Consumer Complaint: On XX/XX/30, Bank of American applied a composite credit of {$5100.00} to my account. This was in three components : {$2100.00} + {$250.00} + {$2400.00}. The {$2100.00} comes from my BofA checking account ending in XXXX. The {$250.00} came from a closed XXXX account and should correctly be charged negatively to my account. I have no complaint about the reversal of the {$250.00} nor about the {$210000.00}, which was correctly credited.. Bank of America deducted the {$2400.00} from my XXXX account. Then they reversed the credit to my HELOC account.. I twice wrote to them through their website and received no response. I then complained to the XXXX. I received a message that they acknowledged the complaint, and beyond that message, no action has been taken.

Issue: Opening an account
Subissue: Account opened as a result of fraud
Consumer Complaint: I called Bank of America back in XXXX 2023, to report I received a bank card that was issued to me the problem was it wasnt my address and I didnt open the account. I explained this to them and their fraud department, they claimed the account was open online and based on the transactions it was definitely opened fraudulently. Today XX/XX/2023, I was given another piece of mail containing a bank statement from Bank of America again my name but wrong address. I called again. I was told there is a case open and its under investigation but they REFUSE to close the account until I provide them with a copy of my ID as well as other personal information such as my social security number, address, etc All the transactions were made out of state and most through an app called XXXX. I dont know how they could open an account online without an ID but wont close it unless I provide them with my personal information ( which if it was an actual account they would already have it ). When I asked to speak to a supervisor at Bank of America I was denied! I have spoke to BOA and there fraud department and I cant seem to get anywhere without giving them personal info. I have no credit cards, loans with them or bank accounts. I just want the account closed its affecting my life!

Consumer Complaint: Inviolation of the Fair Credit Reporting Act, Bank of America refuses to removed a delinquency int he 3 credit reporting agencies. This was fraud during an account takeover. In spite of the fact I reported the fraud when it occurred on XX/XX/XXXX ( 4 credit cards were involved and the credit card fraud dept had no clue about 3 of them until I reported them. ) They were aware ( see screen shot around XX/XX/XXXX as well as previous response from their regulatory complaints dept dept acknowledging these frauds were reported on XX/XX/XXXX. Email is attached proving this was reported. 3 of the credit card fraud cases were settled but the person handling the card now ending in XXXX did absolutely nothing until XX/XX/XXXX - total ineptitude and no fiduciary responsilbility as well as blatant violation of the Fair Credit Reporting Act. To make matters worse, during the account takeover, the thief fraudulently obtained cash advances, transferred the stolen funds into his Bank of America checking account ( I know this because of the attached police investigation report. ) Instead of going after the thief, knowing his name, address, BOA checking account number and computer IP address, that person insisted on holding me responsible. There was also a violation of the Electronic Funds Transfer Act when the bank should have realized this was a fraud- I did receive a call after the fact ) It wasn't until XX/XX/XXXX when I was finally told to file a claim with the checking account fraud dept. I filed the claim on XXXX XXXX, XXXX. It took checking account fraud until XX/XX/XXXX to realize the violation of EFT and they sent me a letter and the funds for the entire fraud amount ( see attached ). I refused to pay the XXXX account balance which with interest and late fees was {$1900.00} since it was a fraudulent cash advance which I reported. Not my fault there was ineptitude in it not being worked until XXXX XXXX, XXXX. The credit card fraud dept was recalcitrant and refuses to close the case. With the funds from the checking account fraud, I paid the fraudulent card off. ( First,, I paid {$230.00} to bring it up to date. I had just hired an attorney and would have sued BOA.How can Bank of America get away with ignoring bank regulations? Last week I sent an email to XXXX XXXX XXXX and XXXX had called me. She was able to have the additional finance charges refunded to me since it was fraud and the total settlement did not cover the subsequent finance charges. She told me she requested the delinquency be removed but couldn't promise. Obviously, in spite of XXXX requesting the delinquency b removed since the bank was in violation of the Fair Credit Reporting Act, they are adamantly refusing.

Consumer Complaint: On or about XX/XX/23 we saw a transaction on our business account for {$110.00} that we did not make. We contacted our banking rep XXXX and Customer Service. We were told Bank of America knew this to not be a reputable charge and they would reverse the transaction and it would fall off the following day. This is the next day and the charge went through and Bank of America said we will have to submit a fraud complaint. We informed Bank of America of the fraud charge on our account and Bank of America said we would not be charged but we were charged anyway.

Consumer Complaint: I have a California Employment Development Department debit card issued by Bank of America which has my XXXX claim funds on it. I have contacted Bank of America at least a dozen times since XX/XX/2023 when they told me they were mailing me a replacement card as mine would soon be expired. I never received a replacement card, even after requesting a second one, and have been promised by Bank of America on four different occasions that they would mail me a check for the balance of my account which is {$10000.00}. I went in to my local CA EDD office and they confirmed my address and that the money had been issued to my prepaid card. The most recent dates on which I was promised a check are XX/XX/2023 and XX/XX/2023. I spoke with Bank of America again today ( XX/XX/2023 ) and was told no check had been sent.

Issue: Closing an account
Subissue: Can't close your account
Consumer Complaint: My Bank of America account has a negative balance of {$35.00} from fees only, not from overdrafts. I want to close the account, but Bank of America will not let me close it while it has a negative balance. They have frozen my account so that I can not add money to bring it back to a XXXX balance. Repeated attempts to close the account have resulted in more than XXXX XXXX on the phone with no resolution. I live on XXXX XXXX and there is no local Bank of America branch here. I have an email stating that the account has been closed, but I just received another statement with a negative balance that is increasing. I just want to close the account because I had the account for years and never used it, but still they drained hundreds of dollars in monthly maintenance fees. Once I became aware of the fees and reached out to them, they did not offer me a no fee account. I just want to be done with this Bank. They are not helpful and they are predatory in my view.

Issue: Managing an account
Subissue: Problem using a debit or ATM card
Consumer Complaint: On XX/XX/2023 I had my Bank Of America debit card stolen, along with all my ID. An hour later I went to my branch at XXXX XXXX XXXX, XXXXXXXX XXXX, had the card cancelled, had the employee check my account and she stated 'no worries, no one has accessed it ' and cancelled my card. And issued me a new one. It didn't arrive until 3 wks later after several calls with the Fraud Dept. number she gave me to call. I then couldn't talk to Fraud Dept until I had new ID, '2 ' pieces, which's why I had to wait for 2 weeks to get my claim underway. My first ID I received within 12 days, which wasn't acceptable to the Bank Of America until I received my second, their Bank Of America new Debit Card. In the meantime, we realized, after cancelling my Bank Of America debit card that someone was still using it. By the end of many calls to the fraud department their conclusion was I authorized all usage of my card, 'and ', since Bank Of America sent me 3 cheque copies that someone put into my account with my forged name on them, endorsed by my name on the back, all of which were different forgers by the different signatures. Bank Of America concluded 'I ' authorized them with different signatures, which I of course didn't. The names of the cheque owners are on the front of each cheque, with their addresses of the cheque owners, with my name, XXXX XXXX, endorsed ( forged ) on the back of each one. I do not know any of these people. One endorsed cheque for XXXX XXXX XXXX for XXXX XXXX XXXX for XXXX XXXX I then called Bank Of America 's fraud department after they sent me copies of the forged cheques, had to have an employee verify I was indeed the account owner every time at the branch, meaning the obvious, and I filed the Fraud Claim. I received various letters stating I first took XXXXXXXX XXXX out of my account the day my card was stolen, which I didn't. I actually chequed via computer and the XXXXXXXX XXXX withdrawal attempt said 'denied ' at the Library computer. And now it stated someone withdrew the XXXX $ funds. So, after this information I filed another Fraud Claim and was told that the first Fraud Claim wasn't filed properly and they'll reopen it, 'and ', that XXXX $ had been reimbused. And it'll probably take another week for the rest of the money be reimbursed, totaling XXXXXXXX XXXX which was missing. The last time I used Bank Of America was on XX/XX/2023, I deposited XXXX XXXX And thus I waited for my account to reopen so I could use it. Which never happened. And my debit card couldn't access even a dime. I called Fraud Dept again, and then, after 2-3 more calls to the Fraud Dept the Bank Of America decided they're they're just going to close my account where I am totally at fault for giving my PIN to someone, endorsing the phony names on those cheques and they're not reimbursing me for any of the missing funds. I had a police report issued for 'Identity Theft ', obviously provable by the forged cheque endorsement forging my name and usage of my debit card, my stolen ID, SSI Card, EBT Card, XXXX XXXX Card debit, and XXXX XXXX card, which were all stolen at the same time. XXXX has since reimbursed my stolen funds, XXXX XXXX I am still awaiting a response since they used the same justification that I endorsed someone else using my card upon the first Fraud Claim -- I've since filed another -- of which I didn't authorize anyone to sign my name. Not legal, anyway. Thus, due to the police report, 'and ', having to replace all my cards and ID, it took 4-5 weeks to get an understanding that I won't be reimbursed for any funds whatsoever. I filed a police report at the XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX. If you'd like a copy of it I can send it to you but can't send it via file upload on this Library Computer.
