3 months after closing the first 2 fraud accounts. I have sent my demand letter also and attached it to the complaint and he avoided it, I am in a mental and financial hardship due to Bank of America improper use of reporting my information and improper account management. I also noted the violation of which theyve committed. I will also have that attached along with a new demand letter, that I will take this matter to court if its avoided again. It was made clear that I was the victim of fraud, which resulted in me losing a large amount of my hard earned savings in the amount of XXXXXXXX XXXX The main reason I continue to insist on due process in my case is because I understand that Bank of America has not and is not taking adequate steps to protect its customers from financial loss and to recover their losses. The only thing they do in fraud cases is to deliberately exploit a gap in current regulations in order not to admit their mistakes and negligence, which cost their customers a lot of money.
