Consumer Complaint: I requested a new XXXX XXXX Bank of America XXXX in the middle of XXXX of XXXX, the card was never received. I called inquiring why XXXX XXXX received my card in the beginning of XX/XX/XXXX and found out the card sent but just left on the porch out in the open by whichever delievery carrier was used. Upon calling Bank Of America and requesting an additional card requested to be sent I was informed the previous card was acrivated and my funds were drained out of my account with fraudlent unauthorized transactions. Upon successfully receiving it after the first failed attempt I tried to activate the card for I can gain access to my online mobile transaction history I was informed my account has been frozen. This is ridiculous that funds can be fraudulently taken out of my account and when I try to get it resolved they freeze my account after filing a claim for the all the money that was fraudulently stolen from my account. The claim was filed on a Friday XX/XX/XXXX and then claim was denied by the following Monday on the XXXX of XXXX. I truly don't see how they could or properly investigated the unauthorized activity and to have a decision of denial like that. I'm clearly not the only individual that has had this issue due to the class action suit that has been filed against Bank Of America. No proper action wad taken by Bank Of America because they denied and put a block on the account that said couldn't be removed 3 days after I filed the claim regarding the fraudulent activity. After receiving mail sometime in the first week of XX/XX/XXXX, stating {$6.00} in fees was deposited into my account ( which was false ) I called and was told my claim yet again is being looked into which is why I'm filing this complaint to hopefully finally get the resolution that I rightfully deserve.

Consumer Complaint: Beginning in XX/XX/XXXX I reported to Bank of America multiple recurring fraudulent charges to my checking account dating back to XX/XX/XXXX. I made at least 7 phone calls to BoA. I provided all requested information on the phone. Multiple claims were opened. Some were approved and I was reimbursed for those. The following were denied. XXXX {$69.00} denied XXXX XX/XX/XXXX, XXXX {$190.00} denied XXXX XX/XX/XXXX, XXXX {$61.00} of {$140.00} denied XXXX XX/XX/XXXX. The charges were under XXXX, XXXX XXXX, XXXX, XXXX XXXX, and XXXX XXXX. I did not make these purchases. My debit card was with me at all times and no one else is authorized to use my account. Yet BoA states " The following charge ( s ) was authorized by you or made by someone who has permission to use the card or account. '' This is a lie. I contacted the vendors, who confirmed it was fraud. I placed a Fraud Alert on my credit report with all 3 bureaus on XXXX XX/XX/XXXX. I placed an FTC Identity Theft Report on XXXX XX/XX/XXXX ( XXXX ). I placed a police report with my local police department on XXXX XX/XX/XXXX ( XXXX ). Bank of America refuses to work with me, doesn't call me back, doesn't help at a local branch, and has now withdrawn over {$240.00} from my checking account and will take another {$61.00} on XXXX XX/XX/XXXX. Please help.

Consumer Complaint: So California 's Bank of America EDD debit cards allows you to make a one time transfer to another bank. I used my one time transfer and transferred XXXXXXXX XXXX to someones account for a purchase ... BOA took the {$5000.00} and that persons $ XXXX paycheck and closed their account saying I was not supposed to send a transfer to some one else 's account. I had been put through the ringer for about 2 years trying to retrieve our money! BOA ( which the other person banks with ) said they sent the {$5000.00} back to EDD and that they would send the remaining balance of the other persons paycheck which they never did either! I've contacted EDD they informed me that they didnt receive any money as they CAN NOT receive any money back! After I told BOA that, I was then also informed that they did not send the money back to EDD because EDD did not submit a claim form.

Consumer Complaint: My Bank of America account is closed ( i requested ) i cant have correct date and amount but it will be in day or XXXX difference. My business credit card was charged for offset payment for XXXX $ and my checking account was left with XXXX XXXX I am going trough hardship and cant afford regular daily expenses. They took money on XXXX or XXXX of XXXX, 2023. I called many times and tried to get written explanation based on what state or federal law they can leave me with XXXX $ and without my contest take the money away. I was able to talk to escalation manger and he told me that based on my agreement they can do that. Paragraph XXXX as he mentioned. I believe that agreement is unlawful and should be voided. I feel my rights are hurt, i cant pay my rent now. This money should be taken only if court approves in my opinion. I need protection and help, cant afford lawyer. Thank you! My items were stolen and because I did not use my bank card for a while, i didnt notice it was missing until I received fraudulent charges. I informed Bank of America of this but an unproductive investigation was conducted. No one compared signatures and it is my sworn oath this is stolen identity which has happen before in XXXX i filed with internal revenue services for stolen identity. My credit reports are on alert for fraud and IRS has been on alert for stolen identity for years. This situation with Bank of America is stolen identity!!!!

Consumer Complaint: Bank of America is a financial institution that is violating 15 USC 6801 and 15USC 1681. I have the right to make sure my private information isn't shared. 15 USC 6801 states " It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' Bank of America ( the financial institution ) does not have my consent to furnish this information and under no circumstances do they have my written consent. 15USC 1681 ( a ), specifically items ( b ) which defines the Person ( Bank of America ), ( c ) which defines the consumer ( myself ) and ( d ) 1, defines what a consumer report is. 15 USC 1681 ( d ) ( 2 ) defines what a consumer report is not. In other words, what CAN NOT be included in a consumer report. ( 2 ) EXCLUSIONS.Except as provided in paragraph ( 3 ), the term consumer report DOES NOT INCLUDE ( A ) subject to section 1681s3 of this title, any ( i ) report containing information solely as to transactions or experiences between the consumer and the person making the report ; Bank of America has submitted information to all 3 credit reporting agencies that are now included on my consumer report. These are items that Congress clearly says CAN NOT be included by sharing transactions and experiences between myself and their company. On XX/XX/23 I sent a certified letter in reference to both my accounts, which reflect transactions/experiences solely between their company and myself, and in their letters dated XX/XX/23 they refuse to remove them and closed my dispute.

Consumer Complaint: On XX/XX/XXXX at XXXX PT, someone used my Bank of America credit card to purchase tickets to a basketball game on XXXX for {$1400.00}. The email address they used is XXXX. I do not know this person, and nobody is authorized to use my card except myself. According to the resolution letter provided by Bank of America, including information provided to them from XXXX, the purchase was made from a XXXX computer accessing the internet through the XXXX address XXXX which maps to near XXXX, NV where I live. I do not use a XXXX machine and I was in XXXX for work at the time. Early the next morning on XX/XX/XXXX, I received a fraud notice from Bank of America for 3 charges. One was a declined charge at XXXX for about {$800.00}. The second was for the accepted charge at XXXX of {$1400.00}. The third was a charge for a few dollars on the XXXX XXXX, which I did make. I confirmed immediately to Bank of America that the XXXX charges were fraudulent but the XXXX XXXX charge was not. Bank of America reversed the charge while investigating the fraud. That same day, I also began receiving emails from XXXX, which apparently linked my credit card number to an account I had with this merchant, despite the fact that I had not provided my credit card number to this merchant. ( Many years ago, I was gifted baseball tickets through XXXX and had to sign up to receive them. I did not provide any payment information to XXXX then or ever. I have not transacted with this merchant since. ) I also called their customer service number at this time to inform them that the charges were fraudulent and the subject of a fraud investigation from Bank of America. They took no action, and I continued to receive emails about the basketball tickets as if I had purchased them. It is through these emails that I found that the perpetrator of the fraud used the email XXXX. Upon signing in to XXXX I found no trasactions, payment methods, or tickets in my account. I was unable to resell the tickets or cancel their purchase. As far as I know, the tickets were delivered to XXXX and they were able to attend the basketball game on XX/XX/XXXX. On XX/XX/XXXX, I received a resolution letter from Bank of America stating that they are unable to approve my claim as the " merchant provided documentation confirming you received the merchandise or service ''. This resolution letter included a copy of the report from XXXX showing the XXXX address and operating system where the charge was initiated. It stated that I had a credit card on file with the merchant, which is not true. What is true, to the best of my knowledge, is that XXXX linked my credit card to my email address and provided this linkage to XXXX without my knowledge or consent. As XXXX is a back-end credit card processor for many merchants and owned by XXXX, my understanding is that they would have my credit card and email on file because I've made purchases with other merchants. I have never made a purchase with XXXX. I have tried to resolve the matter with XXXX and Bank of America. Both are unreachable by phone. I have reached out on XXXX and have been told that XXXX will only work with local law enforcement. I have filed a police report but as far as I know this is not a priority for the XXXX police and they have not assigned an officer to the case. As such, I am at an impasse with XXXX as they have refused to work with me any further to resolve this. On XX/XX/XXXX, I filed a complaint with the CFPB. On XX/XX/XXXX, I received a response from Bank of America stating that they require more time to investigate the fraud due to the complexity of the case. Upon receiving this response from Bank of America, the CFPB closed the complaint. As the matter is not yet resolved, I still have a balance of fraudulent charges and late fees with Bank of America, I am opening a new complaint. As of XX/XX/XXXX, all of my legitimate charges to the Bank of America account have been paid in full and no new charges have been made. The fraudulent charge of {$1400.00} remains in my balance and a late payment fee of {$9.00} was charged to the account on XX/XX/XXXX. My next payment is due XX/XX/XXXX. At this time, I anticipate that Bank of America will begin to charge more late fees and interest on the fraudulent amount. I am providing the following documents : * The email email from Bank of America informing me of the fraud. * The emails from XXXX. * The resolution letter from Bank of America. * The XXXX police report. * My travel itinerary for my trip to XXXX. * Bank of America 's XX/XX/XXXX response to the CFPB complaint
