Consumer Complaint: I have boa credit card - XXXX XXXX XXXX XXXX - i consolidated credit from another credit card in XXXX by paying full as it has higher interest and credit limit was transferred to this credit card. My credit limit was XXXX - and i have been making minimum payments and using this credit card from past 1 year. This acct has been open since 15 years. BOA reduced my credit to XXXX as it is lower fixed interest rate credit card. Also they did not pay me the better rewards balance on all of my 4 credit cards that I have. I am supposed to get XXXX $ for all 4 of them after they forcibly transferred to another unlimited cash back rewards credit cards without my consent.

Consumer Complaint: Wednesday night ( XX/XX/XXXX ) at around XXXX XXXX I went to an ATM near my old residence to deposit some money, I was moving to my current address, I sold some furniture, I had some cash with me as well and to my security guard decided to deposit it so as not to travel on XXXX XXXX with this money in cash. I didn't count the amount because normally the ATM itself does this, I just followed the steps and inserted my money, then an error screen appeared asking me to enter an approximate amount that was being deposited, so I did some calculations and thought it was around of {$1600.00} and typed that, then a second screen saying to contact the bank as soon as possible if I disagreed with the amount that would be deposited ( I have a photo of both screens ), only {$300.00} was deposited ( I have the receipt saved, where on it contains a message saying that there was an error with the ATM ) so I did it, I called the number that appeared but only robots spoke to me, at that time of night there was no human representative to solve my problem, I felt nervous and anxious and I couldn't sleep right. I woke up the next day and first thing in the morning I called the bank, they told me that I would have to make a claim, so I did, and explained that I was moving and could not be without that amount of money at the moment, she said that They would evaluate the case and if possible, they would release a credit within 2 business days, 2 business days passed and the credit ( which is actually MY MONEY ) was not deposited, so I came to an agency close to my current address in XXXX, CA. and the attendant told me that there was nothing to do (?! ) and that I should wait. So I called the bank again, to talk about Claim number XXXX, and explain that I needed my money, I was treated with contempt by the attendant and I was furious, so I said I would go to the police and contact a lawyer. The lawyer informed me that before I went to court I could make a complaint on this website and here I am.

I am appalled by the actions of Bank of America and its agents and of the repo company, XXXX XXXX XXXX XXXX XXXX and its agents, which have not only breached our contractual agreement but also treated me in an extremely unjust and unethical manner. There is no longer a debt and I have proof of that. My SUV was repossessed without any prior warning or legal justification on XXXX XXXX. This action is a violation of our contract and a breach of the trust I have placed in Bank of America and its agents as my financial institution. This is a clear reporting error on behalf of BANK OF AMERICA and its agents and violation of these Consumer Protections. Furthermore, the conduct of the XXXXXXXX XXXX XXXX XXXX XXXX and its agents during the repossession was completely unacceptable. Not only was my vehicle seized without providing me an opportunity to remedy the situation, but I too was refused access to my personal belongings within the SUV. This caused severe inconvenience and distress, as I had important documents, personal items, and valuable possessions in the vehicle at the time of repossession. The repossession of my SUV was unjust and has caused harm to me. The actions of Bank of America and its agents and XXXX XXXX XXXX XXXX XXXX and its agents are in violation of the terms of our agreement and the laws governing such procedures. As a result of these harmful actions, I have suffered financial losses, emotional distress, and a significant disruption to my daily life. I am requesting the following actions to address this matter : Immediate Return of My SUV : I demand the immediate return of my SUV, as it was unlawfully repossessed without proper lawful grounds. They stole it out of my driveway, XX/XX/XXXX. Access to My Belongings : I demand access to my SUV to retrieve my personal belongings, documents, and valuables that were in the vehicle at the time of repossession. I expect these items to be returned to me without any further delay or inconvenience. Compensation for Damages : I demand compensation for any financial losses, emotional distress, and inconvenience caused by the unauthorized repossession and the actions of XXXX XXXX XXXX XXXX XXXX and its agents. Investigation and Accountability : I demand Bank of America and its agents to conduct a thorough investigation into the circumstances surrounding this repossession and take appropriate action to hold those responsible accountable for their actions. I demand that Bank of America and its agents take my complaint seriously and address this matter promptly and fairly. I trust that you will take the necessary steps to rectify this situation and restore my faith in this institution. I expect a prompt response to this complaint within three ( 3 ) days of receiving this letter. If my concerns are not addressed satisfactorily, I may have no choice but to seek legal recourse to protect my rights and interests. Here are the potential consumer protection laws that may have been violated : Uniform Commercial Code ( UCC ) : The UCC is a set of laws that govern commercial transactions, including vehicle loans and repossessions. A breach of the UCC may occur if the repossession was not conducted in accordance with the terms of your loan agreement or if there was a lack of proper notice. UCC Article 9 Fair Debt Collection Practices Act ( FDCPA ) : If XXXX XXXX XXXX XXXX XXXX and its agents are considered debt collectors, they may be subject to the FDCPA. Violations of this law could include engaging in unfair or deceptive practices during the repossession process, failing to provide required notices, or refusing to allow you access to your belongings. 807. The Truth in Lending Act ( XXXX ) is a federal law that requires lenders to disclose the terms and costs of credit to consumers. XXXX aims to protect consumers by ensuring that they are fully informed about the costs and terms of their loans, and that they are not misled or deceived by lenders. XXXX requires lenders to provide consumers with a written disclosure statement that includes the annual percentage rate ( APR ), finance charges, and other important information about the loan. XXXX also gives consumers the right to cancel certain types of loans within three days of signing the agreement, and requires lenders to provide consumers with a notice of their right to cancel. However, its important to note that TILAs disclosure requirements for loan costs and terms do not generally apply to small business owners or entrepreneurs obtaining credit for commercial purposes, leaving commercial borrowers at risk. False reporting is a violation of this act. Fair Credit Reporting Act ( FCRA ) : If the repossession was reported to credit bureaus inaccurately or without proper notification, it might constitute a violation of the FCRA. State Consumer Protection Laws. You, ( BANK OF AMERICA and its agents ), are describing this account type as a loan when in fact the alleged agreement is known by its governing laws as a credit sale. There is no loan agreement in place. No goods or money have been loaned to the alleged debtor. It is a direct violation of the FCRA to knowingly furnish or report false information. Please correct or delete this item within the time allowed under the FCRA. Repossession should have never taken place. Please release this vehicle to me, XXXX XXXX XXXX. You, ( BANK OF AMERICA and its agents ) have violated the FDCPA by mischaracterizing this alleged debt in your attempts to collect. Consumer Complaint: My credit card ( Bank of America XXXX XXXX XXXX XXXX ) has been the subject of fraudulent activity over the last 8 weeks. I have had three new cards issued, and there have been several fraudulent transactions not authorized by me, with consistent merchants, one of which being XXXX. I became aware of a feature known as XXXX XXXX XXXX XXXX XXXX or " XXXX '' and I believe this service has contributed to the fraudulent activity being perpetrated at my expense. My understanding is there are several merchants, who keep my credit card information on file ( XXXX ) and these merchants benefit from XXXX, which updates them with new credit card detailed information ( such as number and expiration date ) as I have new credit cards issued. I believe there is a link between this XXXX service and the scammer 's performing the fraudulent activity. When I requested that BofA opt me out of the XXXX service, they said they could not. I was able to locate a merchant list for the XXXX program, and I am cross referencing the merchant list with merchants on my credit card statement, however I am not sure how best to address these concerns with each an every merchant. This seems like something which should be researched to protect consumers.

Consumer Complaint: First, I reported the following : As happened in XXXX, I received a prepaid Visa card from XXXX XXXX because I am a part of a study they are running on behalf of the XXXX. This time, I received twocards, not just one. I tried to set up the two card per Bank of America 's instructions, and at first I was sent to an account I already had on their prepaid card site, and when logged into my account there, I was offered no option of adding these two new cards. Instead, I had to set up two more accounts, one for each of these new cards.So, once again Bank of America is working as hard as it can to deny people the ability to use these prepaid cards. For a total of {$50.00}, I now have three Bank of America Prepaid card accounts, with individual usernames and passwords. Seems like intentional obfuscation to me. Oh, and for that first card that they tried to charge me for activating, despite the fact that their system wasn't even working properly at the time, they continue to send me spam emails, reporting that there has been no activity on a card that I exhausted the available balance well over a year ago, heading towards two years now. Please, hold these XXXX accountable for pulling these kinds of stunts. If I had a credit card with Bank of America, which I once had until I closed because of the bank 's predatory practices, it was easy for me to set up a single account for my checking, savings, and credit card account, which amazingly were all associated with one and only one account. Bank of America should be required to do the same for these silly prepaid cards. If they are allowed to sell these items into the marketplace, they should be required to make it easy to both manage them and use them. And for the record, they should not be allowed to issue one-time use, plastic cards. If they are going to issue plastic cards, those cards should be required to be ones that people can add value to if they want to do that. That would be in keeping with good environmental stewardship, which the US federal government should be promoting. Finally, I want to thank you folks for holding Bank of America accountable for all the XXXX fees it was charging people. Now, they no longer charge if someone needs to call in to activate one of these silly cards. So, there is progress here ; but not enough. Too Big to Fail Bank of America is still taking advantage of consumers with its prepaid cards, and that needs to be stopped. I am also on a drug trial at XXXX XXXX, and amazingly I get a prepaid card from those folks every month. I don't have to set up an account to use those XXXX cards, and itis easy to find out the balance left on them online. So, if one company can do this, Bank of America can do it too. I now have three accounts on the Bank of America prepaid card site, all with distinct usernames and passwords. I was forced to offer Bank of America security question answers three times now. That is total XXXX, and should not be allowed. That is abuse of consumers, period, end of sentence. After I reported that to the CFPB, Bank of America did something to make it impossible for me to use either of the two cards. I had a balance of {$4.00} on one and the full amount of {$15.00} on the other, and now I can't use any of that money. I know, because I tried to move the money from the cards to my gift card on XXXX, and the transactions were blocked by Bank of America, despite the fact that I registered both of the cards. I just got off the phone with a Bank of America representative, who called as I was on hold, waiting to speak with an IRS agent about another matter ; and all that person was doing was calling me to " establish communications. '' He also claimed to know nothing about my two cash cards being canceled. Also, folks should know that the CFPB doesn't allow a person to update complaints. They will now cancel my first complaint, and I will start all over again, with some XXXX from Bank of America calling me to " establish communications. '' I'm really over both the predatory practices of big banks in the US, and with my federal government treating my time and energy as of absolutely no value whatsoever. CFPB, you have a lot of work to do to make yourselves " consumer friendly, '' so maybe you should take a look in the mirror and change the way you interact with the public.
