Consumer Complaint: According to XXXX, Bank of America states that my DATE OF LAST PAYMENT was XX/XX/XXXX. According to XXXX, Bank of America states that my DELINQUENCY DATE was XXXX XXXX, XXXX. The discrepancy between these two dates determines when this negative credit report will be eliminated from my credit history in XXXX. I filed an XXXX dispute with Bank of America over this issue. XXXX XXXX # XXXX. Bank of America replied that their DELINQUENCY DATE is not the same as the DATE OF LAST PAYMENT. They insisted that the start date for my seven years is their DELINQUENCY DATE, not the DATE OF LAST PAYMENT. I believe the DATE OF LAST PAYMENT and the DATE OF DELINQUENCY should be the same date. Otherwise, Bank of America can arbitrarily assign any DATE OF DELINQUENCY they wish, and consequently elongate the 7 year period a consumer must wait for the negative report to be eliminated. This is exactly what Bank of America is doing. How can the law allow Bank of America to assign any DATE OF DELINQUENCY they like, at their whimsy, without restrictions or safeguards to protect the consumer?
