Issue: Managing an account
Subissue: Deposits and withdrawals
Consumer Complaint: On Friday XX/XX/2023 at roughly XXXX XXXX, I deposited a cashier 's check from my account with XXXX XXXX XXXX XXXX to my account with Bank of America in the amount of {$48000.00} which were proceeds from the sell of my condo in Georgia. After the Teller deposited my funds, she then proceeded to show my receipt which placed the majority of my funds ( {$42000.00} ) on HOLD for an additional 5 business days. I asked why and they only said it was what their system provided, and that I could speak to their customer service department for assistance. Seeing that I am considered a PREFERRED customer with over XXXX of loyalty to this bank, I thought this issue would be easily rectified, but it wasn't. After reading their " deposit/hold '' policy online and the Federal Reserve regulations , I believe I was discriminated against and they gave me no real cause or explanation for extended this hold on my funds. Due to their negligence, I missed the opportunity to make a stock purchase which would have paid me dividends as well as missed out on other plans and purchases.

Issue: Managing an account
Subissue: Problem accessing account
Consumer Complaint: On XX/XX/2023 a check in the amount of {$9000.00} was counter deposited to our business checking account with bank of America. Check issuer is XXXX XXXX and the check number was XXXX. At the time the issuer bank suspected the signature and did not clear the funds and the check was returned. The account owner confronted his bank and the apologized and XXXX XXXX issued another check for the same amount which I deposited through bank of America on line banking. A few days later I noticed that my access to my on line banking was restricted and could not see my account or make transactions. After calling Bank of America and going from one department to the other which without exaggeration took XXXX minutes they said the check deposited was a counterfeit ( which was not ). I kept asking if the check was counterfeit the issuing bank would not have cleared the funds but they kept on saying it is being investigated. Another call to them later revealed that they are in the process of closing my business account! and other than the bogus claim of deposited counterfeit check they did not give me any other explanation. When I aske d for my fund in the account they said after the account closing is finalized they will send me a cashier check and now about a month after the awful disaster which put my company 's reputation in question I received a letter saying my account has been closed and the funds before the {$9000.00} deposit is being send to me but the remainder is frozen pending investigation!!! The issuing bank is baffled since they had no problem with the check and released the funds. The check issuer is going crazy since he is out of {$9000.00} and neither him nor us have the funds and Bank of America is none responsive as to when they will release the funds they are XXXX ; XXXX illegally. I still have no clue why they claim the check was counterfeit sinkcethe issuing bank never claimed it to be and released the funds to Bank Of America,

Subissue: Problem using a debit or ATM card
Consumer Complaint: Hello, around early XXXX of this year XXXX there was an unauthorized transaction done for {$810.00} to the merchant XXXX which i did not authorize. I did not know about it until i tried to use my debit card and my transaction was getting declined. Thats when i went and checked my account and seen the unauthorized transaction. I tried to submit a claim via the app which i am not very good at using but eventually a claim was submitted not knowing if i did it correctly or not. Either way i called a few days later to follow up about the claim and was told i needed to fax in a letter explaining the unauthorized transaction so they can move forward with the claim which I submitted right away. Ever since i have not heard anything back and no provisional credit has been given and this has really caused a huge financial burden for me. When i call i get no help or update and just keep getting forwarded to the answering machine. Its almost 2 months now without my money and i feel like bank of America isnt really doing anything to recover my money or at least provide me with a temporary solution/credit in the mean time and we are talking about {$810.00}. That was my rent money. Please help in possibly expediting a resolution to this please. I appreciate the help! Thank you!

Issue: Improper use of your report
Subissue: Reporting company used your report improperly
Consumer Complaint: The Fair Credit Reporting Act ( 15 U.S. Code 1681 ) says ( 1 ) The banking system is dependent upon fair and accurate credit reporting. Inaccurate credit reports directly impair the efficiency of the banking system, and unfair credit reporting methods undermine the public confidence which is essential to the continued functioning of the banking system. So whenever there is a violation under the FCRA, it impairs the efficiency of the banking system. This is a violation of my privacy with my consumer report, since I control what is listed and what is not. In the event that any accounts are reported without my written consent, that is considered identity theft. This is a violation of both 15 U.S. Code 1681b ( 2 ) and 15 U.S. Code 1681c-2. This leads way to civil liability against the credit reporting agency for negligent and willful noncompliance under 15 U.S. Code 1681n, which allows for {$1000.00} per violation, for account listed without my expressed written consent.

Issue: Closing an account
Subissue: Company closed your account
Consumer Complaint: To whom it may concern, Hello, I would like to voice my complaints with Bank of America for flagging and closing my business account without any warning or attempt to communicate with me. For context, my family owns a small business dedicated to short-term rentals on the XXXX and XXXX platforms . At the beginning of XXXX, a customer contacted us through the XXXX platform, wanting to book 15 nights in one of the condos we manage. He explained that his company would take care of the payment and that they were sending a certified check by mail. This customer then gave us a tracking number, and on XX/XX/XXXX, we received the USPS package with the check. The check was then deposited via a Bank of America ATM since it was after the bank 's open hours. The next day, on XX/XX/XXXX, we attempted to access our online banking system, but our access was denied. Since this was unusual, we called Bank of America, and a representative informed us that the account had been closed due to an incident of fraud. Furthermore, the Bank of America representative stated that our company would not be able to open any other bank account with Bank of America due to the incident of fraud. I attempted to explain the situation, as this is a very clear case of mail fraud perpetrated against me and my business, but the representative could only respond, saying the account was closed due to the deposit of the fraudulent check and that there was nothing I could do. I asked if there could be a case open where I could explain and submit evidence of what happened, and they told me no. They transferred me from department to department to no avail. All they could say is that there was nothing that could be done. We were the victim of a mail fraud scam, and Bank of America marked our business account with an incident of fraud and outright closed the account without providing any form of help or warning us of the incident.
