Issue: Problem with a lender or other company charging your account

Subissue: Can't stop withdrawals from your account

Consumer Complaint: I received a call on Friday XX/XX/XXXX from an unknown number claiming to be XXXX XXXX Account Services. Because of our financial delinquency currently I fell for the request. Two nights previously our cable was shut off for late pay. I was under pressure financially. The caller claimed we were on a list for disconnect that day if the previous balance was not paid directly. I brought up my XXXX Account online and saw the balance they referred to was identical to my overdue balance. Not sure where they got these detail. They showed later on the caller ID as a XXXX phone number. Bottom line is they claimed that if I did not pay directly to that office that my disconnect had been dispatched and that department is the only one that can see the payment and then cancel the disconnect. If I paid on my XXXX online account they claimed it would not go through in time to avoid disconnect on a Friday. They wanted to know if I could XXXX the balance to XXXX XXXX - mobile immediately. I knew I had Bank of America partially owned XXXX on my BOA app and thought I was protected if I made the transaction through my bank. I was blinded by fear in the process and just wanted to avoid disconnect. I made 4 XXXX transactions, 3 cleared before BOA stopped a fourth. The total fraud was for {$890.00} wiping out my weeks budget for other bills. I called Bank of America when my wife got out of work and stated that it ma have been a scam. Bank of America started a case but told me that XXXX is an outside entity that is like transacting in cash and they had no protection against fraudulent activities drawn against my checking account through XXXX within my Bank of America webpage. I was stunned. I am out the money, still owe the bill and have no funds to pay properly. How can Bank of America not protect a consumers money on a transaction that was done on their website through a corporate partially owned entity like XXXX? This is really bad when our money is not protected on our banking apps.

Issue: Managing an account

Subissue: Cashing a check

Consumer Complaint: I was the victim of a check washing scam. I reported the scam to Bank of America 2 hours after discovering my check had been washed. For over 90 days, they claimed they were conducting an investigation into the check fraud. After 90 days ended, they sent me a letter saying that I would not be compensated for the check was because it was reported after 60 days of it actually occurring. During that 90 day period, multiple people at Bank of America insisted that I would be reimbursed for the washed check. Bank of America Fraud line XXXX from Tennessee admitted that they only completed a slight investigation, Bank of America took no meaningful actions to protect my best interest in this case. Furthermore, Bank of America refused to provide me with any information regarding the fraudulent transaction.

Issue: Fees or interest

Subissue: Charged too much interest

Consumer Complaint: I have 2 credit cards with Bank of America and I paid my balance in full on both. They sent me a bill for an additional interest charge telling me I have to pay off my balance 2 months in a row without additional charges to no longer receive a bill. Also, the entire finance charge is due vs. having a minimum payment. The agent told me that is because I paid my account off the rolling interest charge doesnt have a minimum due. So basically, I paid my account off and I no longer qualify for a minimum payment but because of purchases that roll over, I still qualify for an interest charge. Pretty sure this is some type of fee gouging. When you pay an account off, you dont expect to get another statement saying you still owe more. Not all credit card companies practice this because Ive paid off quite a few. My credit card balance was {$9800.00} and I paid {$9800.00} BEFORE my due date and I then got another statement for an additional {$160.00}, which is only interest. And that is due in FULL by my due date, no minimum. They could not tell me what balance that interest was determined from either. And again, not all credit cards practice this.

Issue: Managing an account

Subissue: Banking errors

Consumer Complaint: Hello. Finally looking to get some help after the nightmare this caused and continues to cause now. You see I inherited land before I knew it. Its in my name now luckily. But last year BOA and MAINLY merril lynch in grand junction. Didnt believe I was who I said I was. Well I am who I say I am. The only land I ever told them about. Oil producing land. Is in my name now. But I still dont have access to accounts my grandparents left to me. Because XXXX XXXX locked me out of them. And told the police I wasnt who I say I am. Well the case is over now and its been determined that I am still who I said I was LOL. My account was locked after my mother was tricked into signing a document removing me. After XXXX opened my trust account with a name I did not give her. I figured I would email first I spent a year being forwarded directly to Merrill lynch and being placed on hold until I hung up. XXXX was never supposed to have any control over my personal accounts ever. So Im still confused how she got it. Please help my mother and I. Get this fixed. Thank you. XXXX XXXX XXXX XXXX XXXX XXXX Account number XXXX Please call XXXX This time line was written then. But it still stands. *My mother and I opened a Bank of America ( BOA ) joint account online at the end of XX/XX/XXXX. *Receive email telling us to call *We called and are immediately routed to BOA Private Bank *We were informed that we would have to come in and physically verify our identities, even though we had received emails stating the accounts were already closed. *Upon review of our emails, we have now confirmed the accounts went from processing, to open, to unable to complete the transfer of funds ( which we never requested ), to ready to use. All of this happened between XXXX XXXX to XXXX XXXX on XXXX XXXX, XXXX. *We went to XXXX , UT , five hours away, which was the closest BOA *When we went to sign documents, we noticed XXXX XXXX name had been changed. Immediately, we questioned and pushed back on this. *The two men setting up the accounts told us they had been left detailed notes and they were doing everything correctly and as instructed. *In hindsight , this is where we should have demanded answers, but after continually dealing with varying forms of odd and illegal banking anomalies for over 22 years, for once the name change actually made some sense. *I now know this is where I should have stopped involving others in my finances, but at this point I had confirmed I was going to need legal help to probate a generational trust. *So I decided to keep a previously scheduled appointment with XXXX XXXX XXXX in the Grand Junction Merrill Lynch ( ML ) office, the town where I lived. *By this point I was already noticing many odd things : ~My name being changed ~The accounts said they were opened in Iowa ~Being told the accounts were XXXX XXXX XXXX ~XXXX went on her mother 's BOA bank account in XXXX, following her father 's death. ~XXXX closed that account during the probate process, following her mother 's death in XXXX. ~XXXX opened another BOA account in XXXX when she moved to XXXX . ~None of which add up to 33 years of accounts. *I went to the meeting with XXXX at ML. The initial meeting went really well, because I had ample documentation to support what I was telling them. I now have even more supporting documents. *We were completely upfront and honest with XXXX about BOA changing XXXX XXXX name. When deciding which name to use, XXXXXXXX XXXX birth name or the one BOA gave him, XXXX said 'my grandpa did not teach me to lie and I am here because I told the truth when opening the BOA accounts. The system did it on its own. ' It was XXXX that decided to use the name BOA had given XXXX. Even though she made multiple copies of our government issued IDs, that state our legal government names, which is XXXXXXXX XXXX name that I gave him at birth. *XXXX immediately got to work and made her first attempt at getting us to sign a Power of Attorney ( POA ). *By the second week I could tell something was off. But I gave XXXX the benefit of the doubt, because of the uniqueness of my situation. *Due to the growing need of legal services, XXXX recommended that we open a trust. At this point, I still believed that ML was trying to help. Based on basic math regarding the North Dakota ( ND ) oil lease documentation, we signed paperwork to open a {$50000.00} trust. *Two-three weeks passed and the trust still hadn't been opened. XXXX informed us that her manager didn't understand why we would only want a XXXX trust, when our verifiable net worth was at least XXXX XXXX. *This is the first time anyone had given us information regarding our net worth. I wasn't shocked, because I had done the basic math on just the ND trust and that amount is before inflation and other factors, essentially left in a grandfathered state. *By this time I was getting irritated because I had specifically told XXXX XXXX didn't want her manager involved in our accounts at all. I was getting bad vibes from XXXX and pretty much the rest of the XXXX ML team. But I knew I needed the trust open, so after looking at what would be needed to purchase a home, car, our bills, and get ourselves settled and secure for what looked like a long legal process, at the direction of ML we agreed to adjust the trust amount to XXXX XXXX, rather than the XXXX. With this adjustment ML finally opened the trust. *During this entire process XXXX continued to pressure us to sign a POA. *Due to my growing suspicions and lack of communication from XXXX , following the signing of the trust, I decided to go on my annual birthday trip to XXXX XXXX . My main goal was to physically go into a BOA in a different state. *This trip proved to be extremely enlightening. I spoke with several BOA 's in XXXX XXXX, Arizona, and California, all of them outside of the Colorado banking region. It took time, but most banks were able to give me a little insight on how to operate my BOA checking and saving accounts. Ultimately I figured out the accounts and they worked properly for 2, maybe 3 days at the beginning of XX/XX/XXXX. *Immediately once I had figured out how the accounts worked, I contacted XXXX and informed her that only I ( XXXX ) could have access to the accounts. This conversation was done in a very professional manner. I asked XXXX to remove herself from all the accounts and told her we would reevaluate our business relationship when things had settled down. We had had similar conversations multiple times, because of my distrust of banks and not knowing how the accounts worked yet. *Since I was still out of town, XXXX set up an appointment for my mom to come in and sign the papers removing XXXX from our accounts as we had requested. *At this point my accounts were still positive. The only reason they were dipped in the red is because a Credit Union continued to process checks and place holds on checks that were not written to them. Because they couldn't see info due to redactions. *With the meeting between my mom and XXXX scheduled, I decided to go ahead and enjoy my birthday. Mainly because XXXX had warned it would take some time get her off the accounts because it was a process. *XXXX tricked my mom into signing a paper removing XXXX XXXX online access to the accounts, instead of removing her. My mom questioned XXXX about the wordage on the form, but XXXX assured her this is what was needed to begin the process. *At this time, I wasn't aware I had already lost access to my accounts. My BOA accounts were no longer branded BOA, but rather branded ML, which they had been for a while. I, along with several bankers in XXXX XXXX, were livid with the actions that XXXX and the ML team were taking. The bankers said what ML had done was illegal, but they didn't have the ability to stop them. This ultimately left me homeless from my hotel, because not only did this lock the BOA accounts, it locked all of my accounts. *Eventually I made it home with XXXX help, food, or money on XX/XX/XXXX. Because of what XXXX had told me, I was still under the impression that the accounts were just transitioning back to BOA, after ML had wrongly acquired them. And that they would start working again properly in 5-7 days. *So I hit the ground running. I proceeded to find a home. I had already spoken with XXXX about the townhomes prior to my XXXX XXXX trip, believing them to be good investment property for rental purposes. It was only because of the continued banking issues, that the townhomes ever needed to be used as a temporary home. *Because I still did not have access to the accounts, and BOA still showed XXXX as my contact, I sent her the house contracts for her to process payment for the townhomes. *The escrow process continues and I show up at closing, on XX/XX/XXXX, only to find out nothing had been handled. *At this time it didn't matter if I called BOA or ML, I was always routed directly to XXXX . Even if I called the general XXXX numbers, as soon as I gave my name the call was transferred to XXXX. She would not answer her phone and I was always sent to her voicemail or XXXX XXXX, her mgr. This went on for months. Even if someone from another bank called for me, they were immediately routed to XXXX. The last paper statements we received continued to show XXXX as our account manager. *Following the clown show during the closing, I decided to look at what took place during the meeting with my mother and XXXX . This is the first time I looked at the paper XXXX had my mother sign. Needless to say, I was shocked to learn she hadn't removed herself, instead she had my mother sign to remove my online access. Which is not at all what either of us asked for. *Needless to say this process has taken a toll on us, but especially on my mother. Because of this she decided to give me her Durable Power of Attorney ( DPOA ). I took a copy of the DPOA directly into the ML office. This is the first time I formally met XXXX XXXX, XXXX 's mgr. XXXX XXXX got in my face and rudely told me no one services my accounts there, and that I needed to call XXXX XXXX ( XXXX ). Yet, I had been informed by XXXX that the XXXX XXXX accounts had been closed months earlier. Needless to say I called XXXX anyway, and was immediately routed back to XXXX at ML. *If my accounts are not grandfathered then it would appear that BOA has broken not one, but many laws pertaining to the Bank Secrecy Act. *With the exception of a couple of days in XXXX, we have not had access or control of the BOA accounts since the week after opening them, nor any other accounts. *During this past year, we have been told repeatedly that we needed to verify our IDs. We have done this in several states. I have verified in Utah, California, Nevada, Arizona, and Georgia. My mother has in Utah and Georgia. *I always used my birth name on my current government ID, as does my mother. And even though the accounts are under the name BOA assigned me, I get verified. *You might be asking yourself why it has taken me until XXXX of XXXX to call, it didn't. I spent the last year doing everything I could to get this fixed, while constantly having to deal with the fallout of what it has caused. And quite honestly, I had to calm down and get back to a place where I know that the person on the other end of this phone is probably seeing this for the very first time. I have over 22 years of experience with this, because I have been dealing with banking issues caused by this in one way or another since my late teens. I had to get back to a place of calm, so instead of getting angry, we can get some solutions. *Because of these issues we decided to revisit our relationship with BOA throughout the years, as we now see this did not start in XXXX of XXXX, when BOA closed my accounts in XXXX, falsely saying it was per XXXX XXXX request. Also, XXXX 's accounts were closed in XXXX without his request. Creating non-unique problems every time.

Issue: Fraud or scam

Subissue:

Consumer Complaint: Three months ago in late XXXX which is the time after graduation, I received a call from XXXX saying that they found out there is a phone number under my name that keeps sending fraud messages, in order to keep my personal credit, I need to prove that this is because someone is using my information to register that phone number. So she connected my call to a XXXX police, who is a scammer. And the police initially pretended to help me with the phone number, and he also make another call for the upper office to see if there is any other card under my name. And the upper office says Ive been involved in a secret international money laundry case, where someone stolen my information and there are already victims sending money to my XXXX XXXX XXXX bank account. So the police asked me to download XXXX and show me his police number and card and he send me some case information. He asked me to report my safety to him every several hours and not allowed to go outside. After several days, there is another person who pretend to be the Attorney general, he said he need to arrest me for 90 days to gather information and evidence until approving my innocence. So I was totally panicked, and they send a file XXXX which contains my past driving license and also my past hotel living history and travel history. So I was totally shocked The police said that from his perspective Im a good person and hes willing to use his job as an insurance for me to stay in US until the case being closed. But for that, I need to put some money in the XXXX XXXX bank for approving that I will not escape. So I transferred XXXX dollars for the first time, and they asked me to report 2 days before if I want to go outside. After several days, they said the victims are so angry why I dont need to go back to XXXX to solve this, so they raised a case upon me, in order to prove to them that I dont have that intention, I will need to further prove XXXX dollars and once the case is over the money will be send back. Tracing back this is a huge lie but I was too shocked and dont dare to tell anyone because this is a secret case. And they asked me for the final XXXX dollars for the lawyers fee. I was a little bit scared and dont dare to tell my parents since they provide the first two rounds of money and for the last round I use my salary and some money borrowed. I was so desperate like several weeks ago. The scammer 's phone number is : XXXX XXXX I already file a claim to Bank of America about this fraud and my claim number is : XXXX. Also the FBI and XXXX local police and XXXX police. Please help me I really really need your help really, I feel so hopeless and don't know how to live right now. Please help me with my bank please

Issue: Problem with a purchase shown on your statement

Subissue: Credit card company isn't resolving a dispute about a purchase on your statement

Consumer Complaint: I was issued a new credit card by Bank of America. According to e-mail correspondence from BofA, this card was mailed on XX/XX/2023. To my knowledge, I never received this card. On XX/XX/XXXX and XXXX, XXXX transactions were charged to my card ( for {$870.00} and XXXX, respectively ) that I did not make. These transactions were flagged by Bank of America as suspicious ; I received alerts from BofA via their mobile app, and promptly called their fraud hotline to report the transactions. BofA issued a temporary credit to my account for the fraudulent purchases and promised to investigate the claim. I put the matter aside, confident that the things would be resolved in my favor : I did not make these purchases, I have been a BofA customer for over 25 years, and have not made a single fraud claim during that time. On XX/XX/XXXX, I received a decision from BofA, stating that they would not credit my account for the fraudulent purchases. After piecing together the sequence of events, it is my belief that the card in question was intercepted en route to me and was used fraudulently. I am disappointed that what appeared to be a relatively straightforward case of credit card fraud was not resolved in my favor and that I now have to appeal the decision, which is stressful and time-consuming. If this matter is not resolved promptly to my satisfaction, I will no longer bank with BofA.

Issue: Attempts to collect debt not owed

Subissue: Debt was result of identity theft

Consumer Complaint: XX/XX/XXXX I received a notice that the FTB was going to place a levy on my account. I called and left a email and spoke to someone on bank of america side to let them know I want to know who furnished my information without my consent> I never allowed any non 3rd party to furnish any of my information and to top it off. I did not allow or consent to access my bank of america account. So, I learned the bank of america and franchise tax board stole and furnished my information let alone offer and steal my id and come in and allow a collection agency to steal my funds. They said they took money that i owed. THERE IS NO MONEY and why are they impersonating me and allowing anyone to come in and take my property. I now can not pay my mortgage because I was a victim of theft. please reinvestigate as I am a living woman and I need my funds returned and I want to place a claim of fraud on Bank of America and FTB. Now my water is shut off because FTB and BOFA committed id theft and stole my credits and securities in my account without my consent. I need to be compensated and they are causing tremendous harm and I have been violated. GO get them and have them refund and pay for damages along with a full accounting ledger for the on and off ledger. I am stressed, mentally screwed up, and I want to press charges for ID theft.

Issue: Incorrect information on your report

Subissue: Information belongs to someone else

Consumer Complaint: I am filing a compliant against Bank of America. Bank of America let someone pretend to be in XX/XX/XXXX. I tried to dispute the matter several times. Some odd reason that person hack into my saving and checking account that year to transfer it all into XXXX XXXX. My account was in the negative. Bank of America advised me deactivate my XXXX XXXX and reset my user name and password. Bank of America had issued me a temp credit. After they has done their investigation. Bank of America wanted to reverse the temp credit because my name was on the account. Bank was America had report me XXXX XXXX in XX/XX/XXXX. At first, I had refused to pay for something I didn't do at all. It was hard for me to apply for any personal or business checking account because of this situation. My attorney from XXXX XXXX send a demand letter to Bank of America on XX/XX/XXXX. He gave Bank of America 15 days to resolve the matter, no response from Bank of America yet. Bank of America held me responsible for {$6400.00}. After I paid for something I didn't do. I paid it in full on XX/XX/XXXX. Bank of America told me. I have 5 years to removed from the XXXX XXXX. If I had known, I would not paid a cent. Something I should not done anyway. I request a copy of the policy. They refused. I should not paid for something, I didn't do at all. Please you want removed from the XXXX XXXX. I want my {$6400.00} back and removed from the XXXX XXXX. I have provide them documents. Bank of America ripped so many customers off. Thats why they are constantly being sue for something. Be careful having any accounts with them. Bank of America is the largest bank of crooks.
