Issue: Struggling to pay mortgage
Subissue:
Consumer Complaint: Bank of America was my original mortgage company. Back in XXXX I went through a divorce and bankruptcy there was modifications done so I could lower payments and afford to stay in my home. My mortgage was then sold to XXXX who then was sold to XXXX XXXX. then they sold my mortgage again to XXXX XXXX that is my current servicer on my mortgage. All was ok until I was then laid off due to XXXX in XXXX which put me in a financial bind again and it's been an uphill battle since! fast forward to today. My home sits on XXXX acres of land I am trying to sell a portion of the land to pay off my mortgage so I can stay in my home and downsize to a manageable level I am XXXX XXXX XXXX alone and trying to survive. I have buyers and we are ready to close when they pulled title work it's showing that the XXXX modifications that Bank of America did were not transferred with the XXXX mortgage when it was sold. It shows that they still hold it and they refuse to release it saying that since the loan was sold they are no longer able to release or transfer them. This is preventing my closing and needs to be addressed by BOA as soon as possible. They keep saying that it's not them but they hold the lien. I am putting in this complaint in hope something can be done about this or at the very least consumers know not to deal with BOA with their mortgages or check them if they have modified and the mortgage was sold because this will come back to bite if you choose to sell the home.

Consumer Complaint: On XX/XX/XXXX. Someone called me from Bank of America saying someone was trying to use my XXXX account to take money from my checking .before I gave information they needed I quickly realized they were scammers. At the same time another call came saying this was BOFA. I hung up called the Bank and they realize some was trying to take out money with XXXX, so they had to freeze my acct. i specifically told them my rent is in that account to be paid on the XX/XX/XXXX, they said that will go through its on going transaction. They opened a new account for me. But the money was still in frozen acct, {$3500.00}. My rent for & XXXX was paid electronically at XXXX on XX/XX/XXXX. On XX/XX/XXXX I received notice from rental agent, my check was retired and I will have to pay {$1700.00} by XX/XX/XXXX. I called the boa and they said they froze the account and returned the check because of the fraudulent activity on the Acct. the fraud dept sent me back to rental mgm. Who said The check return fee of {$75.00} must be paid but the late fee of {$170.00} will be waived if the will give me a letter stating that yes the funds was in the acct at that time but was frozen. The bank refuse to give me something stating the money was there. Now the fee is doubled to {$340.00} and I am facing eviction. Because the bank sent me letter saying they had to protect my account and even refuse to return the {$75.00}.

Consumer Complaint: On Saturday, XX/XX/2023 I reported to my bank, Bank of America, that my business account, XXXX, XXXX had been fraudulently accessed and {$4200.00} was transferred via XXXX to a person I do not know and did not authorize to do such. Her name allegedly was XXXX XXXX XXXX. A phone call was placed to me which appeared on my cellphone as Bank of America. The person calling asked whether I was authorizing a transfer to someone in Texas. I replied no. In reality, they were fraudulently getting my assistance to take my money and transfer it out, which they did. I did not go on my computer/account to do any transfer. They did. Bank of America investigated under their claim number XXXX and advised me in writing today they are not putting the {$4200.00} back, claiming they were following my " instructions '' facilitating the transfer of funds. I did no such thing however. This was fraud. I believe this should be covered under Regulation E pertaining to fraudulent electronic fund transfers. Please advise. Thank you.

Subissue: Problem using a debit or ATM card
Consumer Complaint: I spoke to Bank of America on XX/XX/XXXX and told that the merchant XXXX had been showing up in my checking and the charges amounting to over {$5000.00} had been fraudulently taken from my account since XXXX. They didnt ask many questions other than what charges I was disputing. The claim was closed with my funds being refunded today XX/XX/XXXX. If the asked more questions I would have told them that I believe that I have had my identity stolen and accounts compromised or created without my permission. I believe my ip address has been exposed and I still have multiple devices that have been disconnected from cell calls but is still capable of accessing accounts, passwords, photos of banking info, old photos of credit and debit cards, photos of my drivers license. My XXXX and XXXX XXXX accounts were recently taken over and passwords were changed. My neighbor returned my wallet to me XXXX months ago but Im not certain how long it was out of my possession or who had access to it. I often leave my main phone in my car over night or when Im home because I have difficulty hearing so I dont talk on the phone much. Im not sure if anyone has had access to my phone or other devices. I have received many emails asking to reset my password for multiple accounts when I have not requested a change. I have also had multiple two factor authentication texts sent that werent requested. Im not sure what people are capable of but I know that my identity and accounts have been compromised and Bank of America did not ask me enough during the fraud call I made nor did they follow up. My call was made using XXXX XXXX XXXX and I do have a transcript of the lack of questions that I was given. And I must say I do believe that if I was talking to a Bank of America associate instead of using a XXXX call that the person would have been more thorough. I think that nobody there would like to take the right amount of time and effort to accommodate anyone with any difficulties. I dont think the claim was treated with the care and mindfulness that a normal customer would have received. I filed an identity theft report with the FTC as well.

Consumer Complaint: I have XXXX different businesses with bank accounts at Bank of America, for which I also have several credit cards associated. We need the cards to carry out business, especially for our construction company that needs to make large purchases for client projects. We typically have to use one card, then pay it down and switch to another until it becomes available again. Clients pay us back for the purchases we make on their behalf, but sometimes they are delayed or even go into a dispute status and we are left owing money on the accounts. We never received a warning that our credit card accounts might be closed if we weren't able to make a minimum payment right away. Rather, the bank simply closed 4 of our cards and took {$9000.00} from a few of my bank accounts I had with them to make the payments. One of the accounts was my XXXX daughter 's. That was a disgusting action -- especially, without warning us. I asked them today after finding this out if I could do anything to reverse this and simply make the minimum payments and they said " absolutely not. '' I can't believe the bank I have done hundreds of thousands of business with for the last few years would not try to amicably work with me, and they made no effort to restore the money to my daughter 's account. She should not be affected by my businesses and the bank 's lack of notice. The credit lines that I had were a total of almost {$80000.00} that is now not available to me for my businesses to function. I am also hugely impacted on my credit score and have no way to acquire a new card because of this bad history. I had to spend all day and will have to spend several more days trying to figure out how to fix this and not lose our project contracts that are already underway and rely on the cards. In addition, I just took a personal loan of {$20000.00} to cover the minimum payments and to pay my payroll obligation tomorrow ( XXXX ) and they put a hold on the whole check for at least a week, until the XXXX of XXXX. Payroll will be 4 days past due and my employees will threaten to quit if not just be severely impacted by my inability to pay them. I am doing everything I can to meet our obligations, but the bank is acting as if they have no control and no heart. This is cruel and impacts several lives. Please help rectify this by restoring our accounts and helping us access the funds I had to borrow from a family member. They said the check for the loan was already withdrawn from their account by the way. There is no need for a hold. Unbelievable!!
