Consumer Complaint: I am reaching out to Bank of America about a charged account on my credit profile. I am aware that to make this account charged off, you all had to write off this debt to have the account listed as Charged off. Upon looking at my credit report, I see that {$660.00} dollars have been written off. Because of this, I am asking that Bank of America provides me with Form XXXX to prove that you all have in fact written this account off. I am requesting that this form is submitted within 15 days. If you CAN NOT submit this form proving that this account is in fact charged off, I am demanding that you promptly delete this account. If you fail to comply with any of the requests that I am asking, I will not only hold this company accountable for tax fraud, but also proceed with filing a lawsuit. Account number : XXXX

Issue: Trouble during payment process
Subissue: Paying off the loan
Consumer Complaint: Bank of America has not responded to our XX/XX/XXXX complaint. Bank of America sent a letter directing us to contact someone identified as their attorney XXXX XXXX XXXX. When we reached out to XXXX XXXX he directed us back to Bank of America. We have not received a response to our XX/XX/XXXX complaint. In addition, Bank of America was informed on multiple occasions that we only authorized paper communications ( not electronic ) regarding this Mortgage account. Bank of America has subsequently refused to send us paper statements for XX/XX/XXXX and XX/XX/XXXX. We believe this is retaliation for filing these complaints. In addition, Bank of America sent a letter ( dated XX/XX/XXXX ) to us stating that approximately {$210000.00} was added to our home loan ( of which we learned about in or about XX/XX/XXXX ) because of arrearages. Apparently this is supposed to have occurred after Bank of America entered into Predatory Lending Settlement Agreements with California and the Feds. Bank of America has provided nothing to support its arrearage claim. Bank of America indicates that this arrearage of {$210000.00} occurred between XXXX to XXXX.

Consumer Complaint: On XX/XX/2023, i went into my online Bank of America account and noticed all these charges on my Visa card. They were all from XXXX XXXX XXXX. Someone had charged items from XXXX and XXXX XXXX. I immediately went to the Bank of America on XXXX XXXX in XXXX and spoke to an employee there ( dont remember his name ) .He called fraud Dept. for me so I could talk to them. They said they would investigate and the next day the charges were removed. I called XXXX and they told me they would investigate. Two weeks later the charges were back on my card. I was never notified by the bank that they were going to do that. I called the bank again and they then they told me that the charges were put back because XXXX sent them a letter stating that I signed something saying they were my charges, which is a lie. The Bank never showed me a copy of it and now XXXX is sending it to a collectiion agency, which means I willl have to pay twice for something I never bought in the first place. The bank never paid XXXX the money either. XXXX keeps trying to put the purchases through on the cancelled card.

Issue: Problem with a lender or other company charging your account
Subissue: Transaction was not authorized
Consumer Complaint: Amount : {$990.00} The debit card used for this transaction was in the possession of the account owners and it is unknown how the card number was stolen. This charge is the result of fraudulent activity and Bank of America has failed to investigate this matter in a satisfactory manner ; however, Bank of America deemed this to be a valid charge without any evidence to back their decision. Please see the following : 1. This charge was not made by either account owner. This statement was made to Bank of America representatives on XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX 2. The email address for this order is not the email address of the owner nor is it the address Bank of America has on file. 3. The email address listed for the business ( XXXX XXXX XXXX XXXX ) on the invoice is based in XXXX. The actual email address for XXXX XXXX is XXXX XXXX. XXXX XXXX is an established business that has been in operation for 75 years. This invoice is invoice # XXXX Bank of America can call XXXX XXXX to confirm that they are not on receipt # XXXX after 75 years in operation. 5. The payment was withdrawn on XX/XX/2023. The initial phone call made to Bank of America to dispute the charge by the account owners occurred on XX/XX/2023. The invoice was created on XX/XX/2023. This invoice was only created in response to our initiation of the dispute process. 6. This payment was made via XXXX. XXXX does not have a XXXX account for payment nor do they accept payment online. It is not possible to pay XXXX through a secure online system. XXXX. XXXX XXXX is a heating, air conditioning, refrigeration, and ventilation company. They do not sell goods. They operate out of Virginia and do not do business in California, where the account owners reside. The receipt shows the purchase of home tiles. They do not sell home tiles. There is no proof of delivery of the claimed purchased goods. We are highly dissatisfied with the lack of effort provided by the Bank of America fraud department. In addition, the level of investigation that we, the account owners, had to exert to discover some of this information was the responsibility of Bank of America ; however, it appears as if the Bank of America fraud department did not conduct any investigation prior to making their decision. The lack of attention to detail in checking the most basic of things ( i.e., account owners email address ) is negligent. The fact that Bank of America believes that {$990.00} is such a minor amount of money that can be stolen from their customers without concern is appalling. On the behalf of Bank of America, we have conducted a brief investigation where we were able to collect some information for Bank of America. Please see the attached document from the accounting department at XXXX XXXX. This is a statement of fact that neither account owner made this purchase and that they do not sell the items listed on the fraudulent receipts. A simple internet search populated a phone number for XXXX XXXX at the physical address listed on the receipts provided. We have listed it here ( XXXX ) for Bank of America as Bank of Americas fraud department has been previously unable to locate the business in question and conduct their own simple investigation by contacting the vendor. In turn, we demand that Bank of America provide us the following t o defend their investigative process : 1. Shipping and delivery address of the product claimed to be purchased. Proof of delivery that the product was delivered to the residence, business, or home owned by the account owners. Signature of the purchaser that matches a signature Bank of America has on file, identification of the receiver of the product, and/or any item that would be constituted as proof by a court of law. XXXX. Proof that XXXX XXXX has sold and/or delivered the product to one of the account owners. Documentation from XXXX XXXX that they have sold the product listed on the receipt to the account owners OR that they have sold this item and purchase was possible online or through XXXX. XXXX. PDF receipt created at the time of the charge. XXXX provides this when the charge is created and emails it to the purchaser automatically. XXXX. IP address of the purchaser of the product listed on the receipt. Proof that it is connected to the account owners. XXXX. Proof that the owner of the Square account that extracted the funds is connected to XXXX XXXX at XXXX XXXX XXXX XXXX in XXXX, VA XXXX As the Bank of America fraud department did not investigate, we now consider this to be theft sanctioned by Bank of America. If Bank of America attempts to hold us, the account owners, liable for the fraud committed, Bank of America must prove that we, the account owners, were either negligent or ourselves committed the fraud. Otherwise, return our money. Immediately.

Issue: Managing an account
Subissue: Problem using a debit or ATM card
Consumer Complaint: On XX/XX/2023 I went into a fuel station and proceeded to withdrawal some money out of the ATM. After putting in my pin and the amount I needed to be disbursed which was {$60.00} with a ATM fee of {$2.00}, the machine gave an error message and did not disperse any money. However, my bank account was still charged for the funds. I have filed a claim with my bank, and sent the receipt stating no money was ever giving. It has been almost a whole month an no resolution. I just want my money back because it is rightfully mine. The bank is refusing to give me my money after they have all of the proof. This bank, Bank of America has been going down hill for years. No managers have returned any messages that have been left. I am highly upset and disappointed. I just want MY MONEY!

Subissue: Account opened without my consent or knowledge
Consumer Complaint: I received email notification that an account was opened by me with Bank of America. I immediately contacted Bank of America fraud and was given a phone number to reach out to during the investigation. All of the Bank of America numbers will not allow you to speak to someone unless you enter your online pin. I did not open the account, so how could I have this information? Now I have received a debit card not only from Bank of America but from Merrill Lynch also. Once again, trying to contact them is impossible.
