Consumer Complaint: I told American Express long time ago that all communications from Amex should come to me via online, NO paper mail. A couple of days ago I called Amex and asked the operator to confirm if that setting is activated and he confirmed that all communications from Amex would come to me via online ONLY, and that is how it is set up. This was confirmed to me over the phone two days ago. Go listen to that phone call. Hours later I receive two emails from Amex which states " Withdrawal of your consent to receive Account Communications in electronic format ''. Who gave this consent? What's going on here? Are you trying to play games with me?

Consumer Complaint: XX/XX/XXXX thru XX/XX/XXXX i been trying to retrieve my money that was used in a scam.And when i called you, the money was still pending and u didnt stop it the transaction u told me that it had to be recieve first and then u could get my money back.. U told me to register my card on 4 attempts it never got register on the 5th attempt it was denied and you told me to report it to police ... And your custumer service was rude and horrible especially the foriegn women ... Your card was used and requested by this company to scam me out of my money ... And you didnt help me to get it back ut seem to me like you was in this together ... The Scam

The terms were XXXX points once I hit a spend of {$2000.00}. I agreed to this offer in XX/XX/XXXX and completed the {$2000.00} spend requirement on XX/XX/XXXX. I paid the agreed upon prorated annual fee of {$60.00} on XX/XX/XXXX. Today is XX/XX/XXXX and I still have not received the promotional XXXX points as promised. I have tried to contact the bank many times and they just give me the run around saying the points will show up next month every time I call.

AMERICAN EXPRESS has been notified in writing to cease and desist communication. AMERICAN EXPRESS continues to violate my consumer rights while continuing communication through mail and emails even after receipt of Cease-and-desist letter. Pursuant 15 usc 1691 ( a ) Activities constituting discrimination It shall be unlawful for any creditor to discriminate against any applicant, with respect to any aspect of a transaction- because the applicant has in good faith exercised any right under this chapter AMERICAN EXPRESS suspended all charging privileges threated to cancel my consumer credit plan and threated to refer my consumer credit plan to a local attorney offic after I invoked my consumer rights. AMERICAN EXPRESS is in violation of 15 USC 1692b ( 5 ) not use any language or symbol on any envelope or in the contents of any communication effected by the mails or telegram that indicates that the debt collector is in the debt collection business or that the communication relates to the collection of a debt. AMERICAN EXPRESS sent mail with symbols on and in the content inside the envelope through the mails that indicates their in the debt collection business. Consumer Complaint: I XXXX XXXX XXXX entered into a consumer credit transaction with American Express in XX/XX/2017. A Consumer credit transaction where the social security credit card was involved. Pursuant 15 USC 1602 ( l ) the term credit card means any card, plate, coupon book or other credit device existing for the purpose of obtaining money, property, labor, or services on credit. Pursuant 15 USC 1602 ( g ) ( 2 ) the term creditor refers only to a person to whom the debt arising from the consumer credit transaction is initially payable on the face of the evidence of indebtedness or, if there is no such evidence of indebtedness, by agreement. Notwithstanding the preceding sentence, in the case of an open-end credit plan involving a credit card, the card issuer and any person who honors the credit card and offers a discount which is a finance charge are creditors Pursuant 15 usc 1602 ( g ). I am the original creditor in the consumer credit transaction I granted American Express the right to extend credit deriving from the open-end consumer credit plan. During the consumer credit transaction, a finance charge was involved. 15 USC 1605 defines a finance charge as the sum of all charges in a consumer credit transactionThe finance charge does not include charges of a type payable in a comparable cash transaction but American Express took monthly cash payments which is a violation of my consumer rights. Pursuant 15 usc 1692j ( a ) it is unlawful to design, compile, and furnish any form knowing that such form would be used to create the false belief in a consumer that a person other than the creditor of such consumer is participating in the collection of or in an attempt to collect a debt such consumer allegedly owes such creditor, when in fact such person is not so participating. Pursuant 15 usc 1692j ( b ) Any person who violates this section shall be liable to the same extent and in the same manner as a debt collector is liable under section 1692k of this title for failure to comply with a provision of this subchapter. 15 USC 1692 defines a debt collector as any person who uses any instrumentality of interstate commerce or the mails in any business the principal purpose of which is the collection of any debts or who regularly collects or attempts to collect a debt ... American Express sent monthly statements attempting to collect a debt but did not state they were attempting to collect an alleged debt. Pursuant 15 USC 1692e ( 11 ) The failure to disclose in the initial written communication with the consumer that the debt collector is attempting to collect a debt ... is a violation of consumer rights. American Express repeatedly violated my consumer rights by mailing statements with deceptive and misleading representations alleging I owed a debt. 15 USC 1692g ( c ) states The failure of a consumer to dispute the validity of a debt under this section may not be construed by any court as an admission of liability by the consumer AMERICAN EXPRESS violated my consumer right limitlessly. Pursuant 15 USC 1611 Whoever willfully and knowingly ( 1 ) gives false or inaccurate information or fails to provide information which he is required to disclose under the provisions of this subchapter, or any regulation issued thereunder, ( 3 ) otherwise fails to comply with any requirement imposed under this subchapter, shall be fined not more than {$5000.00} or imprisoned not more than one year, or both.
