The company has refused to communicate back with me about options to settle or to even discuss the account. Consumer Complaint: I submitted a complaint to the CFPB -- XXXX. Bank of America responded that they needed more time to investigate. Bank of America sent a very short two paragraph response to me flatley stating the information on my report is correct. Bank of America did not send the response to the CFPB. Bank of America did violate a settlement agreement by failing to correct the credit reporting per the settlement agreement, and instead completely deleted the entry, per the original complaint. This complaint also alleges that Bank of America used the response that it needed additional time to respond to sidestep having to respond to the CFPB about the complaint, avoiding a response to the CFPB entirely.

Consumer Complaint: This letter is my formal dispute notice regarding two cases that refers to the Bank of America Acct ( s ) back in XXXX. Plaintiff is XXXX XXXX XXXX XXXXXXXX XXXX XXXX and the Law Offices of XXXX and XXXX, XXXX. I am the defendant and a victim of Identity theft and fraud. As reported to the XXXX XXXX XXXX Sheriffs Dept. Levying Officer. I responded to inform them that their information was completely inaccurate, fraudulent and a matter of identity theft. I requested that they return my earnest money that was levied. They took {$1500.00} which was garnished from my bank account, including the miscellaneous debit garnishment processing fee of {$100.00}. They have taken my time at the court house, the sheriff dept. and I had to research information which was extremely stressful. Not to mention the gas money to travel back and forth for weeks. I am not a lawyer! Therefore, I had to learn things and gather information and paper work that I am unfamiliar with. I still don't have an attorney. I demanded that they validate this information by providing me and the XXXX XXXX Manager Dept. We have tried to subpoena Bank of America for proof of records and asked that the law firm that took over this case to substantiate this debt. The case was recently brought to my attention for the first time as of XX/XX/XXXX. On that day I received a letter of ( 13 ) thirteen pages in the mail from the Sheriff department in regards to this case. I have never received any summons or been served by the court in regards to this allegation prior to this month, XX/XX/XXXX. When I received this letter I went to the XXXX Superior Court at XXXX XXXX XXXX XXXX. in XXXX, CA. to inquire and receive a case file with ( 80 ) eighty pages of non-conclusive information, accusing me of an alleged debt with NO Authorized SIGNATURE of the acclaimed debt.

So, for a year and a half Ive been having a major issue with Bank of America and fake accounts taking money from me. They would freeze my account and make me wait for a card. The problem that I keep telling them, is that IM A XXXX XXXX. That means Id have no access to the money I saved, etc. on the road. The one time I attempted to pull my money out and move to another bank, I was blocked with a withdrawal limit notice but I tried to transfer it. Consumer Complaint: On XX/XX/XXXX, someone posed as me and withdrew {$800.00} from my joint account with my wife at Bank of America ( {$400.00} from checking account and {$400.00} from saving account ) at a local BoA branch. Prior to this, around the end of XX/XX/XXXX, I realized I was a victim of identity theft, so I already alerted all my banks and credit card companies of a potential fraud against me. As a precaution, my wife even opened a new account and transferred most of the money out and just left a small balance for bill payments. I have filed several police reports with our XXXX XXXX XXXX and also with the Federal Trade Commission. As soon as we knew of these two unauthorized transactions, we submitted two claims with BoA. One was resolved on XX/XX/XXXX and we got the {$400.00} refund back, but the other {$400.00} claim was denied. We found out the denial when we called BoA check fraud department on XX/XX/XXXX, and they said they have the video footage to deny our claim. Then on XX/XX/XXXX, we got the denial letter claiming that I authorized this illegal transaction and that I benefited from the funds. I want to make a complaint against BoA for the following reasons : 1. I timely alerted BoA and even set up a verbal password. Did all precaution to protect my finances by transferring the cash out from the joint account as soon as the identity theft came to my attention. 2. I still have in my possession all my IDs or bank cards, so if BoA did the right thing, especially when I already requested BoA to put an alert on my account, they must scan the ID, must request the PIN and the bank card. I believe BoA did none of these because if they did they would have found out these documents are fake. 3. The baseless and irresponsible denial of my case and their claiming that it was me are equivalent to defamation of my character. Since I'm with my patients throughout the day, people can vouch for me that I wasn't at the bank at all. By concluding that I was the one on the video, it clearly shows BoA is very irresponsible and hasn't done their due diligence. I have requested that they share with me that video footage, but I haven't received any responses. 4. While the two unauthorized transactions occurred on the same day, at the same location and same time, they honored one but denied the other. This just proves they haven't done their research, or their research ( if any ) is baseless.

Consumer Complaint: Prior to the last complaint I put in with consumer finance protection bureau I stated and alerted my financial institutions fraud department of the identity theft & fraud that has taken place with my name & social security number that I did not authorize. Before putting a complaint in I tried to resolve this issue with my financial institution which they directed me to go into your nearest branch. unfortunately I did not get the help needed to move further in investigating what is going on with this fraudulent unauthorized account that my financial institution Bank of America joint to my actual checking & savings account that I opened. However the branch I chose to go to denied me access to the information on the savings account that I told them was an unauthorized account. I made police report I also made a report with the attorney general at this point because my financial institution has frozen my legit funds & my legit checking & savings account. Furthermore I called a resolution department on XX/XX/2023. I was told my accounts was being closed my funds are frozen & they could not disclose to me why. This department was of no help. However there was a XXXX XXXX who reached out to me through email in response to the consumer finance report I made stating she was the point of contact & would help on the behalf of Bank of America as a resolution specialist. I emailed her back 3 times I also left a voicemail because I could not get a answer when I called. I have been complying with every law as the consumer & im not being helped & also at this point my financial institution Bank of America is rejecting me not helping & they froze my funds & closing my account with no explanations. Because of this they are causing me a financial burden.

Consumer Complaint: On the afternoon of XX/XX/2023 I placed a total of XXXX banknotes consisting of XXXX {$100.00} bills and XXXX $ XXXX bills. I did not realize that the ATM had a limit of XXXX bills for accepting cash deposits. The ATM spit out a number of bills, which I deposited on a second deposit basis. However when I looked at my ATM receipt, I was credited with {$5300.00} instead of the {$6400.00} that I had deposited. I was shorted {$1100.00} by the ATM. I believe that the ATM malfunctioned. I immediately went inside the bank and informed the staff, who told me that the branch was helpless to do anything, and I would have to call an XXXX number to file a claim, and I did as instructed. More than a month later, I received a standard boiler-plate form letter that my claim was denied after reviewing my account history. I have contacted BoA call center a number of times to dispute the finding and to understand how that decision was made. I have not been provided a logical answer. I also emailed the CEO of BOA, and received a call back from the XXXX Escalation office that they would follow up, but that never happened. I had hoped that the bank would research the amount of money that was deposited and withdrawn in and out of the ATM in question, to determine if there was indeed more money in the box than the ATM showed. This would require that the actual physical cash in the ATM box should have been reconciled with its electronic readout to determine a discrepancy. Bank of America never did this work.
