Consumer Complaint: On XX/XX/XXXX I noticed that {$200.00} was taken from my personal savings account. I called Bank of America customer service number right away and asked what it was for. Eventually I was told that it was a offset payment taken for my business credit card that was in default. It was closed as was my business checking account because I have not made money with that business to date. After a few transfers I spoke with someone about setting up a payment plan and had to see if I qualify to make under {$50.00} per month payments. She took my information and said I qualified for {$48.00} per month and that I needed to make my first payment within 30 days or the payment plan would be denied. I asked her about the {$200.00} money they took from my savings account and she said that normally they don't refund an offset but considering it was my rent money, she would escalate it up to a supervisor. I waited till Saturday XX/XX/XXXX and called because I didn't hear anything about whether the money would be returned or not and the money was not back in my savings account. The lady that I spoke with said she had in the system that I would be getting the money deposited in my account on Saturday. I said ok, today is Saturday! She said yes, give it to the end of the day. I did and still no {$200.00} was returned to my savings account. It was not returned on Sunday XX/XX/XXXX, Monday XX/XX/XXXX and on Tuesday XX/XX/XXXX it still was not in my savings account. I called the BOA customer service number and asked to speak with someone in the Business credit card offset department. After I got transferred 1 or 2 times, the lady said that she did not see where I had made any payment plans. I told her when I called on XX/XX/XXXX that I made the payment plan for {$48.00} per month and I would like to speak to her supervisor ; she transferred me again. This time I spoke with XXXX XXXX. I told him everything again and he said they do not return offset money pulls. I said that's not what I was told when I called in on Saturday. He also said that I was told the {$200.00} was a down payment for the payment program I was entered into. I was never told that it was a down payment. I was told the issue, my request, would be escalated to a supervisor for approval since that was not a decision she could make. Also told him about the Saturday conversation but he kept saying no they will not return it. I asked to speak to his supervisor and he said it will be 24-48 hours and what was my phone number. I gave it to him and asked for all my " recorded '' messages to be sent to the supervisor too so they could hear the real conversation and not the falsely written notes from previous conversations. XXXX XXXX called me back about an hour later. I told him everything again too. He said that it is in the Terms and Conditions when I signed up and I asked him to email it to me and he said that I could look it up from when they emailed it to me. He said that in Texas they have the right to offset. Taking money from my personal savings account to make a business credit card payment does not seem right. Please advise!

Issue: Opening an account
Subissue: Account opened as a result of fraud
Consumer Complaint: On XX/XX/2023, a Bank of America XXXX account was opened using my nickname, old address, social security number and my birthday. I contacted Bank of America on XX/XX/2023 to notify them that this account was opened fraudulently. When I called, they did not close the account, they advised it would be marked as fraud and then researched. Since the information was sent to my old address. the people that live there contacted me to let me know that I received 2 letters from Bank of America. When I picked them up, one was the bank statement showing money that was deposited via XXXX and the BoA location that the money was withdrawn from. A few days later I received information that a case was opened and that I needed to provide a copy of my drivers license, a letter from the social security administration office and a bill showing my new address. I sent them a letter advising that I would not provide any of this information as they did not require the information to initially open the account. I also provided a police report and the statement showing the BoA location that the money was withdrawn from. I repeatedly asked for someone to contact me but did not receive any communication. I contacted them on XX/XX/XXXX and spoke with XXXX in Maryland, he advised my information was received and it would take 90 days to research. In the mean time, I was still receiving account statements to my old address. Last week XX/XX/XXXX, I contacted them to ask them to stop sending the mail to the old address. When I called I spoke with XXXX in Tennessee, she told me that my case was closed and that they sided with me. When I asked them to provide additional information she told me that they don't really research where the money was deposited and withdrawn. They just verify I didn't open the account. When I asked how the account was opened when my credit is locked, She advised to contact XXXX because when they did the credit check XXXX didn't pass information to them that the credit was frozen. ( side not, I can't even open an account without unlocking with the credit companies ). I contacted XXXX and they advised BoA never did an inquiry with them. I contacted BoA again and asked for more information. I spoke with XXXX in Tennessee, I informed them that XXXX was never contacted to open an account. She was dumbfounded and told me that she would send me documentation showing how the account was opened and what information was used. ( I have yet to receive that information ) She then sent me to the BoA New Account to talk to someone about how accounts are opened. ( I still don't understand how the fraud department doesn't know that ). I spoke with XXXX in the New Account department. She was dumbfounded as well on how the account was opened if I have XXXX in place. She then sent me to the Online Account department. I spoke with XXXX in the Online Account department who told me they don't use XXXX to open accounts they use XXXX XXXX XXXX. She provided me with their phone number. I am still awaiting information from them on what information they have on me that would allow BoA to open an account using my information. This took 2 hours and 8 minutes of my day. They continue to send letters to my old address even though I specifically told them not to.

Consumer Complaint: Bank of America closed my account on Friday XX/XX/XXXX and they have a pending closure date of XX/XX/XXXX. I was have not able to pay my late rent or car note because of this. I have not been able to provide food for my family. They have been giving me the run around as I explained that I need my money from this account to take care of my small children and pay my bills. I called them everyday XXXX and XX/XX/XXXX and they still dont know when I will get my money. I explained this is creating a hardship and may cause me not to be able to pay my rent next month. They told me it could be 10 business days for them to even review my hardship withdrawal request. This is ridiculous. I had XXXX direct deposit from my employer go into this account on XXXX and they wont give me my money. Since I have not been able to get my money when they have the ability to allow me to withdraw my funds from the branch and close the account.

Consumer Complaint: Over {$2200.00} was " defrauded '' from my account when I received an phone call from an authorized Bank of America call XX/XX/2022. I was convinced by the CSA to move my assets to another account because I had received another authorized text from BOA that I was going to have a XXXX transfer of {$3500.00} that same night. I deleted that text and received another XX/XX/2022. I was duped, scammed, whatever you'd like to call it. I called the real Bank of America and got no results. As a matter of fact, I was denied so fast it was insulting. Then I received a phone call from their escalations department and was told that clients like myself had been getting " defrauded '' consistently. And BOA, could do nothing to stop it. They found where the money went and closed the account, allegedly. Some fictitious account that belonged to XXXX XXXX. Another bank that has been in hot water alongside BOA. I need help resolving this matter and want whoever was responsible held accountable.

Consumer Complaint: I made a purchase of a seat upgrade at XXXX XXXXXXXX on XX/XX/2023, which posted XX/XX/2023. Per the terms and conditions, this purchase is covered by an annual Airline Incidental Credit offered by the Bank of America Premium Elite Credit Card. This charge was not credited by the automatic system, despite meeting all of the requirements of the terms and conditions. When I called the number on the back of the card, I was advised that the BoA personnel had no access to these credits and made a number of incorrect claims about the credit - that it had something to do with XXXX XXXXXXXX ( confusing this product with the co-branded XXXX XXXXXXXX card ), that there is some submission process for these charges with the travel/concierge team ( there is not ). I asked for the call to be escalated because BoA 's failure to appropriately credit their advertised benefits is an Unfair, Deceptive, or Abusive Act or Practice ( UDAAP ). The manager was similarly unable to access any part of the system related to this benefit. The manager referred me to the travel/rewards team, who was unable to access anything to do with these credits. That team then transferred me to the benefits team, who also knew nothing about these credits. That person then referred me back to the main BoA credit card phoneline, where I had started.

Consumer Complaint: My original complaint about Bank of America ( BoA ) was closed prematurely by CFPB with no response from BoA and the issue is still unresolved. My original complaint about BoA : I was based and worked in XXXX XXXX for XXXX from XXXX until my retirement in XX/XX/XXXX Before I left XXXX, I cleared ALL my debts and closed all my accounts including credit cards at Bank of America. However, despite asking that all my accounts to be closed and " allegedly '' closed, I discovered In XX/XX/XXXX that BoA is still charging my accounts with monthly " bank fees ''. In XXXX I spent close to {$100.00} in phone calls to BoA customer service to ensure that my accounts were closed. They allegedly " reversed '' these fees stating that was an automatically generated " system issue '' and that they would pass on the information to the appropriate department. I refuse to spend any more money contacting BoA due to their lack of customer service, diligence and banking compliance. I am now back in XXXX XXXX since XX/XX/XXXX and discovered that BoA has been charging my allegedly " closed accounts '' Monthly bank fees for XXXX and XX/XX/XXXX. ( refer to attached Screenshots and copy of email ) In my bank account, it has an overdrawn account balance of - {$24.00}!! In my case, they are deliberately " failing '' to close my accounts. I have already sent by mail XXXX official letters to close the accounts. Although being in XXXX XXXX I could " ignore '' them. However, I would do so at my own peril. Left unchecked, these unpaid bank fees will eventually attract default payment fees, referral fees to bailiffs and the likes eventually Courts fees added to the lot with a warrant to arrest should I ever put a foot in the XXXX ( or even transit via the XXXX ) with the outstanding amount totalling thousands of XXXX Dollars for XXXX individual. I would be grateful if your office could address and expose the bank 's rot at the expense of the average consumer. Thank you for your time and consideration. XXXX XXXX ( XXXX )
