Consumer Complaint: To Whom it May Concern, I opened a Bank of America credit card account XXXX on XX/XX/XXXX. In XX/XX/XXXX, Bank of America sent me the attached letter and description of Amendments to my Credit Card agreement, including an increase to the annual percentage rate. Upon reviewing the information, I found that I had the ability to reject the amendment terms by following the instructions provided. Subsequently, I called Bank of America to notify them of my rejection of amended terms. I confirmed that my rate of XXXX would be locked in if I discontinued use of the credit card. I received the attached letter dated XX/XX/XXXX, confirming acceptance of my rejection. Since that time, until XXXX of XXXX only account activity was payments. I complied with all the terms and conditions set forth in the correspondence sent by Bank of America and was never late making monthly payments. In XX/XX/XXXX, I noticed an increase to my monthly minimum payment due. I contacted Bank of America and was told the higher minimum payment amount was due to an annual percentage rate increase to my account. I mentioned the letter from XXXX, but the Bank of America representative said they have no record of it. My remaining balance was paid as follows : {$13000.00} was paid on XX/XX/XXXX Residual interest of {$46.00} was paid on XX/XX/XXXX I recently found the letters from XX/XX/XXXX and called Bank of America. The customer service representative advised me to bring the letters to my local Bank of America branch in XXXX, CT. The bank representative used an internal service number and opened service case # XXXX. To date, I have not received any communication from Bank of America regarding this matter. On XX/XX/XXXX, I again called Bank of America. I was told that account records and statements older than 7 years are archived, however, the representative could not retrieve them. I asked who could retrieve them and was put on hold. The line then disconnected. I again called Bank of America on XX/XX/XXXX to get specific detail on the annual percentage rate increase history of my account. This is not a complete list due to ageing of statements, archiving and the BOA representative potentially missing dates as she reviewed my account information. XXXX XXXX- XXXX variable XXXX XXXX- XXXX variable XXXX XXXX- XXXX XXXX variable XXXX XXXX- XXXX variable XXXX XXXX- XXXX variable XXXX XXXX- XXXX variable XXXX XXXX- XXXX variable XXXX XXXX-XXXX XXXXariable XXXX XXXX- XXXX variable XXXX XXXX- XXXX variable I ask that you pursue this matter with Bank of America on my behalf. Based on the correspondence, it is my belief that they willfully breached my contract with them and overcharged interest since XXXX. I ask that you request copies of all statements since account inception to review and I respectfully request all overpayment refunded to me with interest. I can not help but think other Bank of America customers received this letter as well and took action to reject increase and may have had a similar experience. I appreciate your assistance regarding this matter.

Consumer Complaint: I suffered a total loss on my primary residence due to XXXX XXXX. As a result, I spent all of my savings, took out retirement, and maxed out my credit cards because my insurance company went bankrupt. The banks are refusing to give me a forbearance or any sort of deferment and have reported to the agencies that I do not pay my bills. They have charged off my debt and have significantly destroyed my credit. They are unwilling to work with me. This is not my fault. I have always paid my bills on time and now have to file bankruptcy as a result of a hurricane and the lack of regulation of insurance companies in the state of Florida. I am paying a mortgage on a home that is condemned in addition to a mortgage on a rental property and rent for myself if I can afford it.I have been living in hotels. I have been living in a car XXXX I have a salary of {$11000.00} a year and I'm currently homeless because I make too much money to benefit from federal or state programs. My house is condemned and unsafe and I have been unable to see my child since XXXX. I do not need additional financial hardship as a result of an act of XXXX and the lack of regulation by the government.

Issue: Closing an account
Subissue: Company closed your account
Consumer Complaint: In early XXXX, I attended a protest of the XXXX XXXX ' police training facility in XXXX , GA . I was XXXX along with 22 other concert goers and held in XXXX XXXX XXXX for almost 4 weeks, despite not being formally charged with any crime. Upon returning home I received notices from Bank of America that my checking, savings, and two credit card accounts had been suddenly closed. I was able to transfer my checking and savings accounts to a new bank, but I struggled for several months to obtain a new credit card due to the impact this cancellation has had on my credit score. Upon meeting with my local bank manager ( XXXX XXXX ) on Monday XX/XX/XXXX and calling BofA to seek additional information about why my accounts were closed, I was not given any additional information. The BofA representative I spoken with on the phone maintained that BofA has a right to close accounts at any time without giving a reason. The bank manager I met with in-person reviewed my bank accounts and said that she could not see any evidence of fraudulent activity from my accounts. Given the fact that there is no evident fraudulent activity in my accounts, I have strong reason to believe that these sudden account closures are indeed related to my political and legal situation. I understand that BofA is a financial supporter of the XXXX XXXX ' police training facility, so I am concerned that BofA is using its power as a financial institution to punish protestors and suppress the right of free speech by penalizing customers who speak out against a project it supports financially. Without additional information, I also can not tell whether BofA identified me through public media surrounding this case or through collaboration with police. In the meantime since my in-person meeting with the bank on XX/XX/XXXX, I have contacted my local representatives, who independently reached out to Bank of America . As a result of this exchange, Bank of America issued me a final letter ( addressed by XXXX XXXX ) on XX/XX/XXXX reiterating their decision and refusing to provide additional reasons for the closure of my accounts. I also filed a complaint with the OCC, and received a reply that my complaint does not fall under their jurisdiction. On XX/XX/2023, my savings and checking accounts were closed, and on XX/XX/2023 cashiers checks were mailed to me with remaining balances in those accounts. Similar issues with Bank of America and XXXX XXXX ( both of which are corporate funders of the police facility ) have been documented for at least two other defendants in this case. I am submitting a complaint individually because the sudden and inexplicable account cancellations have negatively impacted my credit, and they seem to be a targeted attempt to inflict financial damage to citizens exercising their right to protest.

Consumer Complaint: In XX/XX/2022, my name and credit card number were stolen. The card itself wasn't stolen. The Bank of America XXXX XXXX XXXX alerted us about possible fraud on XXXX XXXX. I looked at the transactions and there were several XXXX dollars worth of charges that I had not made. Another part of the identity theft/scam was that the thief was sending XXXX XXXX and XXXX XXXX people to pick up packages and take them to XXXX or another mailing service and send the stolen packages to them. We encountered 4 different delivery people including 3 on XXXX XXXX and intercepted 2 or 3 packages. I filed a police report on XXXX XXXX and even called them to the house because one of the XXXX XXXX people wouldn't leave. I talked to Bank of America fraud department several times. They refunded some of the charges we disputed. However, others weren't considered fraud because they were delivered to our house. I was out of town at the end of XXXX when they would have been delivered. I suspect the thief was using XXXX XXXX to pick up and send packages to them similar to what we experienced in XXXX. Some of pending charges were to businesses that I have never patronized. These pending charges are from the same companies that Bank of America has canceled. I don't understand why these are different. I haven't heard from Bank of America since XXXX regarding the claim. Online it says the claim is active, but they haven't updated me. The credit card company has started to charge us late fees and interest on the pending charges that I disputed.

Consumer Complaint: XXXX XXXX charged my account {$6.00} a month for a long time. I go to XXXX XXXX frequently and never noticed. After I finally started seeing a pattern, I called them to find out what the deal was. I had not authorized a monthly charge of any kind. They could not find a reason that I was being charged, but yet still refused to give me a refund. They would not take the charge off of my account and I was forced to change my credit card number. Then I tried to dispute it with Bank of America. They could only go back 1 year. They told me the total they could do was XXXX. This was last XX/XX/2022. They did credit me some of this money, but later charged me for it again. I believe at this point, I have only received XXXX credit. I just called them and still no resolution. After 6 months, I am tired of waiting. They have closed the dispute twice and I had to re-open. I want this resolved as 6 months is more than enough time to get it done. I am hoping you can help

Issue: Trouble during payment process

Consumer Complaint: I am writing to inform you that Bank of America has engaged in retaliation following my filing of complaint XXXX on XX/XX/2023. On Saturday XX/XX/2023 we received an Escrow Analysis letter from Bank of America backdated to XX/XX/2023. We had not received such a letter previously. This letter falsely alleges that our family paid only {$5400.00} of a XXXX tax bill of {$9700.00}. The letter states that there was an underpayment of {$4300.00}. The letter states that due to this underpayment, our monthly mortgage bill will increase by nearly {$400.00} per month. Upon review of our records we show that we actually paid {$9300.00} of the {$9700.00} tax bill through monthly equal escrow payments of approximately {$770.00}. The probable underpayment amount based on this is about {$430.00}. This is nowhere near the underpayment amount of {$4300.00} indicated on the letter we received. Furthermore, the letter includes dollar amounts that Bank of America knows are not part of Escrow ( e.g. Insurance ). Bank of America is using the US Mail to send financial debt information to us that it knows to be false for the apparent purpose of defrauding us. Because of our recent written complaints against bank of America for what we believe are violations of State and Federal predatory lending Settlement agreements ( this was contained in certified letters sent to Bank of America - dated XX/XX/2023, XX/XX/2023 and XX/XX/2023 ), we are now being targeted and retaliated against by a significant and an unjustified increase to the monthly mortgage payment in order to place an additional hardship on our family. In addition, we have attempted to contact the regulatory affairs person identified for the response and resolution to the original complaint ( # XXXX ). We have not received a call back nor have we received any document showing the response submitted to the CFPB from Bank of America. We have not authorized Bank of America to send any communications electronically. We have received nothing in the mail to date. I sent certified letters and a fax to Bank of America authorizing my husband to speak and correspond on these matters. I am enclosing a copy of the letter ( along with envelop showing postmark date ) we received from Bank of America regarding Escrow and a copy of the most recent letter sent authorizing my husband to speak on my behalf. My husband is authorized to speak regarding this matter as well.

Consumer Complaint: Today, XX/XX/2023, my account was closed with no notification and alert. I have all my money in my saving account, and I am an XXXX XXXX with no any pay off. How can I survive in this urban city, with XXXX money in my account. And I still need to pay my rent, my credit card debt. I have been used XXXX XXXX XXXX for my whole XXXX XXXX XXXX XXXX XXXX, which is about 9 years. And I kept perfect credit, and never been have had this happened. It is unfair for consumer to face this situation with no prediction. You can suspect my account, but you should have checked, at least verify with me about the truth of your suspicion. I have to mention that I received NO emails, notifications, alerts about " fraud report ''. I am even open to background check about my statement, that is why I am writing this complaint. Because I can prove all my transaction and they are transparent and clean. They can not take all my money, add on to that, money for survival as an XXXX XXXX, just because they want to lock my account. Also, when I log in to online banking, they even did not show up any words about my account is closed or locked. Even I called the associate, they did not provide any reasons, and said, " rely to the policy, they can close my account with no reason in anytime. ". I would say it works for someone really needs to be checked, but for me, a XXXX XXXX XXXX, and I did not graduated yet from my XXXX XXXX, why would they even suspect my account and close it with no reason. I called for an hour to make this thing process, and being transferred back and force. I really hope you can take this seriously.
