Consumer Complaint: Greetings, on XX/XX/2023, there were UNAUTHORIZED charges made from my checking account with BANK OF AMERICA. These UNAUTHORIZED charges were transacted through XXXX, as someone fraudulently accessed my XXXX XXXX account, and made the transaction, which deducted the money from my checking account when my cellular device was lost/stolen. These UNAUTHORIZED charges were in the form of 2 payments, one for {$4600.00} and one for {$4500.00}. For a sum total of {$9100.00} in UNAUTHORIZED FRAUDULENT charges. One of the recipients that the money was fraudulently stolen and sent had the name " XXXX XXXX. '' I concluded that THIS PERSON had a part in the FRAUDULENT UNAUTHORIZED charges that were made from my account, and this person must be investigated, and their accounts should be reported. I contacted XXXX to dispute the transactions and gave information on the fraud, yet I was denied a refund of the charges with NO SUBSTANTIAL evidence or documents provided at all regarding the denial decision that was made. I requested documents that support their decision of denial, and all I received was an email showing the transactions that were made, and no other evidence that positively accurately support their denial. I then created a fraudulent claim with my bank ( BANK OF AMERICA. ) After a week of waiting, I was then met with a message including the denial of my claim from Bank of America for my unauthorized charges. There was a message included by Bank of America that stated, " The charge was authorized by you or made by someone who has permission to use the card or account. '' THE CHARGES MADE FROM MY CHECKING ACCOUNT WERE NOT BY ME, AND I DID NOT AUTHORIZE ANYONE TO USE MY ACCOUNT. There is supporting evidence of the person who was associated with the fraud, as the UNAUTHORIZED money was sent to this person, as their name shows up as one of the persons to who the money was sent to ( " XXXX XXXX ''. ) XXXX clearly has information on where the money was sent to, and which bank the money was withdrawn from. If they further investigated this, they will realize that the money was fraudulently taken from my account and was UNAUTHORIZED. They also have information regarding the banks involved with this fraud, as they can further investigate it. BUT I WAS DENIED OF MY CLAIMS AND DISPUTES BY BOTH XXXX AND BANK OF AMERICA.

Consumer Complaint: My merchant account with Bank of America was unfairly closed randomly. In addition, the remaining funds on the account were automatically withheld as a result. I was advised the funds an amount over {$2600.00} will be on hold for approximately 6 months, which was excessive in comparison to the 90 days norm from other financial institutions. Furthermore, I received XXXX charged back during the holding period, and all three charged back were deducted from my business checking account instead of the funds on hold. To my concern another red flag. Besides, I was informed by Bank of America otherwise, that funds are placed on hold for this specific reason to cover any potential charge back. Move forward, on XX/XX/XXXX a representative from the risk department advised to call on XX/XX/XXXX in order to have the funds release. After all, upon calling on XX/XX/XXXX, another issue arise detailing that the funds will not be release until late XXXX, since the last charged back occurred in XXXX. Therefore, an additional 6 months, were added and will continue to add in conjunction of potential future charge back. At this point Bank of America failed me at every point, by using tricks and malpractice to not release the funds as promised within the 6 months period.

I when to deposit the cash amount of {$2700.00} at the Bank of America ATM ID XXXX located at the parking lot of the XXXX XXXX located at XXXX XXXX XXXX XXXX, XXXX XXXX Ca XXXX. We deposit the money at the money slot, machine took the money and just completed the transaction without giving any receipt. Free our card. We automatically check our banking application and notice the money wasn't credited. We call the number of the ATM and they told us they couldn't help. We tried calling the bank but customer service is not responding.

Consumer Complaint: On XX/XX/XXXX, I submitted an investment collateral property ; negotiable instrument in the form of a Promissory Note worth { {$400000.00} } to BANK OF AMERICA BANK BY MAIL XXXXXXXX via registered mail number ( XXXX ) which was confirmed received by the UNITED STATES POSTAL SERVICES on XX/XX/XXXX. This Note, negotiable instrument, credit agreements, bills of exchange and Promissory Note are defined as legal tender, or money, by the statutes such as 12 USC 1813 ( 1 ) ( 1 ), UCC 1-201 ( 24 ), 3-104, 8-102 ( 9 ) ,9-102 ( 9 ), ( 11 ), ( 12 ) b, ( 49 ), ( 64 ). It is the duty of the Bank to honor this instrument, to know, abide by, and operate under the law, 18 USC 8 and HJR- 192 XXXX XXXX XXXX applies. All Banks must process lawful United States currency. Failure to do so is " interference with commerce '', a felony RICO ACT, 18 USC 1951. The computation of time for carrying out performance of fiduciary obligations is three-five business days in accordance with the Bill of Exchange Act. I contacted BANK OF AMERICA on XX/XX/XXXX to follow up about my account being credited, I was informed by a representative that a request have been submitted for someone to contact me within XXXX hours to discuss about processing the promissory note and crediting my account. I never received a call back from anyone. On XXXX/XXXX/XXXX, I made another follow up call and spoke with another representative who told she will file a claim and have someone call me back. Still no one call me back. On XX/XX/XXXX, I made another follow up call and asked to speak with a supervisor. He told me the team responsible for processing the Promissory Note was not online at that time. He will send them an email to follow up about crediting the account and will notify within XXXX hours. I have spent several hours on the phone, being transferred from one representative to the next with no resolution about crediting my account or someone providing me with answers about my investment collateral property I provided to BANK OF AMERICA for my account to be credited. This has been a huge inconvenience for me and emotionally draining. It's almost a month and BANK OF AMERICA have not credited my account nor have they return my original " investment collateral ''. All of these interactions can be subpoena through the Freedom of Information Act should this matter need to be contested before XXXX and XXXX. BANK OF AMERICA Failure to act in good faith, to honor, process and credit the intended account has caused loss, injury and harm. BANK OF AMERICA breached its fiduciary duty by : ( a ) Failing to act in the best interest of their client to carry out performance of obligation in reasonable timely manner. ( b ) Failing to respond to issues arising from this contractual transaction in prompt manner to address client 's concerns. ( c ) Held on to my investment collateral for longer than required to carry out performance and still have not retuned my financial asset. ( d ) BANK OF AMERICA failed to act in good faith to credit the account even they were notified that I provided them with an investment collateral property in exchange for them to credit my account. Due to the suspension of the gold clause and H.J. Res. 192, 73rd Cong., 1st Session, all we can issue is collateral security in exchange for credit ; and or for performance. I issued BANK OF AMERICA legal tender which is lawful currency of the United States, but the bank failed to act in honor and good faith.

Consumer Complaint: I noticed that I had maintenance fees on a monthly XX/XX/2023 statement. I talked to an XXXX XXXX XXXX at a BofA bank in my area about this. I knew that at times in the last 10 years that my account had a large deposit of money in XXXX of my XXXX accounts though I still received maintenance fees on my account. I was sure that I maintained at least {$1.00}, XXXX in XXXX of my accounts so that I would not receive maintenance fees. The XXXX XXXX XXXX at the BofA filled out a request form for me to receive {$800.00} from the bank to reimburse me maintenance fees on my account, but the BofA did not reimburse me any money for charging me maintenance fees even though I had the required amount of money in the bank, at times, to not have to be charged maintenance fees.

Consumer Complaint: I made a dispute against XXXX for the full amount of my rental on XX/XX/XXXX with Bank of America. A few days later, I called them and the guy said he would expedite the claim. I asked him why didn't they give me credit on my account ( {$650.00} about ). He did not answer. Later I called again and talked with a female and she said I should have gotten a letter or email requesting more documentation ( I had never received any request for documentation in the initial call, any subsequent call, or in any email or letter ). On XX/XX/XXXX I received a letter in the mail from Bank of America stating I had XXXX business days to submit documentation or they would close the case and not refund my account money. The amount disputed in the letter was {$270.00}. I never disputed this number. I disputed the FULL AMOUNT and told EVERY CSR that I was disputing {$650.00}. I don't know how they came up with this number. I want to have more time to submit documentation. I also want to know when this " email '' was sent to me to submit documentation. I want to know why my account was not credited for {$650.00} while this investigation was done into the disputed amount. I want to know why I was sent a letter dated XX/XX/XXXX when that was the day I called them and complained. Why wasn't I sent a letter on XX/XX/XXXX when I made the initial dispute. Bank of America has incompetent staff, backwards procedures, and can not handle a simple dispute. I will seek legal counsel for this and other matters.
