Consumer Complaint: New account with Bank of America, never received bank card and they are refusing to investigate and resolve fraudulent transactions on an apparently stolen card. This includes fraudulent withdrawals from branch offices. They've put hold on SOCIAL SECURITY funds, left me homeless. No help in my branch office or over phone although they said they escalated this. Haven't even had account for 2 months and they are rude thieves!

Consumer Complaint: I was contacted by XXXX XXXX via voicemail. The voicemail stated that I had an open summons to court in the county in which I currently reside, however, after further investigation, I was not residing in the state when I opened the supposed credit card. I contacted the 'debt collector ', XXXX XXXX XXXX XXXX and was told that I had a debt from XXXX that was still outstanding. The debt was to Bank of America which had a {$3500.00} debt. Several details sounded suspect to me - 1. the debt was from XXXX, I had paid on the debt until XXXX and then suddenly stopped. 2. If I had a debt long, I would have likely paid off that balance in much less than nine years. 3. This was already over the statute of Limitations for both the state of XXXX XXXX, where I had supposedly opened the debt and XXXX, where I currently reside. 4. I never opened a Bank of America credit card - ever. After brining these details up to the representative, XXXX, I was told that he could not provide any documentation of the details until I paid the debt. I asked questions as I thought it was fraud. He did provide verbal details about my current open lines of credit to which I could use to pay him. He claimed to have current signatures from student loan documents that he could compare to promissory note from the Bank of America credit card. I wanted to take a few days to look into the details and examine my finances to figure how I was going to pay the debt. I was persuaded to pay the debt while on the current phone call or I would be taken to court and charged for the debt and all fees associated with the case to an amount upwards of {$13000.00}. I did give XXXX, XXXX my credit card number to charge the agreed upon amount of {$2900.00}. A few days later, I received the 'contracts ' that required my signature which also had the Bank of America credit card number on it. I immediately called Bank of America for information on this. I was told by several different departments that I had no footprint within Bank of America and the credit card number provided had never been issued- it was a made up number. After receiving this information, I immediately filed a chargeback with my credit card company. They have been denying my claim ever since XX/XX/XXXX. I need proof of cancelation of the policy which I never had. I was also told to contact the 'merchant ' and request a refund. I reluctantly called XXXX back and was berated, yelled at and hung up on subsequently denying me a refund. XXXX with XXXX, XXXX also told me that I would pay what I deserved and they would get their money. His attorney 's were ready and prepared to take me to court. I'm under the impression that because this XXXX XXXX has a work-up on my financial background and current history, it looks like they have supporting evidence that I owe this debt. This is what my credit card, XXXX XXXX, is going off of. I have provided a clean credit report and verbal contact with Bank of America, to no avail. XXXX, XXXX is good at what they do, scamming. Do your research, don't rush and don't give money to anyone without proof.

This is incorrect as there were no other charges on the account, only the fraudulent charge.

Issue: Managing an account
Subissue: Problem accessing account
Consumer Complaint: Since XXXX I have been the legal and medical POA for my mom, who is suffering from XXXX XXXXXXXX. She has an account at Bank of America which her 2 pensions are electronically deposited into. In XXXX I drove one hour to the BOA XXXX XXXX, IL branch, which is the nearest branch to my home. I had a copy of the POA and my valid DL and other identification info. I was turned away because the POA was not original, it didn't have 'wet ink '. Since that time, I managed my mothers BOA account online until XX/XX/XXXX when I made another effort to have the POA accepted at BOA. I drove again to the same XXXX XXXX XXXX ( the branches do not answer the phone, the only way I've been able to make contact is through booking in person online appointments. ) only to be told I needed either a " wet ink '' copy or 'certified copy '. I asked if they would call my attorney ( who was also my mother 's attorney ), who had prepared my mom 's POA document and the branch manager refused. I called my attorney and he had never heard of such a request and said they legally had to honor the POA, regardless he prepared a letter of authenticity, he signed it and had it notarized. I drove 1/2 hour to XXXX to pick it up and 2 days later I drove back to the BOA XXXX XXXX office and presented to the same branch manager. He stated this is what they were looking for and had me take a seat while he forwarded to legal. After waiting an hour ( literally ) I was told 'legal ' was still not accepting it and they would not give me access to the account. I asked for a number for myself or my attorney to call to try rectify the issue, but the manager said he couldn't give me any more information. BOA has since blocked all online access to my mom 's account, so I/mother no longer has access to her funds. My attorney has stated I should do everything possible before initiating legal action. On XX/XX/XXXX I was appointed 'legal guardian ' of my mother by the XXXX XXXX XXXX XXXX XXXX XXXX . To top it off, on XX/XX/XXXX I received a call from XXXX XXXXXXXX XXXX who was investigating a complaint of alleged adult financial abuse. After several questions about transactions only from my mothers BOA account it became clear the complaint was filed by BOA. The questions included why did I spend my mothers money at a pet store, my answer was to purchase dog food for her XXXX XXXX XXXX that has lived with me now for more than a year. After several other questions, and the XXXX agent patiently listening to my frustrations with BOA, I believe the case/complaint is resolved with no wrong-doing on my part. I filed for legal guardianship of my mother, which I received in XXXX of XXXX ( I have attached a copy for your record. ) I still do not have access to my mother 's funds ... which she needs!

Consumer Complaint: On or about XX/XX/2022 I filed CFPB Complaint # XXXX. I received the attached email on XX/XX/2022 from a resolution specialist at Bank of America 's Regulatory Complaints Department, asking to confirm I am the party who filed the CFPB complaint. I confirmed filing the CFPB complaint and requested copies of the evidence the bank has regarding the fraudulent transaction and I never received such evidence from the bank. The bank has now re-opened the dispute and I am again requesting the evidence in the bank 's posession be sent to me so I can examine it and be afforded due process rights to challenge said evidence. In the interim, I have paid the full disputed balance and I am requesting the {$220.00} in accumulated interest charges be waived since the bank has re-opened the dispute.

Consumer Complaint: Hi, I am currently on unemployment. I received my benefit for 2 weeks yesterday. Somehow someone up in XXXX XXXX withdrew {$760.00} from my EDD card at an ATM, which means there is a duplicate card. I made the report and they are doing an investigation, however the {$760.00} that was stolen will not be replaced for 45-90 days. My rent is due XX/XX/XXXX, as I tried to explain. Bank of America said there was nothing they can do. I am trying to secure a loan to pay for my room, but there is a good chance I will be homeless, through no fault of my own, because EDD and Bank of America have been compromised. It dose make a lot of sense to me why they cant do direct deposit is beyond me, it would have ensured this problem and a {$760.00} loss would have never occurred. If there is anything you can do to help expedite the replacement of my unemployment benefit it would be greatly appreciated. Best Regards. The date of the withdrawal was XXXX
