Consumer Complaint: On XX/XX/2023 I contacted Bank of America to report fraudulent use of my debit card with a consumer ( XXXX ). I was able to stop another transaction that was made fraudulently, however I was not able to stop the transaction in the amount of XXXX. Bank of America sent me a new debit card and I was given a temporary deposit of the money stolen. On XX/XX/XXXX we received a letter in the mail stating that our claim had been denied and that they would be taking the money back out of our account. Bank of America did just that and left my account negative on XX/XX/XXXX. Now, I feel as if my own Bank is stealing money from me and failed to protect my identity as well.

Consumer Complaint: XX/XX/23 - Receive later from BoA that they are closing an account I was never aware existed and that they will be reporting the account which will impact my credit score. I call BoA and report the fraud and they mail me a fraud claim form. XX/XX/23 - I call number listed on fraud claim form ( XXXX ) and request an email address to send form. They provide me with an email and I send claim form and requested documents the same day. XX/XX/23 - Submit complaint to BoA because they have still not resolved the fraud issue despite me submitting claim form and requested documents. XX/XX/23 - Get response from XXXX XXXX at BoA asking me to contact them about complaint. XX/XX/23 - Call BoA, sent right to voicemail. Leave message asking them to contact me about fraud claim. XX/XX/23 - Get call back from BoA asking me to resubmit documents because XXXX is going on vacation next week and needs them right away to close the matter. I resend claim form and requested documents immediately upon ending phone call. XX/XX/23 - Receive email from BoA that account that is still under complaint is overdrawn and they are going to destroy my credit and still hold me liable for the overdrawn balance in an account I didn't authorize to set up or authorize a single transaction that took place. I send email to XXXX XXXX at BoA explaining the situation and requesting a little more urgency be placed on my case. XX/XX/23 - Receive another threatening email from BoA that if my account isn't fixed in 20 days my credit will be damaged and I will be liable for amount due. Still have not received any response from XXXX XXXX at Bank of America despite sending documents XXXX and a half weeks ago and sending follow up about the urgency. Call XXXX and leave voicemail to please, please make this urgent so I don't need to waste more time on this if it impacts my credit. I am getting XXXX responsiveness from the bank.

Couple days later after buying material and stuff with that money the check bounced and Bank of America did nothing about it. They told me i had too pay that money back. It doesnt make sense for me too pay that money back when they put the money in my account too use and then force me too pay which I already paid them that money back. Why not hold the check till funds clear and then put it in my account?

Consumer Complaint: This is in response to your letter dated XX/XX/XXXX. You stated in your letter you were under no obligation to accept this modification offered by Bank of America in XXXX. It took Bank of America XXXX to review my request for modification, but only gave me few days to sign and return the modification documents. Bank of America put pressure on me to sign by giving me limited time and stating that foreclosure sale date was set for XX/XX/XXXX. I did sign the modification without getting any legal advise and under duress. XXXX ) Even if the loan/property was originated as investment property in XXXX. I had informed Bank of America that XXXX XXXX XXXX XXXX CA XXXX is owner occupied primary residence in XXXX of XXXX. This notification was done several times over the phone and in writing via fax that Bank of America also have in their records ( see attached ). The fact is that Bank of America knew that XXXX XXXX XXXX was used as owner occupied primary residence in XXXX but fail to process the modification under XXXX or XXXX program. Bank of America keep delaying the modification request by losing the documentation or claiming correct documents were not received for months. I had several conversation in XXXX & XXXX with Bank of America representative who keep giving me run around. XXXX ) For Loan number ending in XXXX you mentioned it was approved for Bank of America loan Modification. Can you please provide me complete copy of the Guideline/rules under which this loan modification was approved. XXXX ) At this time I am requesting Bank of America provide me copies of all the notices and statements required under the law ( TILA, RESPA, XXXX & XXXX XXXX ) since the origination of the loan till today on loan number ending in XXXX. XXXX ) I am also requesting Bank of America to provide all the notes and documentation regarding my loan ending in XXXX including but not limited to loan modification or short sale request in XXXX & XXXX. XXXX ) I have reported this account under dispute and under FDCPA it should not be reported delinquent until the dispute is resolved, since it will also be violation of Regulation Z. Bank of America should also refrain from threats of any kind including but not limited to Foreclosure of my home. Consumer Complaint: My card was hacked and funds were stolen off my debit card XX/XX/XXXX of XXXX, while I was at work the entire day. In XXXX XXXX, When I got off work to try to get gas my transaction was declined, I tried a lesser amount because I needed gas but I knew I had just added funds to my debit card. I called my bank to see why my card was denying, and to my surprise all my funds had been used in my account. The money that was taken off my debit card was all the money I had to my name. I submitted a dispute to the bank immediately. As soon as I called them the representative told me my card information had been stolen from the atm I had just deposited Money at. He also told me that my card was used at multiple stores in XXXX XXXX XXXX. The money I deposited in my account was all money I had to my name and the bank is now denying my claim. school has just started I have no money to purchase my daughter clothes for school, no money to survive until my next pay check and the bank is saying my claim is closed and they will not return the funds back to my account. They have information that shows my card was used at multiple locations all while I was at work in an entirely different city. I put my money in the account thinking it was safe now I am out of almost XXXX dollars, please reimburse me my funds! I need my money! Please explain to me how you came to a decision to deny my claim when I had nothing to do with my money being stolen of my debit card! please re evaluate this case because I need my money! I have attached documentation to prove that I was at work the entire time the funds were being stolen off my debit card.I also attached the police report I made about the funds being stolen off my debit card.
