Consumer Complaint: I received a notification on the XXXX around XXXX XXXX that someone head looked up my Bank of America user ID and changed my password. My phone was misplaced/stolen on the XXXX of XXXX and I believe they used apps/information to hack and drain my bank accounts, they started transferring money from my main checking account ( ending in XXXX to my other checking account ending in XXXX ) taking out large sums of money/ completely draining my accounts in the total of {$17000.00}. They were made to a company called XXXX XXXX which I had used previously however NEVER made a transaction over $ XXXX. The XXXX XXXX XXXX XXXX, etc were all on my phone. They used XXXX XXXX to send my money to some crypto wallet depleting my account of funds within a couple of hours of password change. I let BOA know as soon as I was made aware and I was told that she could tell someone had stolen my identity and made these transactions fraudulently. These charges that were made from XXXX to XXXX. These charges were very alarming because they were all in LARGE sums of money.= thousands of dollars in each transaction and completely drained my main checking to transfer into an account they were able to make transactions/withdrawals out of. The account they transferred money over to ( was hardly ever used prior ) and the debit card was saved to stolen phone. I have attached claim details along ( however if BOA can update me that someone looked up my user ID and password and then changed password they NEVER should have allowed transactions to go through ), along with message to original company that refused to refund transactions. In fact they replaced to my email update regarding fraudulent activity stating they had never confirmed my identity verification and my drivers license required to withdraw these funds... and that is because I NEVER GAVE CONSENT not did i authorize these transactions. I was told by BOA that they would research claim and was later denied claim/closed out.

On XX/XX/2023, my credit card balance was {$100.00}, and I paid it in full at the Bank of America XXXX located at XXXX XXXX XXXX XXXX. XXXX. I paid {$100.00} through an ATM and {$2.00} through a branch payment. The clerk was rude but assured me that I had a XXXX balance on the credit card. However, on XX/XX/2023, I noticed that my credit card balance was {$1.00}, and interest was charged for a XXXX balance. On XX/XX/2023, Bank of America aware of the missing funds, multiple account changes made by the bank, and complaints that were not addressed. Bank of America aware I had filed XXXX complaints with the Consumer Financial Protection Bureau, yet, Bank of America chose to close my account ending in # XXXX. When I called Bank of America on XX/XX/2023, and spoke with an agent named XXXX from XXXX, she stated that all information regarding my account ending in # XXXX was deleted. This is fraud. Bank of America can not ignore complaints, remove money from accounts, and then close the account stating non-activity and/or non-funds. I will file a complaint against Bank of America for ignoring my XXXX complaint against a dealership ( truck ). The truck was paid in full through my savings account, yet Bank of America allowed monthly charges and then changed the account without accountability. Note : I can provide documents if requested of me.

Consumer Complaint: XX/XX/2022 I went for a temporary subscription to a site called XX/XX/XXXX for {$1.00} then attempted thru email to CANCEL the " subscription '' before the trial expiration date - they refused to do so... so I contacted b of a by email - no response - then contacted them by phone and they said they were going to BLOCK this fraudulent actor - month after month after month ... I kept getting b of a alerts that their fraudulent attempts were denied - even though BLOCKED usually means blocked ... whatever ... I guess that's their way of doing it? I haven't used that card since then or close to it I had no reason to believe that this fraudulent actor would ever be able to do it again Inadvertently ... because I was saving & sending statements to debt management ... I started to notice that the fraudulent charges eventually started to make it thru to my account Recently... I spoke to a phone rep that said he would put those in dispute and change the card number so they could no longer do that b of a sends me a letter stating that the fraudulent charges are valid and that they were crediting me {$40.00} from just short of {$400.00}

Issue: Managing an account

Subissue: Deposits and withdrawals

Consumer Complaint: I am a first-year international XXXX XXXX at XXXX University ( please refer to Attachment 1 for proof ). I opened both a savings and a checking account at Bank of America ( BoA ) on XXXXXXXX XXXX XXXX, with the intention of using these accounts to manage my university stipends and cover my daily expenses. However, things did not go as planned. On XXXX XXXX, I received a paper check for my first month 's stipend, totaling {$6600.00}, from XXXX University ( please see Attachment 2 for my funding letter and Attachment XXXX for my paystub ). I deposited this check at a BoA ATM. Unexpectedly, on XXXX XXXX, I discovered that my accounts had been locked ( please refer to Attachment 6 for my transaction history ), and all my deposited funds were frozen. Concerned, I visited a BoA branch the next day to inquire about the issue. A specialist informed me that BoA had decided to close my account, suspecting that the check I had deposited was fraudulent. To substantiate my claim, I provided BoA with the front page of my check ( Attachment 2 ), confirming that XXXX University had indeed issued a legitimate check to me. However, when I revisited the branch on XXXX XXXX to follow up on my case, I was informed that their decision to close my accounts was final, and my check was still under investigation, which would take less than 1-3 months. Furthermore, they could only return the check to me if their investigation determined it to be genuine. As of today, the entire balance in my checking account, amounting to {$6800.00}, remains frozen by Bank of America. All the funds in my account are legitimate, and the check I received was issued to me by XXXX University for my stipend. Given these facts, I have no idea about why BoA chose to freeze my funds and close my account. Their actions are entirely baseless and have had a significantly adverse impact on my life. I hereby demand the following actions from BoA : 1. Swiftly restore access to my accounts. 2. Release the frozen balance in my checking account without delay. 3. Given that this situation arose due to BoA 's errors, and I have not engaged in any fraudulent activity, I insist that this case should not have any negative impact on my credit history. Attachments : ( 1 ) My XXXX University student ID ( 2 ) My funding letter from XXXX University ( XXXX ) My paystub from XXXX University 's portal ( 4 ) The front page of the check from the Trustees of XXXX University ( 5 ) Photographs of the check ( 6 ) My transaction history, provided by the Bank of America XXXXpecialist.

Issue: Attempts to collect debt not owed

Subissue: Debt was result of identity theft

Consumer Complaint: I received the attached debt collection letter from the local law firm of XXXX XXXX XXXX XXXX XXXX, falsely claiming that I had an account with FIA Card Services and owed them {$12000.00}. The letter asked for a response before XX/XX/XXXX and also pointed me to the CFPB website to learn what my rights are. I will send a letter to this law firm denying their false claims, but first wanted to file this complaint after reviewing what the CFPB can do, because I am concerned with the age of this fake debt ( 14 years ) and that it is being pursued anew. I am glad I kept records of the difficulty I have had over the years relative to clearing serious identity theft. Attached are police reports affirming that I was indeed the victm of identity theft on multiple occasions over 20 years ago. I continually had to fight new charges or new accounts that would pop up and did not belong to me. In early XXXX, I worked with a reconciliation representative of Bank of America ( B of A ) to go through XXXX accounts to determine what was my debt and what was the additional debt caused by identity theft. We came to an agreement of XXXX different amounts and I authorized B of A to deduct those funds from my bank account. They sent me XXXX confirmation letters stating nothing further was owed, also attached. But a third B of A account also appeared in XXXX. They alleged I had their " World Points '' credit card ending in # XXXX ( see statement sent to me ). None of the $ XXXX owed was my debt. I never travelled at the time and received no financial benefit from this travel card. I contacted the same reconciliation department who determined that B of A could provide me no written proof that I had ever personally applied for their " World Points '' promotion. Therefore, B of A was not authorized to deduct funds for this debt. It appears FIA Card Services bought the old XXXX Bank of America credit card account ending in # XXXX, and hired the XXXX law firm to falsely claim the debt was originated from them. Again, I have never had a FIA credit card and am disputing I owe them any money whatsoever.

Issue: Attempts to collect debt not owed

Subissue: Debt was result of identity theft

Consumer Complaint: I noticed an account on my credit reports from a company called BANK OF AMERICA that I never had any business relationship with. BANK OF AMERICA was attempting to collect on a an alleged debt in the amount of {$15000.00}. I have had my identity stolen and sent BANK OF AMERICA a letter via certified mail XX/XX/2023 notifying them about this fraudulent account including a copy of my Identity Theft report asking them to please delete the fraudulent account from my credit reports. I also disputed this fraudulent BANK OF AMERICA account with the credit bureaus. BANK OF AMERICA however continued reporting this fraudulent BANK OF AMERICA account with the credit bureaus. XX/XX/2023 I noticed BANK OF AMERICA still reporting this fraudulent BANK OF AMERICA account with the credit bureaus. I then sent BANK OF AMERICA a DEBT VALIDATION LETTER via certified mail XX/XX/2023 requesting the agreement between BANK OF AMERICA and myself and the original application for the account. BANK OF AMERICA violated the FCRA 15 U.S.C. 1681g ( d ) by failing to provide the evidence requested after being notified about the identity theft. FCRA 15 U.S.C. 1681g ( e ) states .... a business entity that has provided credit to, provided for consideration products, goods, or services to, accepted payment from, or otherwise entered into a commercial transaction for consideration with, a person who has allegedly made unauthorized use of the means of identification of the victim, shall provide a copy of application and business transaction records in the control of the business entity, Pursuant to the FDCPA 15 U.S.C. 1692g ( b ) BANK OF AMERICA was required to cease collection efforts until the alleged debt was validated but failed to do so. BANK OF AMERICA continued reporting the alleged debt to the credit bureaus in its attempts to collect on the alleged debt thereby violating the FDCPA 15 U.S.C. 1692g ( b ). I saw the fraudulent BANK OF AMERICA account XXXX, XXXX and XX/XX/2023 on my credit reports. I then sent BANK OF AMERICA a FAILURE TO RESPOND letter via certified mail XX/XX/2023. XXXX XXXX XXXX violated the FDCPA XXXX XXXX. XXXX ( XXXX ) In its attempt to collect on an alleged debt by falsely representing the character, amount, or legal status of any debt. BANK OF AMERICA violated the FDCPA 15 U.S.C. 1692f In their attempts to collect on the alleged debt by collecting an amount that was not expressly authorized by an agreement creating the debt or permitted by law. BANK OF AMERICA violated the FDCPA 15 U.S.C. 1692g ( b ) by not ceasing collection efforts until the debt was validated. Case law is well settled that reporting an alleged debt to the credit reporting agencies is " an attempt to collect on a debt ''. Pursuant to the FDCPA 15 U.S.C. Additionally, BANK OF AMERICA FAILED TO RESPOND to the DEBT VALIDATION LETTER within 30 days causing me to send a FAILURE TO RESPOND letter via certified mail XX/XX/2023. BANK OF AMERICA violated the FCRA 15 U.S.C. 1681i by not validating the alleged debt within 30 days. I saw the fraudulent BANK OF AMERICA account XX/XX/2023 on my credit reports and it is still there as of this filing.
